The Harnett County Board of Commissioners met in regular session on Monday, May 16, 2011,
in the Commissioners Meeting Room, County Administration Building, 102 East Front Street,
Lillington, North Carolina.

Chairman McNeill called the meeting to order at 7:00 p.m. and Commissioner Burgin led the
pledge of allegiance and invocation.
Chairman McNeill called for additions and deletions to the published agenda. Mr. Sauer
requested to add four additional budget amendments for consideration. Commissioner Burgin
asked for clarification regarding 372 Transportation and 377 Emergency Medical Services
budget amendments both of which were internal budget transfers to rebalance overtime
expenses.
Commissioner Burgin moved to approve the agenda as amended. Commissioner Andrews
seconded the motion which passed unanimously.
Upon motion by Commissioner House and seconded by Commissioner Burgin, the Board
unanimously approved the following items on the consent agenda:
1. Tax refunds, rebates and releases (Attachment 1)
2. The Finance Officer requested the contract with 3HC (Home, Health & Hospice) and
Harnett County Emergency Medical Services be extended for one additional year. This
agreement, which is an extension of the current contract already in place, is to provide
transport services (upon the request of 3HC) to the patients under 3HC's care.

3. Public Utilities requested approval of write -offs for the first quarter of 2011 in the
amount of $13,916.98. All of these accounts have been delinquent for more than three
years. The facilitation of these write -offs is an important step in a continuing effort to
effectively manage our collections and bad debt. Public Utilities is currently using the
Local Government Debt Setoff Program and On -Line Collections, Inc. to help collect
delinquent accounts and has recovered over $343,000 in bad debt previously written off.
4. Parks and Recreation requested permission to apply for grant funds from Mid - Carolina
Area Agency on Aging for a grant for the Anderson Creek Senior Center. Funds would
be used to purchase a new computer, three sewing machines and landscaping materials
and supplies. Grant funds requested in the amount of $1820 would be responsible for a
10% match ($182).
5. Human Resources requested approval of amendments, retroactive to January 1, 2011, to
Article III Section 19 and Article VI Section 29 of the Personnel Ordinance in reference
to Emergency Operations Center compensation.
6. County Attorney Dwight Snow requested approval of an engagement letter confirming
Tharrington Smith LLP as counsel to the Harnett County Board of Commissioners and
Harnett County Board of Education regarding redistricting following the 2010 census.
The engagement letter states the base fee for assistance by Tharrington Smith LLP is
$14,000 which includes up to three (3) alternative redistricting plans as well as
preparation of any other documents needed to accomplish the redistricting and complete
necessary work related to submitting the redistricting plan for preclearance under Section
5 of the Voting Rights Act.
7. County Attorney Dwight Snow requested approval of a resolution to sell real property
proposing to accept the offer by La'Juana McNeil of $3,500 to purchase that .6106 acre
real property tract (REID No. 23462) owned by Harnett County pursuant to NC General
Statute 160A -269 which includes a negotiated offer and upset bid procedure.

Chairman McNeill opened the floor for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes.
Ms. Peggy Smith McDougald of Bunnlevel shared concerns regarding the current guidelines
being used by staff for citizens to book the commons area meeting room at the governmental
complex. Ms. Barbara McKoy echoed these concerns. Both reported that the guidelines had
changed over the years and were not approved by the Board of Commissioners. Chairman
McNeill directed Mr. Sauer to set up a group to develop a governmental complex use policy
including a fee structure and report back to the board as soon as possible.
Ms. McDougald also alerted the Board about trees on Bunnlevel -Erwin Road in danger of falling
"because of tree rot from past back -up of water on this road ". Staff was already working with
Ms. McDougald in reporting this concern to NC Department of Transportation.
Lorraine and John Gunn of Bunnlevel spoke of their on -going issues with a dirt bike track and
other concerns of adjourning property owners. Chairman McNeill assured the Gunns that the
Harnett County Planning staff was working on this issue and a notice of violation had been
issued to their neighbors.
Chris Strahan and Jenny Harrop, both county employees, voiced concerns about insurance
options currently being considered by the commissioners.
Commissioner Burgin moved to approve the appointment listed below. Commissioner Andrews
seconded the motion and it passed unanimously.
Harnett County of Health
Dr. Russell A. Warren (nominated by Vice Chairman Hill) was appointed for a term of 3
years which will expire December 31, 2013.
Commissioner Andrews questioned if Dr. Warren qualified to serve as he is a resident of
Sampson County. The Health Director noted that currently there is not an optometrist that
resides in Harnett County. It was consensus of the Board that this was not an issue as Dr.
Warren practices in Harnett County.
Mrs. Victoria Whitt, Chief Executive Officer of Sandhills Center, presented a budget request and
program update. Mrs. Whitt reported that the Center was requesting the amount of $199,677 in
county funding for the seventh year in a row. She noted without county funding Local
Management Entities (LMEs) might not be able to maintain a presence within the county.
Mrs. Whitt recognized and thanked Commissioner House for his service on the Sandhills Center
Board and noted Harnett County is well represented by its four members including Pat Cameron,
Louise Taylor and Walt Titchener.

Mark Browder with Mark III presented four health insurance options for consideration by the
Board. Mr. Browder said his company had worked very hard to get the options that are now
available. At the request of the Board, Mark III had met with department heads reviewing over
25 health insurance solutions. Mr. Browder noted that his company would receive $2 per
employee per month as the insurance broker as well as providing dental and vision coverage.
Chairman McNeill moved to adopt Option 1 of the health insurance options presented which was
a PPO $1,500 BCBSNC with zero employee contribution toward premium for employee only.
Vice Chairman Hill seconded the motion.
Commissioner Burgin stated that he was not satisfied with the options presented. He said he did
not understand the HSA option presented by Mark III and feels that other insurance brokers
should be given an opportunity to present options to the county as he believes there are better
options available for the same or less money.
Commissioner House questioned how they could vote on employee's benefits; which is a large
part of the budget, without having reviewed a draft budget for the upcoming fiscal year.
Chairman McNeill agreed that the process needed to start earlier next year to allow bids but
believes there is not enough time this year before enrollment.
Commissioner Burgin moved to table this decision to allow for consideration of more options.
Commissioner House seconded the motion. After much discussion Commissioner Burgin
amended his original motion to allow other insurance brokers to bid on health insurance options
by May 31, 2011, and authorized them to contact carriers on behalf of Harnett County.
Commissioner House seconded the motion which passed unanimously. Chairman McNeill
withdrew his original motion but announced commissioners would make a decision on health
insurance for county employees on May 31, 2011.
Jennifer Slusser, Senior Staff Attorney, requested approval of resolutions to abolish existing fire
protection service districts and resolutions to create fire protection service districts. Mrs. Slusser
noted this project had taken approximately 2 years and thanked county staff for the teamwork
and collaboration involved.
Commission Burgin questioned; by adopting these resolutions, if everyone in the county would
now be within a fire district. Gary Pope, Emergency Services Director, reported that with these
changes all citizens would be within a fire district. Mr. Pope said they had met with all of the
fire chiefs throughout this process and believes all of the departments agree. Fire district rates
range from .07 cents to .15 cents.
Attorney Slusser clarified for the towns to be included within this process they were required to
adopt resolutions seeking to be included. She reported all three towns had adopted resolutions to
be included.

Commissioner Andrews moved to adopt the resolution of the Harnett County Board of
Commissioners abolishing existing fire protection service districts. Vice Chairman Hill
seconded the motion which passed unanimously. (Attachment 3)
Commissioner Burgin moved to adopt the resolution of the Harnett County Board of
Commissioners creating fire protection service districts. Commissioner Andrews seconded the
motion which passed unanimously. (Attachment 4)
Public Utilities requested approval of a final reducing change order in the amount of $840,251.54
for Triangle Grading and Paving, Inc. This reducing change order brings the total contract
amount to $5,366,008.16 from the award amount of $6,206,259.70. This reduction is due to
significant cost savings in the project. Mr. Ward noted the money saved on this project would go
toward funding the next phases through USDA. Vice Chairman Hill moved to approve the
change order; Commissioner Burgin seconded the motion which passed unanimously.
Mr. Sauer presented the following reports:

- Planning Services Report April 2011
Mr. Sauer reminded the group of the upcoming special session scheduled for May 24, 2011 as
well as County Assembly Day in Raleigh on May 25, 2011. Mr. Sauer announced budget
discussions would start in early June.
There was no need for closed session.
Chairman McNeill called for any new business. Commissioner Burgin stated that he had been
contacted by Harnett Central High School requesting the County to refund permit fees in the
amount of $850.00 to the Harnett Central High School Athletic Booster Club. The permit fees
were associated with the addition of bathrooms to their baseball field concession stand.
Commissioner Burgin moved to refund the $850 to Harnett Central High School. The motion
was seconded by Commissioner Andrews and passed unanimously.
At 8:03 pm Commissioner Burgin moved to adjourn the meeting. Commissioner House
seconded the motion which passed unanimously.

RESOLUTION TO SELL REAL PROPERTY

WHEREAS, Harnett County is the owner of a .6106 acre real property tract located at 31
Poinsettia Lane, Spring Lake, NC 28390 in Anderson Creek Township; this is the same property
conveyed to Harnett County in that tax foreclosure Commissioner's Deed recorded in Book
2444, Page 248, Harnett County Registry with Parcel ID No. 010534011401; and
WHEREAS, La'Juana McNeil has made an offer to the County to purchase said real
property tract for the purchase price of $3,500.00 pursuant to the negotiated offer, advertisement
and upset bid procedure set forth in N.C. Gen. Stat. §160A-269; that the Harnett County Board
of Commissioners has considered this offer and said Board desires through this resolution to
propose to accept the McNeil offer on the condition that McNeil pay a 5% deposit ($175.00) and
that the further requirements of N.C. Gen. Stat. §160A-269 are met.
NOW THEREFORE, BE IT RESOLVED that the Harnett County Board of
Commissioners pursuant to the provisions of N.C. Gen. Stat. §160A-269 do hereby propose to
accept the offer by La'Juana McNeil of $3,500.00 to purchase that .6106 acre real property tract
upon her deposit of 5% of the offered price ($175.00) and subject to any upset bids received after
publication of the McNeil offer pursuant to the aforementioned statute;
BE IT FURTHER RESOLVED that the County legal staff will insure the compliance
with N.C. Gen. Stat. § 160A -269 and will provide to the Board a proposed deed at such time that
a final bid has been received for said real estate.

RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
ABOLISHING EXISTING FIRE PROTECTION SERVICE DISTRICTS

WHEREAS, County of Harnett has a total area of approximately 601 square miles and
has seen tremendous population growth over the years.
WHEREAS, County of Harnett is currently divided into six fire protection service
districts created pursuant to North Carolina General Statute §153A-301, et. seq. and ten rural fire
protection districts created pursuant to North Carolina General Statute §69 -25, et. seq.
WHEREAS, in 2005 the Harnett County Board of Commissioners adjusted fire
insurance district boundaries to six miles, but took no action to adjust the boundaries of the fire
protection service districts or rural fire protections districts.
WHEREAS, because fire protection service districts and rural fire protection districts
abut each to the other, to extend, reduce, or consolidate the various district boundaries is
impractical and prohibitive under the existing circumstances pursuant to the North Carolina
General Statutes of the State of North Carolina.
WHEREAS, on the 12th day of October, 2010, the Harnett County Board of
Commissioners received various proposals relating to the collection of tax revenues for fire
protection purposes and decided, by general consensus, to proceed with a proposal to abolish
existing fire protection service districts within the County of Harnett, assess a zero tax levy for
the rural fire protection districts, and to create new fire protection service districts within the
County of Harnett to fund the full cost of fire protection service, delivered on an equal basis to
all residents of the particular service districts, with the cost burden carried equitably by all
service district property owners.
WHEREAS, the Harnett County Manager, Harnett County Emergency Services
Director, the Harnett County Senior Staff Attorney, and other appropriate representatives and
employees of the County of Harnett were authorized to take such steps as might be required or
necessary to pursue the statutory and administrative processes relative to the proposal to abolish
existing fire protection service districts and create new fire protection service districts.
WHEREAS, North Carolina General Statute § 153A -306 provides that the Board of
Commissioners, may, by resolution, abolish a particular service district upon finding that there is
no longer a need for a particular service district and that there are no outstanding bonds or notes
issued to finance projects in the district.

WHEREAS, the existing fire protection service districts to be abolished are as follows:
a. Averasboro Fire District, as shown on the map attached hereto and
incorporated herein as Exhibit A; and
b. Barbecue Fire District (sometimes referred to as `Benhaven "), as shown on
the map attached hereto and incorporated herein as Exhibit B; and
c. Boone Trail Fire District as shown on the map attached hereto and
incorporated herein as Exhibit C; and
d. Crain's Creek Special Service District as shown on the map attached hereto
and incorporated herein as Exhibit D; and
e. Cypress Creek Fire Protection Service District as shown on the map attached
hereto and incorporated herein as Exhibit E; and
f. North Harnett Fire Protection Special Service District as shown on the map
attached hereto and incorporated herein as Exhibit F.
WHEREAS, the existing fire protection service districts, as shown on the maps attached
hereto as Exhibits A -F, are no longer needed as the Harnett County Board of Commissioners will
create new fire protection service districts to fund the full cost of fire protection service,
delivered on an equal basis to all residents of the service district, with the cost burden carried
equitably by all service district property owners through the service district tax levy.
WHEREAS, County of Harnett has no outstanding bonds or notes issued to finance fire
protection projects in the existing fire protection service districts, as shown on the maps attached

public hearing on April 18, 2011 providing an opportunity for citizens to appear and be heard
concerning the subject proposal.
WHEREAS, it has been represented to the Harnett County Board of Commissioners that
such a proposal enjoys support within the respective communities involved and within the
subject districts.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD
OF COMMISSIONERS that the following fire protection service districts are hereby abolished
effective June 30, 2011 at 11:59 p.m.:

NORTH CAROLINA
RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
CREATING FIRE PROTECTION SERVICE DISTRICTS

WHEREAS, County of Harnett has a total area of approximately 601 square miles and
has seen tremendous population growth over the years.
WHEREAS, County of Harnett is currently divided into six fire protection service
districts created pursuant to North Carolina General Statute §153A -301, et. seq. and ten rural fire
protection districts created pursuant to North Carolina General Statute §69 -25, et. seq.
WHEREAS, in 2005 the Harnett County Board of Commissioners adjusted fire
insurance district boundaries to six miles, but took no action to adjust the boundaries of the fire
protection service districts or rural fire protections districts.
WHEREAS, because fire protection service districts and rural fire protection districts
abut each to the other, to extend, reduce, or consolidate the various district boundaries is
impractical and prohibitive under the existing circumstances pursuant to the North Carolina
General Statutes of the State of North Carolina.
WHEREAS, on the 12th day of October, 2010, the Harnett County Board of
Commissioners received various proposals relating to the collection of tax revenues for fire
protection purposes and decided, by general consensus, to proceed with a proposal to abolish
existing fire protection service districts within the County of Harnett, assess a zero tax levy for
the rural fire protection districts, and to create new fire protection service districts within the
County of Harnett to fund the full cost of fire protection service, delivered on an equal basis to
all residents of the particular service districts, with the cost burden carried equitably by all
service district property owners.
WHEREAS, the Harnett County Manager, Harnett County Emergency Services
Director, the Harnett County Senior Staff Attorney, and other appropriate representatives and
employees of the County of Harnett were authorized to take such steps as might be required or
necessary to pursue the statutory and administrative processes relative to the proposal to abolish
existing fire protection service districts and create new fire protection service districts.
WHEREAS, North Carolina General Statute § 153A -302 provides the standards and
process to be utilized in defining a new service district.

WHEREAS, pursuant to the direction of the Harnett County Board of Commissioners
and North Carolina General Statutes, a thorough inquiry was conducted in connection with the
proposed establishment of the fire protection service districts. Such inquiry included input from
numerous citizens in the areas which would be included in such service districts, fire
departments which would service such districts, consultations with faculty at the UNC School of
Government, independent inquiry by members of the Board of Commissioners, and the
comments of citizens received by the Board of Commissioners and county staff.
WHEREAS, the Harnett County Board of Commissioners caused to be prepared a report
containing maps of the proposed districts, showing the proposed boundaries, statements showing
the proposed districts meet the standards as required by law, and plans for providing fire
protection services to the proposed districts.
WHEREAS, the Harnett County Board of Commissioners conducted a duly noticed

attached hereto and incorporated herein as Exhibit B;
c. Banner Fire Protection Service District, as shown on the map attached hereto
and incorporated herein as Exhibit C;
d. Benhaven Fire Protection Service District, as shown on the map attached
hereto and incorporated herein as Exhibit D;
e. Boone Trail Fire Protection Service District, as shown on the map attached
hereto and incorporated herein as Exhibit E;
f. Buies Creek Fire Protection Service District, as shown on the map attached
hereto and incorporated herein as Exhibit F;
g. Bunnlevel Fire Protection Service District, as shown on the map attached

WHEREAS, the Harnett County Board of Commissioners has carefully considered the
report dated March 14, 2011 containing maps of the proposed districts, showing the proposed
boundaries, statements showing the proposed districts meet the standards as required by law, and
plans for providing fire protection services to the proposed districts, along with the input and
comments of citizens and fire departments which would service such districts.
WHEREAS, the Harnett County Board of Commissioners finds that there is a
demonstrable need for providing the fire protection services within the area of the proposed fire
protection districts.
WHEREAS, the Harnett County Board of Commissioners finds that it is impossible or
impracticable to provide fire protection services on a county -wide basis.
WEHREAS, the Harnett County Board of Commissioners finds that it is economically
feasible to provide the proposed fire protection service for the proposed fire protection service
districts without unreasonable or burdensome annual tax levies.
WHEREAS, the Harnett County Board of Commissioners finds that there is
demonstrable demand for fire protection services by persons residing the in proposed fire
protection districts.
