07201989517 HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, JULY 20, 1989 MINUTES CORRECTED The Harnett County Board of Commissioners met in regular session on Thursday, July 20, 1989, at the County Office Building in Lillington, North Carolina, with the following members present: Rudy Collins, Bill Shaw, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were Dallas H. Pope, County Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board; and Kay S. Blanchard, Recording Secre- tary. Chairman Lloyd G. Stewart called the meeting to order at 7 p.m. Commissioner Mack Reid Hudson offered the invocation. Commissioner Shaw moved that the minutes of the regular meeting, July 3, 1989, be approved with the following correction: On motion to come out of executive session, the minutes should read that Commissioner Collins seconded the motion, not Commissioner Shaw as stated in the minutes. Commissioner Hudson seconded the motion to correct and approve the minutes of July 3, 1989, and it passed with a unanimous vote. RESOLUTION RE: E. Marshall Woodall, Attorney, presented a resolution to Authorize Assignment TAX FORECLOSURE of Bid in Tax Foreclosure. Commissioner Shaw moved to adopt the resolution. Commissioner Collins seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated July 20, 1989, as document no. 1. UNCOLLECTIBLE INSP. ACCOUNTS CHARGED OFF Dallas H. Pope, County Manager, presented request to charge off uncollectible building inspection accounts. Commissioner Collins moved to approve the request. Commissioner Smith seconded the motion and it passed with a unani- mous vote. The list of uncollectible building inspection accounts is copied in full at the end of these minutes dated July 20, 1989, as document no. 2. EDSEL SMITH Commissioner Collins moved that Mr. Edsel G. Smith, Rt. 2, Box 224 -A, Fuquay- JURY COMMISSION Varina, be appointed to serve on the Jury Commission for a two -year term, July 1, 1989 - June 30, 1991. Commissioner Shaw seconded the motion and it passed with a unanimous vote. VANESSA YOUNG REAPPOINTED FINANCE OFFICER & CLERK TO THE BOARD RESOLUTION ADDING STREETS TO STATE ROAD SYSTEM SUBDIVISION PLATS QUAIL ACRES TIRZAH VILLAGE AGREEMENTS WITH FIRE & RESCUE DISTRICTS Commissioner Hudson moved to reappoint Vanessa W. Young to serve as Finance Officer and Clerk to the Board for a period of one year. Commissioner Collins seconded the motion and it passed with a unanimous vote. W. Glenn Johnson, County Attorney, administered the Oath of Office to Vanessa W. Young, Finance Officer and Clerk to the Board. Commissioner Shaw moved to adopt a resolution adding two streets in Sierra Villa Subdivision to the State's Secondary Road System. Commissioner Smith seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated July 20, 1989, as document no. 4. Greg Wilder, Planner, presented a subdivision plat for Quail Acres, consisting of 7 acres located on SR 1278 in Upper Little River Township. Commissioner Hudson moved for the approval of the subdivision plat. Commissioner Collins seconded the motion and it passed with a unanimous vote. Greg Wilder, Planner, presented a subdivision plat for Tirzah Village, con- sisting of 11 lots located on SR 1291 in Upper Little River Township. Commis- sioner Shaw moved for the approval of the subdivision plat. Commissioner Collins seconded the motion and it passed with a unanimous vote. Commissioner Smith moved that Agreements between Harnett County and the following 18 Special Districts located within the County be approved in accordance with the provision of N.C. Gen. BUDGET AMENDMENTS Dallas H. Pope, County Manager, requested a budget amendment for Governing Body, Code 10- 4100 -150, Alternative Classroom, $46,305. increase. Commis- sioner Shaw moved for the approval of the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. REPORT ON TDP APPLICATION Dallas H. Pope, County Manager, requested the following budget amendment for Education: Code 10- 8600 -107 School - Current Expense $82,100. increase Code 10- 8600 -108 School - Capital Outlay 82,100. decrease Commissioner Smith moved for the approval of the budget amendment. Commis- sioner Collins seconded the motion and it passed with a unanimous vote. Dallas H. Jerry Blanchard, Director, Transportation and Procurement, briefed the Board on grant commitment for Harnett County Council for Senior Citizens, Inc. to be used to purchase two vans and to rehabilitate three vans. SPECIALIZED DATA Commissioner Shaw moved for the approval of a sales contract and license SYSTEMS CONTRACT agreement between Harnett County and Specialized Data Systems in the amount of $32,450. Commissioner Smith seconded the motion and it passed with a unanimous vote. RESOLUTION RE: CAPE FEAR REGIONAL WW SYS. LIBRARY DESIGNATED FOR NC ADMIN. CODE OVERTIME PAY FOR COMMUNICA- TIONS EMPLOYEES 1990 HOLIDAY SCHEDULE John M. Phelps, II, Public Utilities Attorney, presented a Resolution Imple- menting Development of Cape Fear Regional Wastewater System. Commissioner Smith moved for the adoption of the resolution. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated July 20, 1989, as document no. 5. Commissioner Hudson moved that the Harnett County Library be designated as the county agency responsible for the North Carolina Administrative Code. Commis- sioner Collins seconded the motion and it passed with a unanimous vote. Commissioner Collins moved for the approval of overtime pay for regular employees of Sheriff's Department Communications function. Commissioner Shaw seconded the motion and it passed with a unanimous vote. Commissioner Smith moved for the adoption of the following Calendar Year 1990 Holiday Schedule for Harnett County in accordance with the Harnett County Personnel Ordinance. Statute 121 -5(b). Commissioner Collins made a motion to approve disposal of records as requested. Commissioner Smith seconded the motion and it passed with a unanimous vote. EXECUTIVE SESSION Commissioner Collins moved that the Board go into Executive Session. Commis- sioner Hudson seconded the motion and it passed with a unanimous vote. Young, Clef to tH@ Board UMW en.ac.J RESOLUTION THAT WHEREAS, the Harnett County Tax Collector caused a tax foreclosure suit to be commenced in that certain case entitled "County of Harnett vs. Wilmer B. Breeden, James Breeden and the City of Dunn ", bearing case number 87 CvD 0926 in the District Court of Harnett County; and WHEREAS, the District Court on the 11th day of November, 1988 ordered the lands described in the complaint to be sold to satisfy the cost of sale and accrued taxes on said lands; and WHEREAS, on the 15th day of May, 1989 at 12:00 o'clock noon, E. Marshall Woodall, Commissioner, caused said lands to be sold at which time the County of Harnett became the high bidder in the amount of $824.02 and that said Commissioner reported said sale to the Court on May 19, 1989; and WHEREAS, the Court has received no upset or raised bid; and WHEREAS, Charles G. McCrae and wife, Hattie McCrae have a deed to a portion of the property above mentioned and owns lands adjoining other portions of the property above mentioned and has offered to purchase the high bid from the County of Harnett for the amount of the bid entered by the County of Harnett; and WHEREAS, by authority set forth in N.C.G.S. 105- 376(A) the County of Harnett as a taxing unit who becomes a successful bidder may assign its bid at any time by private sale for not less than the amount of its bid; and WHEREAS, it has been made to appear to the Harnett County Board of Commissioners that the aforesaid mentioned property is 520 approximately four (4) lots as shown on an old division known as "Goodman Subdivision" as shown in a map recorded in Map Book 1, Page 10, Harnett County Registry; that one of said lots is claimed by Charles G. McCrae and wife, Hattie McCrae, that one lot measures approximately 12.5 feet wide and that the remaining two lots front approximately 50 feet on Ham Street (now known as Fayetteville Street) in the City of Dunn and that there is some question as to the title to said lands and further that said lands are vacant properties; and WHEREAS, no one appeared at the above mentioned auction sale held by Commissioner E. Marshall Woodall and that as a result thereof, the County of Harnett became the high bidder for the amount of taxes and costs involved in the foreclosure suit; and WHEREAS, it has been made to appear to the Harnett County Board of Commissioners that it is in the best interest of the County that the County assign its bid to said property to Charles G. McCrae and wife, Hattie McCrae. NOW, THEREFORE, BE IT RESOLVED that the County of Harnett assign its bid mentioned aforesaid to Charles G. McCrae and wife, Hattie McCrae upon their payment to the County of its high bid as mentioned above in the amount of $824.02 and that further the officials of the County of Harnett to include the Chairman and Clerk to the Board of Commissioners be and they are hereby authorized to execute an assignment of bid and further that the officials of the County of Harnett are hereby authorized to do and perform all matters and things necessary to carry out the intent of this resolution. RESOLUTION IMPLEMENTING DEVELOPMENT OF CAPE FEAR REGIONAL WASTEWATER SYSTEM WHEREAS, the Harnett County Board of Commissioners, (hereinafter sometimes referred to as the "Board ") has previously directed that a study be conducted to examine and analyze the wastewater facilities needs of Harnett County, and as a result thereof, a Comprehensive Wastewater Study has been prepared which recommends certain facility development, including the construction of a wastewater facility system designated as the Cape Fear Regional Wastewater System; and WHEREAS, in anticipation of the need for construction of wastewater facilities in the County, the Board has previously requested Federal and State assistance in funding the construction of the same; and WHEREAS, the aforementioned funding assistance request has been evaluated by the appropriate governmental agency as indicated below, and as a result thereof, the County has been informed that under the applicable guidelines, the proposed Cape Fear Regional Wastewater System Project has been assigned a high funding priority for fiscal year 1990, and WHEREAS, pursuant to the North Carolina Clean Water Revolving Loan and Grant Act of 1987 and the provisions of the Federal Water Quality Act of 1987, the State of North Carolina, through its Division of Environmental Management, Department of Natural Resources and Community Development, has indicated that funds for a loan in the amount of $7,500,000.00 to fund the costs of the Cape Fear Regional Wastewater System will be reserved for Harnett County, if the County commits to proceed with the implementation of the Cape Fear Regional Wastewater System Project in accordance with a schedule of events concluding with completion of plans and specifications by December, 1990; and WHEREAS, it is the desire of the Board to proceed with the various courses of action required to implement the planning of the Cape Fear Regional Wastewater System Project as designated above, and in connection therewith further desires to acknowledge its intent and commitment to accept the described financial assistance and to proceed with implementation of the project in accordance with the referenced schedule of events so as to secure and qualify for the aforementioned loan to the end that the same may be allocated and reserved for Harnett County for its use in the event that construction is commenced. NOW THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS THAT: 1. Harnett County hereby acknowledges and states its intent and commitment to proceed with implementation of the Cape Fear Regional Wastewater System Project in accordance with a schedule of events concluding with the completion of plans and specifications therefor by December, 1990, to the end that the County may accept the aforementioned loan when offered, and ultimately construct the referenced Project. 2. The County Manager and the Director of the Harnett County Department of Public Utilities, in conjunction with the consulting engineers, and with the approval of the Division of Environmental Management, Department of Natural Resources and Community Development of the State of North Carolina are hereby directed to prepare the necessary schedule of events to be followed ih implementing the desired project. 3. The appropriate representatives of Harnett County, as determined by the County Manager, are hereby authorized and directed to proceed with the various courses of action required to implement the initial stages of the plans to develop the construction project as recommended. 4. The Harnett County Public Utilities Attorney is directed to forthwith transmit a certified copy of this Resolution to the appropriate representative of the State of North Carolina, Department of Natural Resources and Community Development, Division of Environmental Management.
