Tax refunds, rebates and releases (Attachment 1) 4. Resolution to add roads in Highgrove Drive SR 2508 ext., Heathrow Drive SR 2510 Ext. and Wimbledon Lane in the Highgrove Subdivision to state system (Attachment 2) 5. Resolution to add roads in Caldwell Street and Rockingham Street in the Overhills Creek Subdivision to state system (Attachment 3) 6. Emergency Services requested authorization to apply and receive funds for FM Global Fire Prevention Grant in the amount of $4,129.29. The grant would be used to replace an outdated camera system for documenting arson investigation scenes. The equipment has limited night time capabilities and the system is being phased out by the manufacturer so repairs /replacement parts are difficult to find. This grant will enable us to purchase a Nikon D 7000 with additional lens to help capture image of an entire confined space area. 7. Information Technology, E -911 Division, requested permission to use the sole source purchasing option to purchase a GeoLynx Upgrade from VisionAir. VisionAir provides software maintenance and support to our Computer Aided Dispatch System (CAD). GeoLynx is the mapping portion of CAD. The GeoLynx software is a major part of the CAD software, it provides the dispatchers maps of all streets in our County, displays the location of each call and is used to give directions to each emergency call. The cost of the upgrade is $1 0,787.50 and will be paid out of the Emergency Telephone System Budget - Fund 240. 8. Information Technology requested permission to use the sole source purchasing option to purchase an additional ArchEditor Concurrent Use License from Environmental Systems Research Institute, Inc. (ESRI). ESRI provides the software maintenance for the County GIS System. The new ArcEditor license will be used by E -911 staff to maintain the Address Points Layer in the County GIS System. The cost of the license is $5,713 and will be paid out of the Emergency Telephone System Budget — Fund 240. Harnett County Board of Commissioners February 21, 2011 Regular Meeting Minutes Page 4 of 10 9. Public Utilities requests approval of write -offs for the fourth quarter of 2010. All of these accounts have been delinquent for more than three years and total $ 12,713.71. The facilitation of these write -offs is an important step in a continuing effort to effectively manage our collections and bad debt. Public Utilities is currently using the Local Government Debt Setoffs Program and On -Line Collections, Inc. to help collect our delinquent accounts. We are happy to report that we have recovered over $306,000 in bad debt previously writing off through the Debt Setoff Program. 10. Resolution to cancel March 7, 2011 Regular Meeting of the Harnett County Board of Commissioners (Attachment 4) 11. Human Resources, on behalf of Cooperative Extension, requested approval to add a Limited Service Family Resource Program Manager position, classified as Grade 64, effective April 1, 2011. The Partnership for Children is requiring that the department recruit for this position which will serve as the coordinator for the Quality Enhancement Program. Funds for this position will be allocated from a grant provided by the Partnership for Children. The department currently has $11,000 grant funded and budgeted for part-time salaries that will include FICA and Worker's Compensation to fund this position through the remainder of this fiscal year. Since this is a Limited Service position, no benefits will be provided. 12. Planning Services requested permission to apply for grant with NC DOT, Division of Aviation, in the amount of $33,410 with a local match of $3,341. This grant will cover costs associated with NC DENR Division of Water Quality requirement for a Stormwater Pollution Prevention Plan (SWPPP) and a Spill, Prevention, Control and Countermeasure (SPCC) Plan at Harnett Regional Jetport. 13. Parks and Recreation requested permission to submit a Recreational Trails Program (RTP) grant application for the Anderson Creek Park. The grant application will request $75,000 with a 25% match of the awarded amount required of which Parks and Recreation Trust Fund monies will be used. This RTP grant will allow for Parks and Recreation to fix drainage issues with consisting trails and provide linkages to the existing trails to prevent dead ends. Chairman McNeill opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. Keith Chatellier of Nursery Road told the Board he had yet to receive the information from his November 2010 public records request. He asked if Marziano & McGougan were the only engineers working for Harnett County Public Utilities. Mr. Chatellier said he did receive a letter from letter from Mr. Sauer informing him the proposed route of a water line had been changed and would no longer go across his property however Mr. Chatellier asked the cost of running the water line the new route. Harnett County Board of Commissioners February 21, 2011 Regular Meeting Minutes Page 5of10 Pastor George Brice of Cameron said he has issues with tax dollars being used to fund elective abortions for employees within the county health plan. Libby Brice, Peter DeMitri of Cameron, Tim Taylor and Sicilia Defalio all echoed these comments and said they did not want their tax dollars paying for elective abortions. Chairman McNeill clarified that there would be no cost savings assumed by the county for removing this elective option and cautioned this could affect women in need of DNCs following miscarriages. He said he is not in favor of legislating morality. Commissioner Burgin believes that there would be a savings to the county from removing the elective option of abortion from the county health plan and said he understands any decision a doctor orders for the welfare of a patient, such as a DNC, would still be covered by the plan. Charles "Chick" Adams made disrespectful comments from the audience and was escorted out by a Harnett County Sheriff's Deputy. Vice Chairman Hill moved to approve the appointments listed below. Commissioner Andrews seconded the motion which passed unanimously. Averasboro Township Tourism Development Authority Billy Tart and Ricky Johnson (nominated by Commissioner House) were reappointed for a term of one year ending December 31, 2011 Barry Blevins, Central Permitting & Community Development Administrator, along with Pat Crissman with the Wooten Company, petitioned the Board to conduct a public hearing regarding the Scattered Site Housing program. The public hearing is required in order to complete close out of the NC Department of Commerce's Division of Community Assistant 2008 Scattered Site Housing grant. The $400,000 Community Development Block Grant helped 6 Harnett County families with housing rehabilitation efforts. They also asked that the commissioners authorize the Chairman to sign the close out documents for this grant. A citizen from the audience said she thanks God every day for what this grant did for her parents and her brother. Commissioner Burgin stressed the continued need to solicit local workers and buy local materials from Harnett County for these and all projects. Chairman McNeill called to order a public hearing on the matter and opened the meeting for comments from the public. There being no comments, Chaiiuian McNeill closed the public hearing. Commissioner Burgin moved to authorize the chairman to sign the SSH 08 CDBG close out documents for this grant. Vice Chairman Hill seconded the motion which passed unanimously. Harnett County Board of Commissioners February 21, 2011 Regular Meeting Minutes Page 6of10 Samantha Ficzko, Planner II, petitioned the Board to approve the proposed rezoning application, Owner of Record: John Frangakis et al, Applicant: Stephen A. Caroll; 3.13 +/- acres (2 parcels), From RA -20R to Commercial Zoning District, 2183 & 2203 Hwy 24/87, Anderson Creek Township. Ms. Ficzko noted a public hearing was held by the Planning Board on Monday, February 7, 2011. No one present spoke in opposition to the request. She reported the two parcels requested to be rezoned are adjacent to commercial zoning, are compatible with Harnett County regulatory documents, would not have an unreasonable impact on the surrounding community and will enhance the public health, safety, and general welfare of the community. The Planning Department staff recommends approval of the request. The Planning Board voted unanimously to recommend that the County Commissioners approve the requested zoning change. Chairman McNeill called to order a public hearing on the matter and opened the meeting for comments from the public. Steven McConnell, who represents Mr. Frangakis, spoke in favor of the rezoning. It was noted that on January 24, 2011, the Harnett County Board of Commissioners approved a zoning change request for a parcel adjacent to these two sites to commercial zoning. There being no further comments, Chairman McNeill closed the public hearing. Commissioner Burgin moved to approve the rezoning application as presented. Commissioner House seconded the motion which passed unanimously. Samantha Ficzko, Planner II, petitioned the Board to regarding the proposed rezoning application, Owner: Henry P. Carroll, Jr., 4.0 +/- acres, From RA -20R to Commercial Zoning District, 17295 Hwy 27 W Lot 2; Barbecue Township. Ms. Ficzko reported that staff evaluated the requested rezoning and found that it was not compatible with Harnett County regulatory documents and would not only have an impact on surrounding community, but would also fail to enhance the public health, safety and general welfare of the community. A public hearing was held by the Planning Board on Monday, February 7, 2011. Several residents of Stoney Creek Subdivision spoke in opposition to the request. A petition was presented with 98 signatures of citizens opposed to the rezoning request. Staff reported the site was analyzed for Small Scale Rezoning and was found to be unreasonable. The Planning Board voted unanimously to recommend denial of the request based on unfavorable findings for Small Scale Rezoning. Chaiunan McNeill called to order a public hearing on the matter and opened the meeting for comments from the public. Harnett County Board of Commissioners February 21, 2011 Regular Meeting Minutes Page 7of10 Helene Cabrera spoke in opposition of the rezoning and presented the Board with a petition signed by 102 citizens opposing the proposed rezoning. Eugene Gonzales, Peter Mayhem, Ronney Moss, Andrea Urtiaga, Pamela Hymer, Runnie Myles, April Wagner and Jimmy Cook also spoke in opposition of the rezoning. Citizens cited fear of crimes they believe are associated with laundry mats, having only one entrance into their community being trapped in their homes if an accident occurred at the propane refill site as well as the increased traffic destroying their way of life and believing the placement of these businesses would decrease the value of their property. Mr. Al Bain, attorney representing Mr. Henry P. Carroll, spoke in favor of the rezoning and presented the Board with a petition signed by 438 citizens agreeing they believe having services of a laundry mat, propane refill station, aluminum can recycling and white goods recycling would be in the best interest of this community. Mr. Bain also distributed a letter from Lillington Police Chief Frank powers stating that there were no records on file from 1997 to 2011 for any incident taking place at any laundry mats located in the city limits of Lillington other than normal property crimes. He stated his client intended on employing 5 people and these businesses would increase the tax base. Mr. Henry P. Carroll, himself, and Ms. Angela Strickland spoke in support of this application saying they believed lots of people in the area need these services. Chairman McNeill moved to deny the proposed rezoning request based on staff's evaluation that the requested rezoning was not compatible with Harnett County regulatory documents and would not only have an impact of surrounding community, but would also fail to enhance the public health, safety and general welfare of the community. Vice Chairman Hill seconded the motion which passed 4 to 1. Samantha Ficzko, Planner II, petitioned the Board to approve the proposed zoning ordinance text amendments, Applicant: Harnett County Planning Department, Zoning Ordinance, New Additions and Revisions, Article VI Section 10.0, 10.9 - 10.9.4 Highway Corridor Overlay Zoning District Standards for the Highway Corridor Overlay Zoning District Ms. Fizcko stated that in an effort to address concerns of sprawl and undesirable growth patterns, the Planning Department has developed a set of standards for the Highway Corridor Overlay. Development of these standards has been a goal of the Planning Department for some time; however work on the Unified Development Ordinance (UDO) was the catalyst for completion of the text amendment submitted. Additionally, the planning staff believes review and approval of this amendment separate from the UDO will make future transitions to the UDO an easier process, as this major change will have already been addressed. Due to recent conversations with a citizen, Commissioner Burgin questioned some requirements and noted that staff needs to be able to work with people on some of these requirements and asked that citizens options always be explained to them. He shared concerns that we may be needlessly increasing expenses and over- stepping boundaries. There being no comments, Chairman McNeill closed the public hearing. Commissioner Andrews moved to approve the proposed zoning ordinance text amendment as presented. Commissioner House seconded the motion which passed unanimously. (Attachment 5) Mr. Sauer presented the following report - Department of Public Health Activities Summary LeeAnne Blackmon and Midred Riley asked the commissioner for permission to sale raffle tickets to employees for one paid day of vacation to employees, working with Human Resources, as a fund raiser for Relay for Life. Commissioner Andrews moved to approve the request. Vice Chairman Hill seconded the motion which passed unanimously. Mr. Jimmy McCormick, Soil and Water Conservation Board member, requested approval of the Soil and Water Conservation Board's recommendation to make Neal Taylor the department head for the Harnett County Soil and Water District as well as change his designation to Resource Conservationist at the entry level of pay grade 71. Commissioner Andrews moved to approve the recommendation which was seconded by Vice Chairman Hill and approved unanimously. Commissioner Burgin asked Mr. Wilder to find out if the tax department is alerted when somebody sales a vehicle. Commissioner Burgin believes citizens should receive a refund of vehicle taxes for the remainder of the tax year when they sale a vehicle. Commissioner Burgin moved to remove elective abortions from the county's health plan. Commissioner House seconded the motion which passed unanimously Commissioner Burgin requested the status of his earlier request that Public Utilities park some of the 41 county vehicles being driven home daily by county employees. Commissioner Burgin moved to instruct Public Utilities to present a plan to park 20 of those vehicles from being driven home every night. Commissioner House seconded the motion. Chairman McNeill amended the motion that all county departments come before the Board to justify the taking home of any county vehicles. Commissioner Andrews seconded the amendment. The amended motion passed unanimously. It was consensus of the group that law enforcement would be exempt from this justification. Commissioner Burgin made a motion that Harnett County offer to pay Harnett County contractors up to 10% higher on a bid project. Mr. Sauer noted we are required by law to accept the lowest qualified bidders. Chairman McNeill asked that this be researched first. Commissioner Burgin made a motion that the county set the 2011 -2012 budget at 95% of last year's revenues which was $97,623,737 which would be $92,742,550 looking at roughly a 6.9% reduction. Commissioner House seconded the motion. Mr. Sauer said he had already met with Harnett County Board of Commissioners February 21, 2011 Regular Meeting Minutes Page 9 of 10 department heads and could provide some budget scenarios at the next work session. Chairman McNeill said where he agrees we need to cut spending there are too many variables right now to adopt such a motion. Mr. Sauer said considering we cannot cut debt services the 5% reduction requested by departments had turned in to a proposed 13.2% reduction. Commissioner Burgin rescinded his motion. Chairman McNeill moved for the board to adopt a resolution to the "powers that be" communicating that they should not balance the state's budget on the back of the counties. The motion was seconded by Commissioner Burgin and passed unanimously. There was no need for a closed session. Chairman McNeill called for any new business. Mr. Wilder clarified he recommendation to deny the request from Mr. Charles Mitchell Oxendine that a 2002 tax bill be released on a vehicle he sold presented a the February 7th meeting. At 9:00 pm Commissioner Burgin moved to adjourn. McNeill, Chairman www.harnett.org Attachment 5 HARNETT COUNTY NORTH CAROLINA A RESOLUTION AMENDING THE HARNETT COUNTY ZONING ORDINANCE WHEREAS, the Board of Commissioners of Harnett County adopted the Harnett County Zoning Regulations on July 18, 1988; June 5, 2000, and June 15, 2009 for the purpose of promoting the health, safety, and general welfare of the county residents; and WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North Carolina, particularly G.S. 153A -340; and WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those provisions have been followed; and WHEREAS, the Harnett County Planning Board has reviewed the amendment to the articles of the Zoning Ordinance as listed below and recommends the adoption of the following amendment. NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT COUNTY, NORTH CAROLINA that Article VI "Zoning Districts and Regulations", Section 10 "Highway Corridor Overlay" of the Zoning Ordinance shall be amended to read as indicated below: 10.9 Architectural Standards 10.9.1 Applicability A. The following regulations shall apply to all new nonresidential structures and development site plan submittals located within the Highway Corridor Overlay Zoning District. B. Expansions 1. Expansions shall comply with these regulations at such time that the expansion totals 50 percent (50 %) or more of the existing building size. The total percentage of building expansions shall be combined over a five (5) year period. At such time that the percentage of building expansions reaches 50 percent (50 %) or more of the original building size, these regulations shall be met. 2. In cases where an expansion is equal to or greater than the total square footage of the existing building, both the expansion and the existing building shall also be brought into compliance with these regulations. The total shall be combined over a five (5) year period. C. Conversions of structures formerly used for residential purposes and changes of uses shall comply with the regulations included herein. 10.9.2 Building Materials & Colors A. Front facades and exterior walls visible from the public right(s) -of -way shall be composed of at least 50 percent (50 %) approved primary materials, listed below. 1 Secondary materials may be used on building walls not visible from a public right(s)- of -way. 1. Primary Building Materials The following materials shall be permitted as primary building materials. a. Brick b. Stone c. Fiber Cement Siding d. Architectural Concrete Said material shall be permitted if the surface is constructed to simulate brick or stone and only as approved by the Administrator. 2. Secondary Building Materials The following materials shall be prohibited as primary building materials but shall be allowed as secondary material along with the approved primary building materials or as primary elements on walls not required to meet these requirements. Secondary materials are not required. When used, no more than 30 percent (30 %) of front facades and exterior walls visible from the public right(s) -of -way shall be composed of the materials listed herein. a. Stucco b. Exterior Insulation Finishing System (EIFS) c. Painted or Stained Concrete d. Metal e. Split -Face Block 3. Supplementary Building Materials The following materials shall be allowed as supplementary materials along with primary and secondary materials. Supplementary building materials are not required. When used, no more than 10 percent (10 %) of exterior walls shall be composed of the materials listed herein. a. Vinyl Siding b. Cast Concrete c. Smooth -Faced Concrete B. For purposes of this Ordinance, the term "visible from the public right(s) -of -way" shall mean visible from any existing public right(s) -of -way or any right(s) -of -way intended for future dedication for public use. Additionally, for purposes of this Section, only those public right(s) -of -way located within the Highway Corridor Overlay Zoning District shall be considered for compliance with these regulations. C. Two (2) or more materials shall be combined on one (1) facade; with the heavier material(s) being installed nearer to the ground or below other materials. D. The number of colors used shall be limited to no more than three (3) discernable colors 2 or ranges of complementary hues. The dominate color shall constitute a minimum of 60 percent (60 %) of the facade, excluding windows, doors, and the like. Facade colors shall be of low reflectance earth tone, muted, subtle, and/or neutral colors. Building trim may feature brighter colors, but neon tubing is not allowed as an accent material. The use of high intensity, metallic, fluorescent, or neon colors shall be prohibited. Variations in color schemes are encouraged in order to articulate entryways, architectural features, and public amenities so as to give greater recognition to these features. 10.9.3 Building Design, Facades, & Massing A. Facades shall include changes in wall plane, incorporating at least one (1) change in wall plane, such as recesses and projections, along at least 20 percent (20 %) of the length of the facade at a depth of at least three percent (3 %) of the entire length of the building. 1. Buildings of 10,000 square feet or less shall include a change in wall plane for every 50 feet of length. 2. Buildings greater than 10,000 square feet shall include a change in wall plane for every 100 feet of length. B. Rooflines shall vary in height, material, treatment, direction, etc. and shall not extend in a continuous plane for more than 50 feet to reduce the scale of structures and to increase visual interest. Roof shape, such as flat, hip, mansard, or gable, and material shall be architecturally compatible with the facade elements of the rest of the building. C. Buildings with flat roofs or with roof pitches of 3:12 or less shall maintain a parapet wall along all walls visible from the public right(s) -of -way. Parapet walls shall have decorative cornices or caps. D. If roof cornices or caps have been removed or damaged on an existing building, renovations of such building shall include retaining, repairing, and replacing the roof cornices or caps, unless justification can be made to the Administrator as to why that is not feasible. 10.9.4 Architectural Standard Design Alternatives A. Alternative design plans, building materials, landscaping, and/or construction techniques may be used when unreasonable or impractical situations would result from the strict application of architectural standards of this Section. Such situations may result from unique site conditions, innovative design applications, and/or unified development design. The review and approval of Architectural Standard Design Alternatives shall be reviewed and decided by the Planning Board. The following criteria shall be used in determining whether an architectural standard design alternative can be accepted by the Planning Board in lieu of meeting the requirements of this Section. 1. The proposal includes a clear and concise explanation of the specific standards that cannot be met and how the alternative methods proposed will achieve the intent of this Section. 2. The proposal represents the use of alternative methods and/or materials (including but not limited to: building materials, massing, materials, and scale; orientation in relation to the public right(s) -of -way; facade treatment; landscaping; lighting; and open space) which will result in a development pattern which is equivalent to or 3 greater than that required by this Ordnance; 3. The proposed use and design alternative is compatible with adjacent land uses. 4. The proposal is compatible with and will enhance the use or value of adjacent and area properties; 5. The proposal is consistent with the intent of adopted County plans; and, 6. The proposed development standards are, in all other aspects, consistent with the intent and purpose of this Ordinance. All findings specified above for the granting of such a request with the Architectural Standard Design Alternatives shall be provided in writing and signed by the Administrator. One (1) copy shall be provided to the applicant and another shall be retained as a part of the permanent record of the determination of the Planning Board.
