Tax refunds, rebates and releases (Attachment 1) 3. Resolution to add roads to state system (Attachment 2) 4. The Legal Department, on behalf of the Department of Public Health, requested approval of an agreement between County of Harnett and Harnett County Board of Education for the purpose of providing school nursing services to the students of the Harnett County School System. The agreement is not to exceed $150,000 and is funded through the School Nurse Funding Initiative enacted by the North Carolina General Assembly. 5. The Legal Department, on behalf of the Department of Social Services, requested approval of a resolution exempting the Child Support Office of the Department of Social Services from the Daily Deposit Requirement per North Carolina General Statute 159 -32. The resolution allows the Child Support Office to make deposits only when moneys on hand amount to two hundred fifty dollars ($250) or more but no later than the last business day of each month. (Attachment 3) 6. Mr. Bryan K. Avery, on behalf of a group of volunteers, requested a waiver of the dumping fees (estimated approximately $500) at the Harnett County landfill for brush removal as a result of cleaning and making repairs at the old "Dushee Shaw's Halfway House" which is the second oldest surviving structure in Harnett County. 7. The Department of Public Utilities requested approval of write -offs for delinquent accounts determined to be at write -off status for the second quarter of 2011 in the amount of $16,324.88. All of these accounts have been delinquent for more than three years. Public Utilities is currently using the Local Government Debt Setoff Program and On- Line Collections, Inc. to help collect their delinquent accounts. 8. The Finance Office, on behalf of General Service's Solid Waste Division, requested approval of write -offs in the amount of $70,662.31. These bills are past the Statue of Limitations and cannot be forcibly collected. Several attempts to collect these bills were made including the North Carolina Debt Setoff Program. 9. General Service's Transit Services requested adoption of a "No- Show" Policy for passengers using the HARTS transportation system. It is believed this policy will help to Harnett County Board of Commissioners September 6, 2011 Regular Meeting Minutes Page 4 of 7 lower the cost for transportation services by allowing users of the transportation system to become more responsible in meeting their transportation schedules. This policy was reviewed and approved for adoption by the Transportation Advisory Board on August 15, 2011. 10. Gary Pope, Director of Emergency Services, and the Board of Directors for Angier and Black River Fire Department requested approval to amend their 2011 -2012 budget. Pennission is requested to purchase a 125KW diesel generator that will be able to run the entire station and will automatically start in case of a power loss. The cost of the generator is $56,141.50 and the money will come out of capital outlay. The Board of Directors also decided to hire one additional full -time firefighter with a salary of about $20,000 more than what was budgeted in total salaries. 11. Cooperative Extension requested permission to use funding from the Division of Child Development to reinstate Parent Referral Specialist Nancy Lee, full -time, for the purpose of staffing the Child Care Resource and Referral program presently without personnel. 12. Human Resources requested approval of the 2012 Holiday Schedule for Harnett County employees. The holiday schedule is in accordance with the Harnett County Personnel Ordinance and the state government holiday schedule. 13. Approval of the 2012 Schedule of Meetings for the Harnett County Board of Commissioners. 14. Approval of a resolution to amend the Harnett County Board of Commissioners' Rules of Procedure regarding agenda publication. (Attachment 4) Chairman McNeill opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. - Dr. Bruce Blackmon of Buies Creek distributed a letter and shared his suggestions for the Harnett County Growth Endowment Fund. Dr. Blackmon said the purpose of the growth endowment is to reduce taxes. - Linda Toth of Cameron spoke in opposition to the proposed landfill. Thomas E. Terrell, Jr., attorney representing Sandhills Environmental who is proposing the landfill in Harnett County, spoke in support of the proposed landfill and distributed statements he said corrected misinformation currently being circulated regarding the proposed landfill. - Benjamin R. Kuhn, attorney representing citizens opposing the proposed landfill, spoke in opposition to the proposed landfill. Mr. Kuhn also noted his belief that the owners of the sandpit are required to perform reclamation of the property in their existing permits with the NC Department of Environment and Natural Resources. Lester Chalmers of Johnsonville addressed the commissioners asking them to study the landfill matter carefully and represent the wishes of the people who elected them. - Brynn Vollmer of Cameron spoke in opposition to the proposed landfill and requested the process of approval be slowed. Harnett County Board of Commissioners September 6, 2011 Regular Meeting Minutes Page 5 of 7 - Betty Pauley of Lillington requested the old bridge in Lillington be left as is once the new bridge is complete; noting she believes the old bridge could be an asset to Harnett County as a walk -way and trail as well as saving over $4 Million for demolition. Mr. Will Pope, counsel for First Choice Community Health Centers (First Choice), requested the Board of Commissioner's approval of a Consent and Subordination Agreement. This request is regarding the closing of First Choice's construction financing of the medical center to be located in the Brightwater Business Park. SunTrust Bank has committed to provide First Choice with a construction loan in the amount of $2,645,000 for its new medical center. One of the conditions of the loan is that the County execute a Consent and Subordination whereby the County subordinates its condition that the real property be used as a medical facility in the event of foreclosure or a deed -in -lieu. Mr. Pope stressed this was a requirement by SunTrust Bank but the subordination does not do away with any restrictions. Mr. Pope also noted the consent clarified the acreage as First Choice was required to do a deed of conveyance for turn lane acreage to NC Department of Transportation which reduced their property to less than 3.02 acres. Commissioner Burgin moved to approve the request. Commissioner House seconded the motion which passed unanimously. Jennifer Slusser, Senior Staff Attorney, requested approval of an Ordinance Requiring a Franchise for Sanitary Landfill which is in the public interest and consistent with North Carolina General Statutes to make it unlawful to operate a sanitary landfill in the County of Harnett without a franchise. Mrs. Slusser stated the ordinance would put some regulations in place that didn't previously exist but is not required. Mrs. Slusser gave an overview of the ordinance and the Board was assured the ordinance did not grant a franchise. Commissioner Andrews moved to approve the ordinance. Commissioner Burgin seconded the motion. The motion passed unanimously. Mrs. Dionne White with Harnett County Transportation petitioned the Board for a public hearing on the Proposed Rural Operating Assistance Program (ROAP) application to be submitted to the NC Department of Transportation. A public hearing is required by State and Federal regulations to allow input from Harnett County residents. These grant funds will provide operating assistance to passenger's trips and other transportation services for Harnett County. Mrs. White reported the following: - Elderly and Disabled Transportation Assistance ($84,091) provides operating assistance for the transportation of elderly and disabled citizens. - Employment Transportation Assistance Program ($38,258) is intended to provide operating assistance for persons with employment related transportation needs. - Rural General Public ($97,655) funds are intended to provide operating assistance for individuals who do not have human service transportation assistance to pay for their transportation needs and live in a non - urbanized area. Chairman McNeill called to order a public hearing on the matter and opened the meeting for comments from the public. There being no comments, Chairman McNeill closed the public hearing. Mr. Sauer presented the following report: • Veteran Affairs August 2011 Activities Report • August 2011 Landfill Billing • Internal budget amendments Mr. Sauer also reminded the Board regarding an upcoming special session scheduled for 9:00 am on Tuesday, September 13 as well as a public hearing scheduled jointly with the Harnett County Board of Commissioners and Harnett County Board of Education for 7:00 pm on Wednesday, September 14, 2011 Commissioner Andrews moved that the Board go into closed session for the purpose of personnel matters, and consulting with County legal staff in order to preserve the attorney - client privilege and to consider and give instructions to the attorneys concerning the handling or settlement of claims, including the following 1) Kent Jeffries, et.al.vs. Harnett County Board of Adjustment, 11 CVS 1187; 2) Melody Lee vs. Harnett County and Town of Erwin, 11 CVS 440; and 3) Diane Clayton Felmet, et.al.vs County of Harnett, et.al., 11 CVS 1646 and 11 CVS 1647. This motion was made pursuant to North Carolina General Statute 143- 318.1(a)(3) and (6). Vice Chairman Hill seconded the motion which passed unanimously. Vice Chairman Hill moved that the Board come out of closed session. Commissioner Burgin seconded the motion which passed unanimously. Chairman McNeill called for any new business. Commissioner Burgin asked staff to research the growth endowment fund. At 11:13 am Commissioner Burgin moved to adjourn. G.S. §159 -32 has the authority to make an exception to the daily deposit requirement; and WHEREAS, the County has determined it is not cost effective for the Child Support Office of its Department of Social Services to drive from Erwin, North Carolina to Lillington, North Carolina to make a daily deposit or create another bank account for the small amount collected by the Child Support office; NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners that the Child Support Office of its Department of Social Services need make deposits only when the moneys on hand amount to two hundred fifty dollars ($250.00) or more, but in any event a deposit shall be made not later than the last business day of each month. General Statute § 153A -41; and WHEREAS, Rule 31 of the Rules of Procedure allows the Board of Commissioners to modify its Rules pursuant to a two- thirds affirmative vote of the members of the Board; and WHEREAS, Section V Rule 9 (d) states that the "agenda shall be published in a newspaper of general circulation prior to the date of the scheduled regular meeting." That due to other technical methods of publishing the agenda and due to newspaper publication costs, the Board determined that it would be in the best interest of Harnett County to delete Rule 9 (d) from the Rules of Procedure. NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of Commissioners does hereby delete Rule 9 (d) from its Rules of Procedure with all subsequent of Rule 9 to be re- lettered accordingly.
