072009mHARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Regular Meeting July 20, 2009 The Harnett County Board of Commissioners met in regular session on Monday, July 20, 2009, in the Commissioners Meeting Room, County Administration Building, 102 East Front Street, Lillington, North Carolina. Members present: Staff present: Timothy B. McNeill, Chairman Beatrice B. Hill, Vice - Chairman Dan B. Andrews Gary House Jim Burgin Scott Sauer, County Manager Wm. A. (Tony) Wilder, Assistant County Manager Dwight W. Snow, County Attorney Sylvia Blinson, Finance Officer Gina Daniel, Acting Clerk Chairman Timothy B. McNeill called the meeting to order at 7:00 pm. Commissioner Dan Andrews led the pledge of allegiance and invocation. Chairman McNeill called for additions and deletions to the published agenda. Chaiiinan McNeill, with consensus of the Board, added a Resolution of Commendation to Amber Reynolds and Nichol O'Malley to the agenda as Agenda Item 7c. Commissioner Burgin asked to remove Item 4 -A Minutes from the agenda as there were no attached minutes to approve. Commissioner Burgin also asked that both Items 4G Workplace Violence Prevention Policy and 4J Purchasing Policy be removed from the consent agenda and listed separately for discussion. Chairman McNeill announced that Agenda Item 10 had been removed from the agenda and there would not be a public hearing regarding the request to rezone from Conservation to RA -20M. Scott Sauer asked for a deferment for Agenda Item I - Early Retirement Incentive Program — until the August 3, 2009 Board of Commissioners meeting. Commissioner Andrews moved to approve the agenda as amended. Commissioner Burgin seconded the motion and it passed unanimously. Commissioner House moved to approve items on the amended consent agenda. Vice - Chairman Hill seconded the motion. Commissioner Burgin asked Mrs. Blinson for clarification on encumbrances included in the budget amendments. The motion passed unanimously. 1. Tax refunds and releases (Attachment 1) 3. Tax rebates (Attachment 2) 4. Resolution recognizing Eagle Scout Steven J. Turnage (Attachment 3) 1,100 decrease 1,100 increase 5. The Harnett County Public Library applied for and has received notification of award for the Library Services and Technology Act (LSTA) EZ Basic Equipment Grant in the amount of $18,808. The local match of $3,002 will be made by The Friends of the Harnett County Public Library, a 501(c)(3) organization. The Harnett County Public Library requests authorization from the Board of Commissioners to approve and accept the local match and the grant. 6. Agreement for Building Inspection Services between Town of Erwin and County of Harnett. Contract teitu is July 1, 2009 — June 30, 2010 with either party able to terminate the agreement with sixty (60) days prior notice. The county shall be entitled to receive seventy -five percent (75 %) of fees collected pursuant to the schedule of fees for Building Inspection Services for Town and one hundred percent (100 %) of fees collected for any and all re- inspections. 7. Approval to allow our Legal Department and Sheriff's Office staff to negotiate terms and conditions of a Food Services Proposal for Inmate Food Service with ABL Management, Inc. Informal Comment David and Karen Rogers of Coats both complained about the Harnett Forward Together Committee, the tax re- evaluation as well as special meeting pay for commissioners. Commissioner Burgin moved to adopt the following resolutions: 1- A resolution congratulating the 10 and under Harnett County Hot Shots on their recent state championship. (Attachment 4) 2 - A resolution congratulating the 12 and under Harnett County Hot Shots on their recent state runners up. (Attachment 5) 3 - A resolution of commendation to Amber Reynolds and Nichol O'Malley. (Attachment 6) Commissioner Andrews seconded the motion and it passed unanimously. Commissioner House presented the resolutions to both Harnett County Hot Shot teams. Chairman McNeill thanked the teams for being wonderful ambassadors for Harnett County. Keith Faulkner, Chief Tax Appraiser, updated the Board of Commissioners regarding the current tax re- evaluation. Mr. Faulkner reported that they originally received approximately 8,300 appeals. After reviewing the appeals and responding back to the tax payer they received approximately 1,600 appeals. The tax office is reviewing appeals again and will contact the tax payer if they find there is any adjustment they can offer but otherwise will send out notices of set hearings with the Board of Equalization and Adjustment for appeals. The Tax Department is anticipating that it will take approximately 14 weeks for all of the appeals to be heard by the Board of Equalization and Adjustment which may necessitate a budget adjustment to pay board members for additional meetings. Mr. Faulkner said once the county's budget is set they will go ahead and process bills. Commissioner Burgin asked that the Board of Equalization and Adjustment consider evening meetings to accommodate tax payer's schedules. He also asked Mr. Faulkner how many of the appealed re- evaluations received increases after review. Mr. Faulkner said that upon further review there was an increase in a small amount of cases. Jennifer Slusser reported that formalizing our current Workplace Violence Prevention Policy made us compliant with current state legislation. Commissioner Burgin asked that staff check in to the possibility of having the policy circulated and signed electronically. Commissioner Andrews moved to adopt the Workplace Violence Prevention Policy as presented. The motion was seconded by Vice - Chairman Hill and passed unanimously. Commissioner Burgin voiced concern that the Purchasing Policy would add to the "bureaucracy" to purchase supplies. Sylvia Blinson explained that the only change from our current policy was the $500 threshold. Commissioner Andrews moved to adopt the Purchasing Policy as presented. The motion was seconded by Vice - Chairman Hill and passed 4 to 1 with Commissioner Burgin opposing. Mr. Ralph Thurman addressed the Board regarding the Proposed Rural Operating Assistance (ROAP) Application. Mr. Thurman stated that a public hearing is required when receiving grant funds from the state. He reported that Harnett County would received all local funds used as a match back from citizens that use the service. Chairman McNeill called to order a public hearing on the Proposed Rural Operating Assistance (ROAP) Application and opened the meeting for comments from the public. There being no comment, Chairman McNeill closed the public hearing. Commissioner Burgin asked Mr. Thurman how many drivers the HARTS program currently has for the 44 vehicles they are shown to have. Mr. Thurman said they have 23 drivers but the program does not have 44 vehicles. Commissioner Burgin asked staff to work on the inventory and believes there is a potential to save money regarding insurance on the 44 verses 29 vehicles and also asked for the number of individuals that use the HARTS Transportation. Commissioner Burgin nominated Commissioner Andrews to be the voting delegate for Harnett County at the upcoming NCACC Annual Conference August 27 — 30 in Catawba County. Vice - Chairman Hill seconded the motion which passed unanimously. County Manager Scott Sauer presented the monthly activity reports for Animal Control, Public Health and a Mid - Carolina Workforce Development Board Summary. Commissioner House asked Attorney Slusser where the County currently is in regards to an addendum to the agreement with Campbell University regarding the Convocation Center after the seven years. Commissioner House asked Mr. Sauer for clarification as to who guaranteed the 50 jobs on the recent grant awarded, Harnett Health System or the Harnett Forward Together Committee. Commissioner Burgin moved to adjourn the meeting, Commissioner Andrews seconded the motion and the meeting adjourned 7:53 pm. imothy :. Gary House Attachment 6 A RESOLUTION OF COMMENDATION TO AMBER REYNOLDS AND NICOLE O'MALLEY THAT WHEREAS, on May 28, 2009 at the Carolina Lakes Subdivision in western Harnett County a birthday party for children was being conducted at a small beach next to the lake at 26 Oak Landing; and WHEREAS, during the party a three year old boy named Giovanni May was observed in the water as a potential drowning victim; that Amber Reynolds alertly and bravely went to the child's rescue and pulled him from the lake; that nurse Nicole O'Malley who was attending the party noted the potentially fatal condition of the child and immediately performed CPR on him thereby reviving said child; that Giovanni May was subsequently transported to the Cape Fear Valley Medical Center where he made a full recovery partly due to the administration of CPR on him by Nurse O'Malley; and WHEREAS, both Amber Reynolds and Nicole O'Malley exhibited great attributes of quick decisive action, calm demeanor, courage and skill in dealing with this emergency situation and their heroic efforts should be recognized. NOW, THEREFORE, BE IT RESOLVED, by the Harnett County Board of Commissioners that Amber Reynolds and Nicole O'Malley are hereby commended and honored on behalf of the citizens of Harnett County for their observant prowess and emergency action skills in rescuing Giovanni May from a potentially fatal drowning. The Board does hereby express its heartfelt appreciation to Ms. Reynolds and Ms. O'Malley for their fearless and unselfish actions in preserving a young life.
