092010mHARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Regular Meeting September 20, 2010 The Harnett County Board of Commissioners met in regular session on Monday, September 20, 2010, in the Commissioners Meeting Room, County Administrative Building, 102 East Front Street, Lillington, North Carolina. Members present: Staff present: Timothy B. McNeill, Chairman Beatrice B. Hill, Vice - Chairman Dan B. Andrews, Commissioner Gary House, Commissioner Jim Burgin, Commissioner Scott Sauer, County Manager Tony Wilder, Deputy County Manager Dwight W. Snow, County Attorney Sylvia Blinson, Finance Officer Margaret Regina Wheeler, Clerk Chairman McNeill called the meeting to order at 7:00 pm. Vice Chairman Hill led the pledge of allegiance and invocation. Commissioner Burgin asked Chairman McNeill if he had made certain comments about him and Commissioner House. Chairman McNeill said he did and saw no need to apologize. Commissioner Burgin asked Vice Chairman Hill to take over the meeting and chairmanship and made a point of order and moved to censor the chairman and that he be deposed for misconduct. Commissioner Burgin cited Robert's Rules of Order regarding this rule. Mr. Snow explained the Rules of Procedures for the Harnett County Board of Commissioners does not include a deposition motion. Commissioner Burgin said the Chairman had committed slander in his name - calling. The Chairman said he stated personal opinion and was not slanderous. Vice Chairman Hill refused to take the chairman seat. Chairman McNeill called for additions and deletions to the published agenda. Commissioner House requested adding the discussion of the South Central Wastewater Project which would include a presentation by T. Glanders. Chairman McNeill said Mr. Glanders could speak for 3 minutes during the public comment period but he would prefer he come to a work session to discuss details with the appropriate staff. Chairman McNeill noted Mr. Glanders had refused to meet with the County Manager and staff to date. Commissioner Burgin moved to extend Mr. Glanders' time during the public comment period to 10 minutes. Commissioner House seconded the motion which failed 3 to 2. Chairman McNeill said he has heard some of the concerns regarding this project and they do need to be addressed. Byrne Memorial Justice Assistance Grant funds. Chairman McNeill also requested the addition of the N.C. Parks & Recreation request that the tipping fee be waived for the trash collected by volunteers during Big Sweep. Commissioner Andrews moved to accept the additions and approve the agenda as amended. Commissioner Hill seconded the motion which passed unanimously. Commissioner Andrews moved to approve the following items on the revised consent agenda. Emergency Services, on behalf of Flat Branch Volunteer Fire Department, requested permission to purchase a used fire engine from Westarea Fire Department for the price of $60,000. Flat Branch Volunteer Fire Department budgeted for a new fire engine in the 2010/2011 budget but feel it is best to purchase a used truck at this time. 5. Public Utilities requested approval of write -offs for the second quarter of 2010. All of these accounts have been delinquent for more than three years and total $18,184.46. The facilitation of these write -offs is an important step in a continuing effort to effectively manage our collections and bad debt. HCDPU is currently using the Local Government Debt Setoff Program and On -Line Collections, Inc. to help collect delinquent accounts. 6. Planning Services requested approval of a Community Development Language Access Plan. In order to be in compliance with Title VI of the Civil Rights Act of 1964 and with Executive Order 13166, Harnett County needs to adopt Language Access Plan 4 -1. Title VI of the Civil Rights Act of 1064 prohibits discrimination based on the ground of race, September 20, 2010 Regular Meeting Minutes Harnett County Board of Commissioners Page 5 or 10 color or national origin by any entity receiving federal financial assistance. The purpose of the plan is to assess and meet the needs of those with limited English proficiency due to national origin. The CDBG Language Access Plan 4 -1: Harnett County covers CDBG, CDBG -R, and NSP funded grants and is good for two years, at which point the plan will need to be reassessed. 7. Legal Department requested approval of the Memorandum of Understanding Pursuant to the Workforce Investment Act of 1998, whereby the County would agree that it would abide by the terms and conditions of the Workforce Investment Act, and the policies and regulations of the North Carolina Commission on Workforce Development and the Triangle South Workforce Development Board, which are established for the development, management and operation of the North Carolina's JobLink Career Center System. 8. N.C. Parks & Recreation requested the tipping fee for the trash collected by volunteers during Big Sweep be waived at the Dunn -Erwin Landfill the week of October 2 — 8, 2010, when taken by Raven Rock State Park staff. Chairman McNeill opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation. - Michael Gibson, 310 Luke Chapel Road, said Harnett County citizens living near the Cumberland County border feel forgotten and shared his frustration regarding confusion on where to vote as the locations change. - T. Glanders, Stone Cross Subdivision, distributed packages to the commissioners and talked about the proposed South Central Wastewater Project along Ray Road. Mr. Glanders said the project was not wanted or needed but offered and discussed a proposed alternative route for the project along with cost saving measures. Mr. Glander said he would be present at the September work session but request this project be suspended until it could be reassessed by the county engineer. Commissioner Burgin moved to approve the appointments listed below. Commissioner Andrews seconded the motion which passed unanimously. Harnett County Juvenile Prevention Council Angela Wood was appointed as 2010 -2011 Council Chairman and Lynn Lambert as Vice - Chairman. Sandhills Center Board of Directors Mr. David M. Dermott (nominated by Commissioner House) was appointed to serve on this Board for a term of three years ending October 31, 2013. Vice Chairman Hill nominated Walter Titchener to be reappointed to serve on the Sandhills Center Board of Directors. Mr. Snow noted he had reviewed by -laws of Sandhills Center Board of Directors which states that each Board of County September 20, 2010 Regular Meeting Minutes Harnett County Board of Commissioners Page 6 or 10 Commissioners within the Sandhills Center Area shall appoint one commissioner to serve as a member of the Board. These county commissioner members shall appoint the other members which gave Commissioner House authority to appoint Mr. Dermott however, Mr. Snow pointed out the boards of county commissioners shall have the option to appoint the members of the area board in a manner other than as required under N.C.G.S. §122C-118.1 by adopting a resolution to that effect. Harnett County currently has four members on this board. Mark Locklear, Planning Manager, petitioned the Board for a public hearing regarding: Proposed Zoning Change , Landowner: Anna Harden, Applicant: J -R Developers, LLC, NC Hwy 87, 13.26 +1- acres, From RA -30 to Commercial Zoning District, Anderson Creek Township. A Planning Board was held by the Planning Board on Tuesday, September 7, 2010. The Planning Board unanimously recommended approval of the request based upon favorable findings of facts. Mr. Locklear reported the site is located along Hwy 87, in our Highway Corridor Overlay District and is currently undeveloped. Surrounding land uses are a mix between residential and non - residential uses. This includes different types of non - residnetial uses such as retail and service uses. There are several large and small residential developments in the area such as: Linden Oaks, Lexington Plantation, Richmond Park& Brandywood Subdivision, which is directly adjacent to the site. The property is also adjacent to land owned bythe U.S. Military. Additional informatin provided is the two parcels adjacent to the subject property were approved unanimously for a rezoning from RA -30 to Commercial in 2010. Also, as required for all zoning changes within a five mile radius of Fort Bragg, RLUAC (Regional Land Use Advisory Commmission) was contacted and had no objections to the proposed rezoning to commercial. Mr. Locklear reported staff evaluation as: The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: Development along Hwy 87 is becoming predominately a mix of residential and non - residential uses. The requested zoning district is similar in nature to much of the existing development in the area and will not have a negative impact on the adjacent property owners or the surround community. - The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The existing land use classification, Compact Mixed Use is meant to encourage a combination of differing residential types such as: small lot single family and multi - family developments, commercial, and institutional uses. The requested zoning change is compatible with this classification. The proposal does ENHANCE or maintain the public health, safety and general welfare. REASONING: The existing zoning district in which the subject property is located is not compatible with the general vicinity of the site. The proposed commercial zoning district is more appropriate for the site due to several factors, including the continued non - residential development in the area and surrounding land uses. Thus will enhance the public health and general welfare. September 20, 2010 Regular Meeting Minutes Harnett County Board of Commissioners Page 7 or 10 This request is NOT for a SMALL SCALE REZONING and should be evaluated for reasonableness. REASONING: The site is immediately adjacent to Commercial zoning and therefore, it is not necessary to evaluate this site for a small scale rezoning request. Suggested Statement -of- Consistency: Staff concludes that the requested rezoning to Commercial is compatible with all Harnett County regulatory documents and would not have an impact on the surrounding community and will enhance the public health, safety and general welfare for the reasons state in the evaluation. It is recommended that this rezoning request be approved. Mr. Locklear did mention that he was contacted shortly before this meeting by Mr. James Lucas who owns the property in the back of the proposed rezoned property. He said Mr. Lucas was not opposed to the rezoning request. He believes Mr. Lucas is involved in a property line dispute which wouldn't make a difference in the rezoning request as that is a private matter between land owners. Chairman McNeill called to order a public hearing on the matter and opened the meeting for comments from the public. Seeing no one move, Chairman McNeill closed the public hearing. Chairman McNeill said this is the corridor where we are trying to promote retail commercial development to help offset property taxes for services we must provide such as schools. Chairman McNeill moved to approve the proposed zoning change as presented. Commissioner Andrews seconded the motion which passed unanimously. Mr. Sauer presented the following report: • August Landfill Billing • Department of Public Health Activities Summary Mr. Sauer reminded commissioners of their upcoming special session scheduled for September 28, 2010, and listed several items that would be discussed including the South Central Wastewater District project review with Mr. Glanders, a follow -up regarding the $5.00 recycling fee omission from the tax bill and proposed amendment to the solid waste budget, and review of the latest draft of the ethics policy. He also said staff is prepared to present suggestions for potential schools sites for review by the school site selection committee. Mr. Sauer announced staff had been working closely with the Fort Bragg financing and the federal government is moving forward with the defeasance of the bonds issued years ago. Staff has also been working closely with the Davenport Financial Group who has identified a potential refunding of Certificates of Participation (COPs). Mr. Sauer announced that staff has invited Mr. Greg Burns with NC DOT to share and discuss the latest adjustments and proposals to the interchange at Hwy 401/ 210. Property owners are also invited to attend to address their concerns. Mr. Sauer said maps shared earlier by NC DOT are a work in progress and have been amended based on feedback. Commissioner Burgin requested copies of the revised map prior to the meeting. September 20, 2010 Regular Meeting Minutes Harnett County Board of Commissioners Page 8 or 10 Mr. Sauer said staff continues to review project costs for the sewer connection for Cape Fear Christian Academy, which is approximately $300,000, if they choose to hook on to county system. Mr. Sauer also noted upcoming discussions regarding the fire district realignment project. There was no need for closed session. Chainnan McNeill called for any new business. Commissioner House listed benefits of modular construction and referenced a 2004/2005 newspaper articles stating Wake County's use of modular units. Commissioner House suggested using Champion Builders to build modular classrooms as an alternative which would meet school needs while employing citizens. Commissioner Burgin moved to ask the Harnett County Board of Education to look at adding more modular and mobile classrooms, temporarily capping the enrollment at over - crowded schools and busing students to under - utilized schools, locate and rent other buildings that could accommodate students for the short term and look at alternative calendar schools. Commissioner House seconded the motion. Commissioner Burgin said these recommendations were taken directly from the 2008 BRAC Report. He also shared concerns with a recent report of the County's SAT scores dropping. The motion failed 3 to 2. Chairman McNeill requested a joint meeting with the Harnett County Board of Education to discuss these options but said reminded that the commissioners cannot tell the Board of Education how to operate their business, only fund their requests. Commissioner Burgin moved to allocate $5,000 to the Wellness Committee to match a NCACC Wellness Grant received so that the Wellness Committee would have $10,000 to promote wellness. It was confirmed that these funds would come from the contingency fund. Commissioner House seconded the motion which passed unanimously. Commissioner Burgin shared information about a Health Insurance Fee Minimization Incentive Program used in Pitt County. Commissioner Burgin again requested information regarding the H.A.R.T.S. program including percentages of budgets, clients and utilization for the past two years. He noted Mrs. Peggy McDougald is also waiting to receive this information. Commissioner Burgin said the County is putting about $1.8 Million toward Economic Development annually. He said the Harnett Forward Together Committee (HFTC) has a fund balance and a lot of property we need to encourage them to start selling. Commissioner Burgin moved to reduce the $1.2 Million given toward debt services to $400,000 per year; which he said was the original estimate proposed when HFTC was created. Commissioner Andrews moved to table this motion. Vice Chairman Hill seconded the motion which passed unanimously. Commissioner Burgin questioned the average salary for Harnett County citizens listed on the website and how it compares to the salaries of Harnett County employees and said he feels the numbers listed need to be investigated. Mr. Sauer said, based on the proximity, any sewage could be related to the Erwin Plant which they are working on plans to remedy. Commissioner House also asked if Mr. Sauer had scheduled Ken Bryan to come talk to the Board regarding the hospital yet. Commissioner Burgin moved to adjourn the meeting at 7:49 pm.
