03141989SOUTH CENTRAL WATER AND SEWER DISTRICT, MARCH 14, 1989 The Board of Commissioners of Harnett County, sitting as the governing body of the South Central Water and Sewer District of Harnett County, met in special session on March 14, 1989 at 7:00 o'clock p.m. in the Harnett County Office Building, Lillington, North Carolina. Members of the Board present were: Chairman Lloyd G. Stewart, Bill Shaw, Rudy Collins, Mayo Smith and Mack Reid Hudson. No members were absent. The Clerk of the Board of Commissioners and of the District reported to the Board of Commissioners of the County of Harnett, sitting as the governing body of the South Central Water and Sewer District of Harnett County, that the bond order entitled, "Bond Order Authorizing the Issuance of $2,769,000 Water Refunding Bonds of the South'Central Water and Sewer District of Harnett County," which had been introduced on February 20, 1989, had been published on March 1, 1989, with notice that the Board of Commissioners, sitting as the governing body of the District, would hold a public hearing thereon on March 14, 1989, at 7:00 o'clock, P.M. The Clerk of the Board of Commissioners and of the District also reported that the District's Finance Officer had filed in the Clerk's office a statement of debt complying with the provisions of The Local Government Bond Act, and such statement as filed showed the net indebtedness of the District to be 2.1 % of the appraised valuation of property in the District subject to taxation. Commissioner Hudson moved that the Board, sitting as the governing body of the District, proceed to hold a public hearing on the refunding bond order. The motion was seconded by Commissioner Shaw and was unanimously adopted. At 7 :06 o'clock, P .M., the Chairman of the governing body of the District announced that the Board of Commissioners, sitting as the governing body of the District, would hear anyone who wished to be heard on the questions of the validity of the refunding bond order and the advisability of issuing the refunding bonds. At the direction of the Chairman, the Clerk read the refunding bond order and the published notice of hearing. After the Board of Commissioners, sitting as the governing body of the District, had heard all persons who requested to be heard in connection with the foregoing questions, Commissioner Collinsmoved that the public hearing be 299 closed. The motion was seconded by Commissioner Shaw and was unanimously adopted. Commissioner Smith moved that the Board of Commissioners of the County of Harnett, sitting as the governing body of the South Central Water and Sewer District of Harnett County, adopt and direct the Clerk of the Board of Commissioners and of the District to publish as prescribed by The Local Government Bond Act the bond order entitled, "Bond Order Authorizing the Issuance of $2,769,000 Water Refunding Bonds of the South Central Water and Sewer District of Harnett County," introduced at the meeting of the Board of Commissioners of the County of Harnett, sitting as the governing body of the South Central Water and Sewer District of Harnett County, held on February 20, 1989. The motion was seconded by Commissioner Shaw vote: AYES: 5 NAYS: 0 and was adopted by the following RESOLUTION AWARDING CONTRACTS FOR WATER FACILITIES PROJECT - PHASE II SOUTH CENTRAL WATER AND SEWER DISTRICT OF HARNETT COUNTY WHEREAS, the Harnett County Board of Commissioners, sitting as the governing body of the South Central Water and Sewer District of Harnett County (hereinafter the "Board ") has received from the Consulting Engineers the results from the public bids on Contracts I through III of the Phase II Water Facilities Project for the South Central Water and Sewer District of Harnett County (hereinafter the "District "); and WHEREAS, the Engineers' discussion of bids has recommended award of the contracts to the lowest responsible bidders which have presented legally sufficient bids based on acceptance of the proposals that will result in the best pricing available to the District; and WHEREAS, the Board considers it in the best interest of the District to proceed with acceptance of the lowest contract proposals recommended by the Consulting Engineers, subject to final approval by the attorney for the District and the Farmers Home Administration, and desires to make provisions for the execution of contract documents and other related matters with respect thereto. 300 NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners, sitting as the governing body of the South Central Water and Sewer District of Harnett County as follows: 1. That Contracts I through III for the Phase II Water Facilities Project are hereby awarded to the following contractors at the amount shown, contingent upon approval by the Farmers Home Administration of the United States Department of Agriculture, and subject to the final approval by the attorney for the District: Contract I - Water Line Extensions Award to: C. K. Andrews Contracting, Inc. 1057 Andrews Road Fayetteville, N.C. 28311 For the unit price of $644,498.85, subject to adjustment as provided by the contract documents. Contract II (Alternate) - Booster Pumping Station Award to: Brown Utility Co. 202 Branchview Drive Concord, N.C. 28025 For the negotiated lump sum contract price of $149,800.00, subject to adjustment as provided by the contract documents. Contract III (Alternate) — Water Storage Tank Award to: Fisher Tank Co. 2330 Two Notch Road Lexington, S.C. 29072 For the negotiated lump sum contract price of $253,700.00, subject to adjustment as provided by the contract documents. 2. That after the approvals as stated above have been obtained, the Chairman of the Board and the Clerk to the Board are authorized to execute the contract documents pertaining to the above made contract awards. 3. That upon completion of the proper execution of said contract documents, and upon further authorization by the Farmers Home Administration of the United States Department of Agriculture, Dallas H. Pope, Harnett County Manager, is hereby authorized to issue Notices to Proceed so as to cause the construction of the aforementioned Project to commence. 301 PROJECT ORD. 4. That Dallas H. Pope is hereby authorized to execute such other documents and take such actions as are necessary to implement the directions of this Resolution. Commissioner Collins seconded the motion and it passed with a unanimous vote. .SOUTN CENTRAL PHASE II WATER AND SEWER DISTRICT ' PROJECT ORDINANCE BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina sitting as the governing board for South Central Phase II Water and Sewer District: Section 1. The South Central Phase II project consists primarily of Northwest section of Anderson Creek Township. The present population within the district is approximately 8,500 based on 2.74 persons per household. There are 150 potential connections along the proposed lines of Phase II. There are presently over 150 connections that have committed to take water upon completion of the project. It is estimated that with the completion of Phase I and Phase II of this district, the total customer count will be 2,400. The project will mainly consist of 14 miles of water mains, fire hydrants, one master meter vault, booster pumping station and 150 individual meter services. Water for this Phase will be purchased from the Northeast Metropolitan Water District at the connection point located at Duncan Street in Lillington. The district will contract with the County utility department to manage and operate the system. The district will be regulated by the South Central Board of Advisors and the Harnett County Board of Commissioners. Section 2. The following amounts are hereby appropriated in the South Central Phase II Water and Sewer District for the construction of this project: Construction $ 1,047,999. Engineering Fees 119,401. Land and Right of Ways 10,000. Legal and Administration 18,000. Meters Interest Contingency Total 7,000. 54,250. 18,600. $ 1,275,250. Section 3. It is estimated that the following revenues will be available in the South Central Phase II Water and Sewer District: Farmers Home Administration Loan 951,000. Farmers Home Administration Grant 313,000. Tap -On -Fees 11,250. Total $ 1,275,250.
