Commissioner Andrews led the pledge of allegiance and invocation. Chairman McNeill called for additions and deletions to the published agenda. Mr. Sauer requested the addition of the Legal Department's request, on behalf of the Harnett County Library, for approval of contracts with Embarq Solutions, Inc., Carolina Telephone and Telegraph Company LLC and Winstream Carolina for provision of internet services, Wide Area Network (WAM) services, and equipment for the Harnett County Public Library System. Mr. Sauer also requested the addition of budget amendments 218 Public Utilities, Brightwater Interfund in the amount $1,016,981; 219 Detention Center Project, Change Order #17 in the amount of $1 8,537; and 232 Emergency Response Planning Fund Capital Outlay for equipment in the amount of $23,250. Commissioner Burgin requested that budget amendment 218 Public Utilities, Brightwater Interfund in the amount $1,016,981 be discussed separately. Commissioner House requested removal from the consent agenda for discussion purposes: 1) Public Utilities' request to consider an engineering services agreement in the amount of $52,272 for Marziano & McGougan, P.A. for the Coats Hwy 55N Wastewater Extension Project, 2) Public Utilities' request to consider the engineering services agreement in the amount $229,700 for Marziano & McGougan, P.A. for the Boone Trail /Johnsonville Wastewater Extension Project, and 3) Finance Departments' request for approval of the Emergency Medical Services patient write -offs. Tax refunds and releases (Attachment 1) 3. Public Utilities requested adoption of the Coats Hwy 55N Wastewater Extension capital project ordinance. This project consists of the extension of approximatley 5,000 linear feet of eight inch gravity sewer along NC 55N from the existing Town of Coats municipal boundary. This project is the result of a January 2009 agreement between the County and the Town of Coats to jointly fund this project. 4. Public Utilities requested approval of a decreasing change order in the amount of $126,670 for Blackmon Contracting Company. This construction contract is part of the Buffalo Lakes Wastewater Extension project. The contract scope was diminished due to Pierce Development's decision to no longer construct the Wildhorse Subdivision on Buffalo Lakes Rd. 5. Finance Department requested approval of Grants Administrative Policy. This policy is to assist county department heads that are involved in grant funded projects. The County does not have a centralized grants management function; however, this policy will address our internal grant procedures to insure that the related grant infoimation flows though the approval process. 6. Finance Department requested approval of the Trustee Resignation and Appointment Agreement between Harnett County and U.S. Bank for the Series 2007A, 2007B and 2008 Revenue Bonds. The purpose of this agreement is to replace First Citizen Bank as the Bond Trustee due to the sale of the First Citizens Bond Trustee Business to U.S. Bank National Association on October 19, 2009. 7. Emergency Services requested authorization to apply for 2009 -2010 ASPR (Assistant Secretary for Preparedness and Response) Grant for the SMAT III (State Medical Assistance Team) project administered by the Wake Med CapRac (Capital Regional Advisory Committee). The amount of this grant is $6,000 and will be a reimbursable grant with no county matching funds required. This grant will be use to purchase two Motorola 800 MHz VIPER radios @ $3,000 each. These radios will enhance local and regional support ; and enhance communication interoperability for the Harnett County SMAT III Team. 8. Finance Department requested approval of Contract Modification Agreement (Modification No. 1 — January 25, 2010) between Triangle South Local Workforce Investment Area and Lee and Harnett County. This contract modification allows for the County to receive an additional $70,000 in grant funding and to change the name from the Mid - Carolina Workforce Development Board and Workforce Development Area to Triangle South Workforce Development Board and Triangle South Workforce Development Area. 9. Planning Department requested waiver of $75 demolition peimit fee for contractors that demolish manufactured homes through project AMPI. Resolution to Celebrate the 100th Anniversary of the formation of the Boy Scouts of America (Attachment 2) Chairman McNeill opened the floor for infolinal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. - The following citizens spoke in opposition to the proposed zoning change request for Allied Investors, Inc., Applicant: Venture Properties VI, LLC, Existing Zoning District: RA -20R, Requested District: Commercial 9.56 acres, Alpine Dr., Barbecue Township, where they propose to build a Food Lion o Mr. Rick Yost, 1051 Northview Drive, Sunset Ridge o Cordelia Winchester, 91 Vail Court o Monessa Bryson, 145 Vail Court o Gabie Kerr, 671 Northview Drive o Trent Stanfield, 37 Vail Court o Eric Benoit, 180 Vail Court o Victor Hernandez, 1091 Northview Drive o Diane McNeill, 180 Canyon Court o Art Sears, 162 Canyon Court - Mr. Ronnie Walsh, Venture Property, spoke in support of the proposed zoning change request. Commissioner House moved to approve the appointments listed below. Commissioner Andrews seconded the motion which passed unanimously. Transportation Advisory Committee Lisa Newman and Phyllis Clayton (nominated by Vice Chairman Hill) were appointed to serve on the Transportation Advisory Committee for a term of one year ending December 31, 2010. Samantha Ficzko, Planner II, requested to postpone the public hearing regarding proposed text amendments for outdoor storage until the February 15, 2010 regular meeting of the Harnett County Board of Commissioner in order to meet notice requirements. Commissioner Andrews moved to untable the zoning change request for Allied Investors, Inc., Applicant: Venture Properties VI, LLC, Existing Zoning District: RA -20R, Requested District: Commercial 9.56 acres, Alpine Dr., Barbecue Township. Vice Chairman Hill seconded the motion which passed unanimously. Vice Chairman Hill said she believed it would cause homeowners property to depreciate and she would not want to live in an area with a business that close to her resident and family. She said the people are willing to drive miles to shop and were promised the area would remain residential. Commissioner House said it is a challenge to bring services to that area with all of the growth. Commissioner House noted the need to attract businesses and said he has lived Harnett County Board of Commissioners February 9, 2010 Regular Meeting Minutes Page 6of11 across from a Food Lion for five years with no issue. Commissioner Burgin reported that commissiners had toured the area. He asked Venture Properties to work with the residents about the possiblity of putting something at the back of the property for them and encouraged residents to form a homeowners association. Chairman McNeill said we have strongly encouraged commercial to keep the tax rates affordable. He said commissioners have been out there and looked and he believes there is enough buffer between the land and their homes allowing for compatible land use. Chairman McNeill said he believes this will enhance and not depreciate their property values. He said people who have lived in the area their whole lives don't want to travel for services they need. Chainiian McNeill said he personally doesn't believe this will be detrimental and will increase property values. Chairman McNeill moved to approve the rezoning request and adopt the evaluations made by the Planning Department which concluded that the requested rezoning to Commercial is compatible with Harnett County regulatory documents and would not have an unreasonable impact on the surrounding community and will enhance the public health, safety, and general welfare. Commissioner House seconded the motion which passed 4 to 1. Pierre Lauffer, BRAC Regional Task Force (RTF), discussed the quarry reservoir project and the possibly of BRAC RTF facilitating the transfer of the Garner Stone Quarry located on Hwy 210 south of Lillington from Hanson Aggregates of Irving, Texas to Harnett County. BRAC RTFs primary role would be to bring the parties to an agreement on the property transfer, but the final transaction would be a fee simple acquisition of the property by Harnett County from Hanson. The quarry could hold billions of gallons of water that could be held in reserve in case of a prolonged drought or other emergency, and ensure that Fort Bragg and the region could continue to meet its water needs in such a scenario. It was noted that in recent years, Harnett County Department of Public Utilities has worked with the BRAC RTF, Fort Bragg, and the region to build and sustain regional water and wastewater capacity. As the drought of recent years demonstrates, new ways to maintain regional capacity should be pursued in order to support growing population, sustain economic growth and to support the mission at Fort Bragg. Though the stone quarry is currently in operation, BRAC RTF wishes to work with the County to develop an agreement with Hanson Aggregates for Harnett County to purchase the quarry for future water resource augmentation. This initiative will support the water resource planning needed to ensure the region's continued economic growth and sustain Fort Bragg's military mission for decades to come. Mr. Lauffer reported the BRAC RTF Executive Committee recommended approval of the request to facilitate the property transfer at its December 17, 2009 meeting. Mr. Sauer noted the county had previously discussed setting aside $25,000 for this project. These funds will come from Public Utilities' existing operating budget. This money would be available under contract with RTF to help cover their cost as they begin the process of negotiating with the Hanson. Cost could include but are not limited to travel, engineering, and reporting. Mr. Sauer said even with Harnett County Board of Commissioners February 9, 2010 Regular Meeting Minutes Page 7of11 the timeline out until 2045, we are hoping that negotiations and this agreement can be consummated in the next 12 to 18 months. Commissioner Andrews moved to approve $25,000 for this project. Commissioner Burgin seconded the motion which passed unanimously. Trinity Faucett, Director of Human Resources, reported the outcome of her recent survey of whether employees preferred the proposed 1% COLA or restored 401K county contributions was about 50/50. She reminded the board that more employees would benefit from a COLA. Regarding a hiring freeze of the intimidate positions, Mrs. Faucett said most of these positions are public safety positions that fill in "as need" which would result in overtime costs to the Sheriffs Office and EMS as they would have to call someone in to fill in. She reported an estimate of $202,000 savings from an early retirement program which would fund a 1 '/z percent COLA if effective February 1st. It was clarified that Sheriff deputies continue to get 401 K contributions which is mandated by the state. Commissioner Burgin said he thinks we still need a hiring freeze. Mr. Sauer reported that before departments advertise any existing vacancies they work with Human Resources who then alerts the County Manager. Mrs. Faucett noted that department heads have been very conservative. Mr. Burgin asked Mr. Sauer to include that info' illation in the County Manager's report monthly. Commissioner Burgin moved to give a 1 '/2 % COLA adjustment, in one lump sum, effective February 1, 2010. The motion was seconded by Commissioner House and passed unanimously. The motion to implement a hiring freeze and re- implement the county's 401K contribution remained tabled. The Board considered Budget Amendment 218 Public Utilities, Brightwater Interfund in the amount of $1,016,981. Staff explained this amount matched the approved project ordinance and the budget amendment was the interfund transfer to fund the Brightwater Infrastructure Development Project; putting the money in the correct account. Commissioner Andrews moved to approve the budget amendment as presented. Vice Chairman Hill seconded the motion. Commissioner Burgin said he didn't have any problem with the infrastructure but we cannot get in to doing roads and have to be careful that utility money is not used on road ways. The motion passes unanimously. 218 Public Utilities Department Code 531- 9000 - 431.90 -83 Brightwater — Interfund 531- 0000 - 399.00 -00 PU Fund Balance Appropriated 1,016.981 increase 1,016,981 increase Staff Attorney Jennifer Slusser, on behalf of the Harnett County Library, requested approval of contracts listed below with Embarq Solutions, Inc., Carolina Telephone and Telegraph Company LLC and Windstream Carolina for provision of internet services, Wide Area Network (WAN) services, and equipment for the Harnett County Public Library System. Mrs. Slusser provided supporting documentation relating to the County's participation in the Erate Program and noted the County has participated in this cost savings program in the past. 1) Services & Use Agreement with Carolina Telephone and Telegraph Company LLC and the Products and Services Agreement with Embarq Solutions, Inc. for the provision Harnett County Board of Commissioners February 9, 2010 Regular Meeting Minutes Page 8of11 of Internet and WAN connecting the Lillington, Angier, Coats, Dunn and Erwin libraries, maintenance and equipment. The Agreement would begin on July 1, 2010 and last for a term of 36 months. The total monthly payment for these services is $5,730.00, with an annual cost of $68,763.96. The County will use this Agreement in its application for Erate, which provides an 80% savings to the County if approved, so assuming the County receives the Erate funding the actual cost of services to the County under this Contract is $1, 146.06 a month and $13,752.79 a year. Embarq also requests that the Board adopt a State and Local Government Certificate of Resolution in the form attached hereto. 2) Agreement for Communication Services with Windstream Carolina for connection of the proposed Western Harnett Branch Library to the WAN into the Main Library in Lillington. The Library desires for the Board to enter into this Agreement so that it can apply for the Erate funding for the 2010 -2011 fiscal in the event the Western Harnett Library is built. The Addendum to this Agreement contains an express contingency that the construction of the Western Harnett Branch of the Harnett County Public Library must begin on or before June 30, 2011 in order for the Agreement to become binding. The Library entered into a similar Agreement with Windstream last year in order to utilitze the Erate funds if the new branch of the Library is built. The montly cost for this connection service is $1,100.00, with an annual cost of $13,200.00, but with the Erate funding the cost would be $220.00 a month and $2,640.00 a year. 3) Products and Services Agreement with Embarq Solution, Inc. for connecting the Windstream Carolina WAN line for the Western Harnett Branch Library to the Main Library in Lillington, which is in the Embarq service area. The Library desires for the Board to enter into this Agreement so that it can apply for the Erate funding for the 2010- 2011 fiscal in the event the Western Harnett Branch Library is built. The Schools and Libraries Funding Program Addendum indicates that the Agreement is contingent on receipt of the government funding commitment. The Library entered into this same Agreement with Embarq last year in order to utilitze the Erate funds if the new branch of the Library is built. The montly cost for this connection service is $122.00, with an annual cost of $1,464.00, but with the Erate funding the cost would be $24.40 a month and $292.80 a year. Embarq also requests that the Board adopt the State and Local Government Certificate of Resolution in the form attached hereto. 4) Service and Equipment Agreement with Carolina Telephone and Telegraph Company LLC for internal connections and AV wiring for the proposed Western Harnett Branch Library. The Library desires for the Board to enter into this Agreement so that it can apply for the Erate funding for the 2010 -2011 fiscal year in the event the Western Harnett Library is built. The School and Libraries Funding Program Addendeum indicates that the Agreement is contingent on receipt of the government funding commitment. The total cost for the materials and labor for the installation of computer and AV wiring would be $21,975.00, the cost to the County with Erate funding would be $4,395.00. Commissioner Burgin said the cost looks high and questioned if there were any other bids. Mrs. Slusser responded this program is done through Embarq and we don't have the ability to be involved in the process. She said we pay some cost and then get advantage of rebate through the program which is 80% this year. Staff Attorney Sarilyn Leary said the first contract for services is already in place but the remaining three are contingent on the West Library. The cost for the Harnett County Board of Commissioners February 9, 2010 Regular Meeting Minutes Page 9of11 first contract, which is already in place is $68,000 but with the Erate it will cost the County $13,000. Commissioner Burgin questioned why staff didn't process this information sooner to allow appropriate time review and approval. Mrs. Slusser said allowing time for proper and timely review of such documents has been discussed and reiterated with the depai tinent heads. Commissioner Burgin moved to approve the contracts. The motion was seconded by Commissioner Andrews and passed unanimously. The Board considered Public Utilities' request for approval of an engineering services agreement in the amount of $52,272 for Marziano & McGougan, P.A for the Coats Hwy 55N Wastewater Extension Project. Commissioner House said there should have been a contract in place prior to negotiations with consultant. Commissioner House questioned if these engineering services have already been done. Mr. Ward said the design and cost estimates were prepared but they need the engineering services agreement to continue. Staff did not bid out the engineering servcies. The County's legal staff was involved in drafting the contract with the Town of Coats. Commissioner Andrews moved to approve to move forward with this project. Commissioner House seconded the motion which passed unaimously. The Board considered Public Utilities' request for approval of an engineering services agreement in the amount $229,700 for Marziano & McGougan, P.A. for Boone Trail /Johnsonville Wastewater Extension Project. Commissioner House asked if this work had already been done. Mr. Ward responded that the design work was done and permits submitted for. Mr. Ward said they used Marziano & McGougan as a consultant to help the county come up with original cost in 2008 as they had to come up with cost estimate to provide sewer to both locations but did agree the work was done without a contract. Commissioner House asked that staff be more careful of work being done without contracts. Commissioner Andrews made a motion to move forward with this project. Vice Chariaman Hill seconded the motion which passed unanimously. The Board considered the Finance Department's request for approval of the Emergency Medical Services patient write -offs. These bills are past the statute of limitations and cannot be forcibly collected. Staff reported, as part of the continual effort to keep a "clean" ambulance receivable, they have made several different attempts to collect on these bills to include refilling older claims with insurance companies and utilizing the North Carolina Debt Set -off program. In many cases partial payments were received and these totals represent remaining partial balances with some dating back to 2004. Commissioner House asked, with $1.5 Million write off request, if should we look at contracting this out. Commissioner Burgin asked if we had talked to anyone about selling these receivables to a company for collection and expressed interest in approaching vendors. Staff reported that Harnett County started up their own transport services again with this program being placed in the Finance Department 3 to 4 years prior. Mr. Sauer also noted staff is looking at developing hardship policies regarding transport service costs. Commissioner Burgin moved to approve the write -offs.
