The Harnett County Board of Commissioners met in regular session on Monday, September 17,
2012, in the Commissioners Meeting Room, County Administration Building, 102 East Front
Street, Lillington, North Carolina.

Chairman McNeill called the meeting to order at 7:00 pm. Commissioner Andrews led the
pledge of allegiance and invocation.
Chairman McNeill called for additions and deletions to the published agenda. Chairman
McNeill requested the addition of 1) Airport Administrator's request to approve the easement
document that allows Progress Energy electrical access providing HRJ Leasing, LLC power
hookup for 90' x 100' corporate hanger under construction and T- hanger; 2) Sheriff's Office
request permission to accept a grant from the Governor's Highway Safety in the amount of
$8,560 to purchase equipment that will be used to conduct DWI checkpoints and other traffic
checkpoints; 3) Sheriff's Office request permission to accept award from the State of North
Carolina to operate the Criminal Justice Partnership Program in Harnett County; and 4) budget
amendments for the Sheriffs Office and Re- Entry. Commissioner Burgin moved to approve the
agenda as amended. Commissioner Andrews seconded the motion which passed unanimously.
Commissioner Burgin requested a correction to the September 4, 2012, regular meeting minutes
and the attached resolution authorizing the negotiation of an installment financing contract
regarding Highland Middle School. Commissioner Burgin said he did make the motion to accept
that resolution as he understood it as a condition of getting the funding but he still thinks there is
a better way to do it and he is not for any tax increase.
Commissioner Burgin also pointed out in April 18, 2011, regular meeting minutes that the Board
unanimously adopted a resolution petitioning its legislative delegation for a two
percent local sales tax for public school construction and financing as well as unanimously
agreeing to lower the property taxes by .04 cents if the two percent local sales tax referendum
passed.

Commissioner House moved to approve the items on the revised consent agenda. Vice
Chairman Hill seconded the motion and the Board unanimously approved the following items on

3. Tax refunds, rebates and releases (Attachment 1)
4. NC Parks and Recreation requested that the tipping fee be waived at the Harnett County
landfill for the trash collected by the Big Sweep volunteers. All trash collected from the
Harnett County Big Sweep sites would be taken to the Dunn -Erwin Landfill the week of
October 6 — 12 by Raven Rock State Park staff. In 2011, 27 volunteer removed over 950
pounds of debris from cleanup sites along the Cape Fear River in Harnett County.
5. Public Utilities requested approval of a final increasing change order of $13,694.75. This
final change order is associated with the force main construction contract for the Erwin
Wastewater Improvements project and brings the total contract amount of to
$3,589,669.95. This increase is mainly due to quantity adjustments and extra work
associated with a bore under Bunnlevel Erwin Road.
6. Public Utilities requested approval to award a construction contract in the amount of
$4,294,947 to Sanford Contractors, Inc. for the Southwest/NTA Cameron Hills
Transmission Project. This project is mainly being funding by a $3,500,000 Department
of Army grant with the remaining funds coming from HCDPU reserves. (Attachment 2)
7. Public Utilities requested approval of an amendment to existing subcontract agreement
with American Water. American Water is currently under contract with the County to
operate and maintain the Fort Bragg Wastewater Plant until the planned infrastructure
improvements are complete. This will allow the County to treat all of Fort Bragg's
wastewater. This amendment changes the language concerning responsibility for the
planning decommissioning of the existing plant that should be completed by December
31, 2012.
8. Resolution of the County of Harnett, North Carolina, Declaring the Intent of the County
of Harnett, North Carolina, to Reimburse Itself for Capital Expenditures Incurred in
Connection with Improvements to Certain of Solid Waste Facilities from the Proceeds of
Tax - Exempt Obligations to the Executed and Delivered in Fiscal Year 2013.

9. Airport Administrator's requested approval of easement document that allows Progress

10. Sheriffs Office requested permission to accept a grant from the Governor's Highway
Safety in the amount of $8,560 to purchase equipment that will be used to conduct DWI
checkpoints and other traffic checkpoints. No local match is required.
11. Sheriff's Office requested permission to accept award from the State of North Carolina to
operate the Criminal Justice Partnership Program in Harnett County. No local match is
required. These programs serve sentenced offenders that are placed on probation. The
program provides drug counseling, life skill classes and other classes. This program is

designed to reduce the number of offenders who return to the court system after
completing probation. The Sheriff's Office also requested permission to hire one full
time employee and one part-time employee with those costs being funding from the
program.
Chairman McNeill opened the floor for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes.
- Sharlene Jones of Angier asked commissioners to do something about the medication
portion of the insurance plan before January 2013. She said some people are not taking
their medication because they can't afford it.
- Joe Langley, 298 Kirk Adams Road of Angier, said he is concerned that citizens do not
know the facts or consequence regarding new schools in Harnett County.
The Harnett County Board of Commissioners reconvened as the Governing Body of the South
Central Water and Sewer District of Harnett County.
Mr. Sauer presented to the Board; prepared by the county's bond counsel, the Resolution of the
Board of Commissioners of the County of Harnett, North Carolina, Sitting as the Governing
Body of the South Central Water and Sewer District of Harnett County, Providing for the
Issuance of $13,211,000 General Obligation Water and Sewer Bond Anticipation Notes, Series
2012B, of the South Central Water and Sewer District of Harnett County. Commissioner House
moved to adopt the resolution as presented. Commissioner Andrews seconded the motion which
passed unanimously. (Attachment 4)
Jennifer Slusser, Staff Attorney, requested approval of the Board of Commissioners of the
County of Harnett, North Carolina, Sitting as the Governing Body of the South Central Water
and Sewer District of Harnett County, on the Settlement of 12 CVS 0171, South Central Water
and Sewer District of Harnett County v. James A. Donavan - Declaration of Taking and Notice
of Deposit (Condemnation) in the amount of $11,500.
Commissioner Burgin confirmed that the settlement presented for approval was the same as
previously shared with commissioner and moved to approve the settlement which included the
following additional terms:
1. Defendant will not release any information related to this settlement, either verbally or
by written or electronic communication, except as may be required by law;
2. South Central will provide Defendant with the installation of 1 sewer tap at no cost to
Defendant
3. South Central will provide Defendant with a $500 credit to be applied against
monthly sewer fees; and
4. South Central will be responsible for all costs of mediation.
Vice Chairman Hill seconded the motion which passed unanimously.

Mark Locklear, Planning Manager, petitioned the board for a public hearing regarding the :
Proposed Zoning Change: Owner of Record: Allied Investors, Inc,; Applicant: Crosland
Southeast, From RA -20R to Commercial Zoning, 1.2 +/- acres from a 10.0 +/- acre tract,
SR1115- Buffalo Lake Road, Barbecue Township. Mr. Locklear noted a public hearing was held
by the Planning Board on Tuesday, September 4, 2012, and a unanimous vote was taken to
recommend the County Commissioners approve the request based upon favorable findings.
Mr. Locklear reported the site is currently vacant with surrounding land uses consisting of Fool
Lion Strip Mall, Quail Creek, Orchard Crest, The Summit, Highland Forest, Sunset Ridge
Subdivisions and vacant land. As required for all zoning changes within a five mile radius of
Fort Bragg, Regional Land Use Advisory Commission (RLUAC) was contacted regarding this
request.
Mr. Locklear reported staff evaluation as:
- The IMPACT to the adjacent property owners and the surrounding community is
reasonable, and the benefits of the rezoning outweigh any potential inconvenience or
harm to the community. REASONING: The requested zoning to commercial would
not have an unreasonable impact on the community, due to already existing
commercial zoning and uses in the area.
- The requested zoning district is NOT COMPATIBLE with the existing Land Use
Classification. REASONING: The requested zoning is not compatible with the
existing land use classification of Medium Density Residential. Medium Density
Residential is meant to encourage stick built and manufactured residential
developments. However, the requested zoning to commercial would be appropriate
due to the surrounding land uses and staff recommends amending the land use plan.
- The proposal does ENHANCE or maintain the public health, safety and general
welfare. REASONING: The request zoning to commercial would maintain the
public health, safety and general welfare due to the other commercial use sin the area.
- This request is NOT for a small scale rezoning. REASONING: This site is adjacent
to commercially zoned property and therefore would not need to be evaluated as a
small scale rezoning.
Suggested Statement -of- Consistency: Staff concludes that the requested rezoning to
Commercial is compatible with Harnett County regulatory documents and would not have an
unreasonable impact on the surrounding community and will enhance the public health, safety,
and general welfare for the reasons stated in the evaluation. It is recommended that this rezoning
request be approved.
Mr. Locklear told commissioners the site might be used for a Family Dollar.
Chaiiiiian McNeill called to order a public hearing on the matter and opened the meeting for
comments from the public. Seeing no one move, Chairman McNeill closed the public hearing.
Commissioner Burgin moved to approve the rezoning request as presented. Commissioner
Andrews seconded the motion which passed unanimously.

Mr. Locklear petitioned the board for a public hearing regarding a proposed zoning change:
Swift Creek Prop. LLC, Denis Bergeron: From RA -20R to Industrial Zoning, 45.0 +1- acres,
NC210S, 100 Tweety Ln., Anderson Creek Township. Mr. Locklear noted a public hearing was
held by the Planning Board on Tuesday, September 4, 2012, and a unanimous vote was taken to
recommend the County Commissioners approve the request based upon favorable findings for
Small Scale Rezoning and Standards of Review.
Mr. Locklear reported the site is currently occupied by an existing business and auto repair,
salvage yard, recycling center, Municipal Solid Waste Transfer Station, race track and a single
family dwelling. Surround land uses consists of Cook's Mobile Home Park, stick build homes,
doublewide and singlewide manufactured homes, storage facility and vacant land. It was noted
On May 10, 2010, this property received conditional use approval for an expansion of the
existing salvage and recycling center and as required for all zoning changes within a five mile
radius of Fort Bragg, Regional Land Use Advisory Commission (RLUAC) was contacted
regarding this request.
Mr. Locklear reported staff evaluation as:
The IMPACT to the adjacent property owners and the surrounding community is
reasonable, and the benefits of the rezoning outweigh any potential inconvenience or
harm to the community. REASONING: The impact to adjacent property owners and
surrounding community is reasonable and minimal, due to the fact that this property
has been used as an industrial site for a number of years. The proposed rezoning will
bring the subject property into compliance with the Unified Development Ordinance.
- The requested zoning district is NOT COMPATIBLE with the existing Land Use
Classification. REASONING: The requested zoning is not compatible with the
existing land use classification of Medium Density Residential. However, the
existing use is currently a use that existed prior to rezoning. Due to the duration of
time this business has been in existence, staff's recommendation is to amend the Land
Use Plan to comply with the existing use.
- The proposal does ENHANCE or maintain the public health, safety and general
welfare. REASONING: The current use has existed on this site for several years and
has not shown any signs of being a nuisance to the public health, safety and general
welfare of the community.
- This request is for a small scale rezoning and should be evaluated for reasonableness.
REASONING: The proposed rezoning to Industrial is not adjacent to any industrially
zoned land and thus the application must be considered as a Small Scale Rezoning.
Suggested Statement -of- Consistency: Staff concludes that the requested rezoning to Industrial
is compatible with Harnett County regulatory documents and would not have an unreasonable
impact on the surrounding community and will enhance the public health, safety, and general
welfare for the reasons stated in the evaluation. It is recommended that this rezoning request be
approved.

Mr. Locklear petitioned the board for a public hearing regarding Proposed UDO Text
Amendments: Applicant: Harnett County Planning Services; Unified Development Ordinance:
Article V, Section 1.2; Article XIV, Section 2.2 Proposed Additions and revisions to the "Table
of Uses" and "Definitions ". Mr. Locklear reported that the Planning Board reviewed all
proposed text amendments. He said a unanimous vote was taken at the September 4, 2012
Planning Board meeting to recommend approval of the proposed amendments as presented.
Mr. Locklear reported the proposed changes were due to concerns shared by the Brightwater
Board. Mr. Locklear noted that originally Office and Institutional (0 & I) was designed for
Campbell University. He said he believes the outside parcels at Brightwater were originally
zoned commercial.
Chairman McNeill called to order a public hearing on the matter and opened the meeting for
comments from the public. Seeing no one move, Chaiunan McNeill closed the public hearing.
Commissioner Burgin asked staff to include links on the Board of Commissioner's agenda to the
Planning Department for citizens who would like to review zoning change applications prior to
public hearings. Commissioner Andrews moved to approve the text amendments as presented
and resolution amending the Harnett County Unified Development Ordinance. Vice Chairman
Hill seconded the motion which passed unanimously. (Attachment 5)
Mr. Sauer presented the following report:
- August 2012 Landfill Billing
- August 2012 Veterans Affairs Activities
Mr. Sauer also noted the Harnett County Board of Education had adopted the necessary
resolutions to provide for lease agreement and property transfer for Highland Middle School and
the application had been submitted to the Local Government Commission. Mr. Sauer also
reminded the group of their upcoming special session schedule at 7:00 pm on September 25,
2012.
Vice Chairman Hill moved that the Board go in to closed session to discuss certain personnel
matters. This motion was made pursuant to N.C. General Statute Section 143- 318.11(a)(6).
Commissioner Andrews seconded the motion which passed unanimously.
Vice Chairman Hill moved that the Board come out of closed session. Commissioner Andrews
seconded the motion which passed unanimously.
Chairman McNeill called for any new business. Commissioner Burgin moved to give Coats
Chamber of Commerce a one -time donation of $5,000 for their centennial Farmer's Day Festival
celebration. Commissioner House seconded the motion which passed unanimously.
Commissioner Burgin moved that the Board waive $8005 in fees for the Good Hope Psychiatric
Facility to establish water and sewer services with Harnett County Public Utilities.
Commissioner Andrews seconded the motion which passed unanimously.

Commissioner Burgin said he receives a number of calls from people asking what incentives the
county offers potential new businesses. Commissioner Burgin said we need to come up with a
more comprehensive method and asked Mr. Sauer to work up some examples including in -kind
contributions as well as what has been done with Brightwater.
Commissioner Burgin requested a report from Human Resources Director John Rankins
regarding the number of county vehicles that are no longer being driven to and from home by
staff not on call as well as the projected cost savings to the county for parking those vehicles.
Commissioner Burgin played a voicemail message from his personal cell phone and then asked
Daniel Glover, a member of the audience who is also a candidate for county commissioner, if he
left the voicemail message saying "the board of commissioners has raised property taxes three
times over the last five years ". Commissioner Burgin said the statement was not true which was
confirmed by Mr. Sauer. Chairman McNeill asked that the exchange between the two gentlemen
stop during this public meeting as it was inappropriate. Vice Chairman Hill moved to adjourn
the meeting at 7:47 pm while Commissioner Burgin continued to discuss the voicemail. The
motion was seconded by Commissioner rdrewsAand passed 3 to 2 to adjourn the meeting.

Commissioner House moved that the following resolution (the "Resolution "), a copy of which
was available with the Board and which was read by title:
RESOLUTION OF THE COUNTY OF HARNETT, NORTH CAROLINA DECLARING THE
INTENT OF THE COUNTY OF HARNETT, NORTH CAROLINA TO REIMBURSE ITSELF FOR
CAPITAL EXPENDITURES INCURRED IN CONNECTION WITH IMPROVEMENTS TO
CERTAIN OF SOLID WASTE FACILITIES FROM THE PROCEEDS OF TAX - EXEMPT
OBLIGATIONS TO BE EXECUTED AND DELIVERED IN FISCAL YEAR 2013.
WHEREAS, the Board of Commissioners (the "Board") of the County of Harnett, North Carolina
(the "County ") has determined that it is in the best interests of the County to make certain improvements
to the County's solid waste facilities, including the acquisition and construction of a lined cell for the
disposal of solid waste, the acquisition and construction of a leachate collection system and certain
transfer station improvements (collectively, the "Projects ");
WHEREAS, the County presently intends, at one time or from time to time, to finance all or a
portion of the costs of the Projects with proceeds of its tax - exempt obligations (the "Obligations "), and
reasonably expects to execute and deliver the Obligations to finance, or to reimburse itself for, all or a
portion of the costs of the Projects; and
WHEREAS, the County desires to proceed with the Projects and will incur and pay certain
expenditures in connection with the Projects prior to the date of the initial execution and delivery of the

Obligations (the "Original Expenditures "), such Original Expenditures to be paid for originally from a
source other than the proceeds of the Obligations, and the County intends, and reasonably expects, to be
reimbursed for such Original Expenditures from a portion of the proceeds of the Obligations to be
executed and delivered at a date occurring after the dates of such Original Expenditures;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of
Harnett, North Carolina as follows:
Section 1. Official Declaration of Intent. The County presently intends, and reasonably expects,
to reimburse itself for the Original Expenditures incurred and paid by the County on or after the date
occurring 60 days prior to the date of adoption of this Resolution from a portion of the proceeds of the
Obligations. The County reasonably expects to execute and deliver the Obligations in fiscal year 2013 to
finance all or a portion of the costs of the Projects. The maximum principal amount of the Obligations
expected to be executed and delivered by the County to pay for all or a portion of the costs of the Projects
is $1,750,000.
Section 2. Compliance with Regulations. The County adopts this Resolution as a declaration of
official intent under Section 1.150 -2 of the Treasury Regulations promulgated under Section 103 of the
Internal Revenue Code of 1986, as amended, to evidence the County's intent to reimburse itself for the
Original Expenditures from proceeds of the Obligations.
Section 3. Itemization of Capital Expenditures. The Finance Officer of the County, with advice
from special counsel, is hereby authorized, directed and designated to act on behalf of the County in
determining and itemizing all of the Original Expenditures incurred and paid by the County in connection
with the Projects during the period commencing on the date occurring 60 days prior to the date of
adoption of this Resolution and ending on the date of the initial execution and delivery of the Obligations.
Section 4. Effective Date. This Resolution is effective immediately on the date of its adoption.

, the foregoing resolution entitled "RESOLUTION OF THE COUNTY OF HARNETT, NORTH CAROLINA

NORTH CAROLINA, SITTING AS THE GOVERNING BODY OF THE SOUTH CENTRAL
WATER AND SEWER DISTRICT OF HARNETT COUNTY, PROVIDING FOR THE
ISSUANCE OF THE DISTRICT'S GENERAL OBLIGATION WATER AND SEWER BOND
ANTICIPATION NOTES, SERIES 2012B, IN AN AGGREGATE PRINCIPAL AMOUNT NOT
TO EXCEED $13,211,000
WHEREAS, the Bond Order described below has taken effect approving the issuance of
$42,000,000 General Obligation Water and Sewer Bonds (the "Bonds ") of the South Central Water and
Sewer District of Harnett County (the "District ");
WHEREAS, the Board of Commissioners (the "Board") of the County of Harnett, North Carolina
(the "County "), sitting as the governing body of the District, has determined that it is in the District's best
interest to issue its General Obligation Water and Sewer Bond Anticipation Notes, Series 2012B in an
aggregate principal amount not to exceed $13,211,000 (the "Notes ") to discharge the District's
obligations with respect to its $13,211,000 General Obligation Water and Sewer Bond Anticipation
Notes, Series 2012 issued on January 30, 2012 and maturing on October 24, 2012 (the "Prior Notes ");
WHEREAS, the Prior Notes were authorized under the Bond Order to finance renovation,
expansion and improvement to the wastewater collection system of the District for which the Bonds were
approved as permitted by Section 159 -161 of the General Statutes of North Carolina, as amended;
NOW, THEREFORE, BE IT RESOLVED by the Board, sitting as the governing body of the
District, as follows:
1. For purposes of this Resolution, the following words will have the meanings ascribed to
them below:
"Bid for Notes" means the Bid for Notes submitted to the LGC by the winning bidder selected to
purchase the Notes
"Bond Order" means the Bond Order authorizing the Bonds adopted by the Board, sitting as the
governing body of the District, on December 2, 2002 and effective on approval by a majority of the voters
who voted thereon at a special referendum duly called and held on February 4, 2003, as modified by an
order adopted by the Board, sitting as the governing body of the District, on December 7, 2009 to extend
the time period for issuing bonds under the Bond Order to February 4, 2013.
"LGC' means the Local Government Commission of North Carolina, and any successor to its
functions.
"Prior Notes" means the District's $13,211,000 General Obligation Water and Sewer Bond
Anticipation Notes, Series 2012 issued on January 30, 2012 and maturing on October 24, 2012.
"Notes" means the District's General Obligation Water and Sewer Bond Anticipation Notes,
Series 2012B, to be issued in an aggregate principal amount not to exceed $13,211,000 on
October 23, 2012.

2. The District shall issue not to exceed $13,211,000 in total aggregate principal amount of
its Notes.
3. The Notes are being issued to discharge the District's obligations with respect to the Prior
Notes, the proceeds of which were used, or will be used, to pay the capital costs of certain wastewater
collection system improvements in the District (the "Project ") pursuant to and in accordance with the
Bond Order.
4. The Notes shall be dated October 23, 2012, mature on January 23, 2013 and bear interest
payable at maturity of the Notes in accordance with the Bid for Notes.
5. The Notes shall be numbered "R -1" and upward. The Notes shall bear interest from their
date at a rate or rates which shall be hereafter determined upon the sale thereof computed on the basis of a
360 -day year of twelve 30 -day months.
6. The Notes shall be registered as to principal and interest and the District is directed to
maintain the registration records with respect thereto. The Notes shall bear the original or facsimile
signatures of the Chairman or Vice Chairman of the Board of the County and the Clerk to the Board. An
original or facsimile of the seal of the County shall be imprinted on each Note.
7. The determination of the rate of interest on the Notes, the place of payment for the Notes
and the denominations of the Notes will be made in accordance with the Bid for Notes.
8. The Notes will be issued in registered form to the owner thereof or will be issued by
means of a book -entry system, in accordance with the Bid for Notes. If issued in book -entry system, one
note certificate will be issued to The Depository Trust Company, New York, New York ( "DTC"), and
immobilized in its custody. A book -entry system will be employed, evidencing ownership of the Notes in
denominations of $100,000 and multiples of $1,000 in excess of $100,000, with transfers of beneficial
ownership effected on the records of DTC and its participants pursuant to rules and procedures
established by DTC. Principal of and interest on the Notes will be payable to DTC in immediately
available funds on the maturity date. The District will not be responsible or liable for maintaining,
supervising or reviewing the records maintained by DTC, its participants or persons acting through such
participants. If not issued by means of a book -entry system, the principal of and interest on the Notes will
be payable to the owners of the Notes upon presentation and surrender of the Notes to the paying agent
for the Notes at the offices of the paying agent indicated on the Bid for Notes on the maturity date of the
Notes.
If (a) DTC determines not to continue to act as securities depository for the Notes or (b) the
District Representative determines that the continuation of the book -entry system of evidence and transfer
of ownership of the Notes would adversely affect the interests of the beneficial owners of the Notes, the
District will discontinue the book -entry system with DTC. If the District fails to identify another
qualified securities depository to replace DTC, the District will authenticate and deliver replacement notes
in the form of fully registered certificates.
9. The Notes are not subject to payment prior to maturity.

10. The Notes and the provisions for the registration of the Notes and for the approval of the
Notes by the Secretary of the LGC shall be in substantially the form set forth in Appendix A.
11. The County Manager or the Finance Officer of the County is hereby authorized to
execute on behalf of the District a no- arbitrage certificate to comply with Section 148 of the Internal
Revenue Code of 1986, as amended, and the applicable regulations promulgated thereunder.
12. Actions taken by officials of the County to select on behalf of the District paying and
transfer agents, and a bond registrar, or alternate or successor agents and registrars pursuant to Section
159E -8 of the Registered Public Obligations Act, Chapter 159E of the General Statutes of North Carolina,
are hereby authorized and approved.
13. The LGC is hereby requested to sell the Notes through a competitive sale to the bidder
whose bid results in the lowest interest cost to the District, determined by the LGC.
14. The form and content of the Bid for Notes and the Note Circular with respect to the Notes
are in all respects authorized, approved and ratified.
15. The Chairman of the Board, the Vice Chairman of the Board, the County Manager, the
Finance Officer, the District Representative, the County Attorney and the Clerk to the Board are hereby
authorized and directed to cause the Notes to be prepared and, when they shall have been duly sold by the
LGC, to execute the Notes and to turn the Notes over to the registrar and transfer agent of the County for
delivery to the purchaser or purchasers to whom they may be sold by the LGC.
16. The Chairman of the Board, the County Manager, the Finance Officer, the County
Attorney and the Clerk to the Board are authorized and directed to execute and deliver for and on behalf
of the County any and all additional certificates, documents, opinions or other papers and perform all
other acts as may be required by the documents contemplated hereinabove or as may be deemed
necessary or appropriate in order to implement and carry out the intent and purposes of this Resolution.
17. The Public Utilities Director of the County and the Assistant Public Utilities Director of
the County are each designated a "District Representative" and are authorized and directed to execute and
deliver for and on behalf of the District any and all additional certificates, documents, opinions or other
papers and perform all other acts as may be required by the documents contemplated hereinabove or as
may be deemed necessary or appropriate in order to implement and carry out the intent and purposes of
this Resolution.
18. This Resolution may be amended or supplemented, from time to time, without the
consent of the holder of the Notes if in the opinion of nationally recognized bond counsel, such
amendment or supplement would not adversely affect the interests of the holder of the Notes and would
not cause the interest on the Notes to be included in the gross income of a recipient thereof for federal
income tax purposes. This Resolution may be amended or supplemented with the consent of the holders
of a majority in aggregate principal amount of the outstanding Notes, exclusive of Notes, if any, owned
by the District, but a modification or amendment may not, without the express consent of any holder of
Notes affected, reduce the principal amount of any Notes, reduce the interest rate payable on it, extend its
maturity or the times for paying interest, change the monetary medium in which principal and interest is
payable, or reduce the percentage of consent required for amendment or modification.

Any act done pursuant to a modification or amendment consented to by the holder of the Notes is
binding on all holders of the Notes and will not be deemed an infringement of any of the provisions of
this Resolution, whatever the character of the act may be, and may be done and perfouued as fully and
freely as if expressly permitted by the terms of this Resolution, and after consent has been given, no
holder of a Note has any right or interest to object to the action, to question its propriety or to enjoin or
restrain the District from taking any action pursuant to a modification or amendment.
If the District proposes an amendment or supplemental resolution to this Resolution requiring the
consent of the holder of the Notes, the District shall cause notice of the proposed amendment to be sent to
the holder of the Notes by first -class mail, postage prepaid, to the address of such holder as it appears on
the registration books; but the failure to receive such notice by mail by any holder, or any defect in the
mailing thereof, will not affect the validity of any proceedings pursuant hereto. Such notice shall briefly
set forth the nature of the proposed amendment and shall state that copies thereof are on file in the office
of the Clerk to the Board for inspection by the holder of the Notes. If, within 60 days or such longer
period as shall be prescribed by the District following the giving of such notice, the holder has consented
to the proposed amendment, the amendment will be effective as of the date stated in the notice.
19. The proceeds of the Notes received by the District shall be applied to discharge the
Prior Notes and to pay certain costs incurred in connection with the issuance of the Notes.

A RESOLUTION AMENDING THE
HARNETT COUNTY UNIFIED DEVELOPMENT ORDINANCE
WHEREAS, the Board of Commissioners of Harnett County adopted the UDO on October 17,
2011 for the purpose of promoting the health, safety, and general welfare of the county residents;
and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. 153A -340; and
WHEREAS, the UDO contains provisions for amending said ordinance and those provisions have
been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to the articles of the
UDO as listed below and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
HARNETT COUNTY, NORTH CAROLINA Article V, Section 1.2; Article XIV, Section 2.2, of
the UDO shall be amended to read as indicated in "Attachments 1, 2 and 3 ".
"Attachment" is filed with the Unified Development Ordinance in the Clerk to the Board's Office.
Duly adopted this 17th day of September, 2012 and effective upon adoption.

SECTION 2.2 GENERAL DEFINITIONS
Manufacturing, Light
The use of an establishment in assembly, processing, packaging, or finishing activities, in the course of any
trade or business other than agriculture, that that are carried on without an unreasonable detrimental effect of
noise, vibration, smell, fumes, smoke, ash, or dust onto the surrounding community. This is intended to
function as a transitional use between the more intense general manufacturing and industrial uses and other
less intense uses. Uses related to research and development, including laboratories and other facilities for
basic or applied research and development, pilot plants, prototype production facilities, manufacturing uses
with a high degree of scientific input, and facilities for organizations or associations that promote research.
This includes the fields of biology, chemistry, electronics, engineering, geology, medicine, and physics.

A facility for investigation into the natural, physical, or social sciences, which may include engineering and
product development. Research laboratories imply physical activities usually associated with "wet" labs or

electronic equipment, and /or use of animals or humans under controlled conditions. Uses related to research
and development, including laboratories and other facilities for basic or applied research and development,
pilot plants, prototype production facilities, manufacturing uses with a high degree of scientific input, and
facilities for organizations or associations that promote research. This includes the fields of biology,
chemistry, electronics, engineering, geology, medicine, and physics.
