Contract for the development of a marketing plan and formal presentation FOSTER PARENTS designed for the recruitment of new foster parents and adoptive homes in Harnett & ADOPTIVE County. The total payment of the contract will not exceed $10,000. The funding PARENTS for this contract will be special adoption incentive the County has received from the State for past performance in securing adoptions. This is 100% State and Federal funding and must be used in the efforts to enhance the adoption efforts of the county. 26 HILLCREST YOUTH 5. Renewal of contract agreement with Lee County which provides Harnett County SHELTER AGREE. with three bed spaces at the Hillcrest Youth Shelter. These spaces are utilized by the County for troubled youths that need placement. The cost is $39,000. MID-CAROLINA AGING 6. Mid -Carolina Area Agency on Aging County Funding Plan for FY 2001-2002. SHEARON HARRIS 7. Harnett County portion of the Emergency Response Plan for Shearon Harris RESPONSE PLAN Nuclear Plant 8. Grant agreement for architectural survey b the State Preservation Office Division • ARCHITECTURAL SURVEY g y y ' ARCHIVES & HISTORY of Archives and History, North Carolina Department of Cultural Resources. This grant amount is $32,000. and will require County funding totaling $8,000. 9. Renewal of lease with M.A. Stevens for office space at 716, 718, and 720 Main LEASE FOR OFFICE Street, Lillington. Rental amounts shall be $695 per month for 716 South Main SPACE ON MAIN ST. Street; $595 per month for 718 South Main Street; and $550. per month for 720 South Main Street. The term of the lease shall be one year with option to renew for an additional term of one year upon the same terms and conditions. CONTRACT FOR LAWN 10. Renewal of grounds maintenance contract with Carolina Pines Lawn Care for MAINTENANCE lawn and grounds care service at the Governmental Complex property. The contract is for one year, and in the amount of $43,680. MTG. CANCELLED 11. Cancellation of first regular Board of Commissioners meeting in July. LEONARD ARNOLD 12. Resolution recognizing Leonard Arnold, retiring assistant superintendent of RECOGNIZED Harnett County Schools. (Attachment 2) 13. FUNDING FOR MENTAL H. • Informal comments were received from Wilton Lee, 132 Rosebud Street, Anderson INFORMAL COMMENTS Creek, who expressed concerns with his neighbor's behavior. Chairman Byrd nominated Elsa Sears to fill the unexpired term of Bethany Stevens APPOINTMENTS who resigned from the Harnett County Council for Women. Commissioner McNeill nominated Commissioner Hill for reappointment to the Social Services Board and John Q. Shaw, Jr. for reappointment to the CCCC Harnett County Board of Trustees. Commissioner Titchener nominated Nettie Cameron for reappointment to the Jury Commission. Commissioner McNeill moved for the appointments as listed below. Commissioner Andrews seconded the motion and it passed unanimously. Harnett County Council for Women Elsa Sears appointed to fill unexpired term which will expire 9/30/02 Social Services Board Beatrice Bailey Hill reappointed fora 3-year term to expire 6/30/04 CCCC Harnett County Board of Trustees John Q. Shaw reappointed for a 4-year term to expire 6/30/05 Jury Commission • Nettie Cameron reappointed for a 2-year term to expire 6/30/03. Ralph Thurman, Transportation Manager, presented and explained a proposed Rural Operating Assistance Programs grant application for FY 2001-2002. Chairman Byrd TRANSPORTATION called to order a public hearing on the proposed grant application and opened the GRANT APPLI. meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner Titchener moved to authorize the grant application. Commissioner Hill seconded the motion and it passed unanimously. NC DOT SECONDARY Ray Stone, District Engineer, North Carolina Department of Transportation, submitted ROADS IMPROVEMENT and reviewed the proposed FY 2001-2002 Secondary Roads Improvement Program PLAN 2001-2002 for Harnett County. Chairman Byrd called to order a public hearing on the proposed roads improvement program. The following citizens inquired about certain roads: 1. Frances Harrington, 116 Harrington Road (SR 1230) 2. Smith, regarding Riverside Road There being no further comments, Chairman Byrd closed the public hearing. • Commissioner McNeill moved to adopt a resolution to approve the FY 2001-2002 Secondary Road Construction Program for Harnett County as presented by Mr. Stone. Commissioner Andrews seconded the motion and it passed unanimously. (Attachment 3 ) Neil Emory, County Manager, presented for the Board's consideration a proposed MOU RE: MID- memorandum of understanding regarding Mid -Carolina Council of Governments CAROLINA RURAL Rural Transportation Organization. Commissioner McNeill moved to enter into the TRANS. ORGAN. memorandum of understanding with Cumberland and Sampson Counties and Region M Council of Governments. Commissioner Hill seconded the motion and it passed unanimously. (Attachment 4) PUBLIC HEARING Neil Emory, County Manager, stated that in accordance with State Statute, the Board RE: BUDGET must conduct a public hearing to receive comments regarding the proposed FY 2001- 2002 Harnett County Budget. Chairman Byrd called to order a public hearing on the proposed budget and asked for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. The Budget will be adopted at a future meeting and prior to July 1, 2001. A monthly report was filed with the Board by Veteran's Affairs. •PLAQUE OF Frank Lewis presented a plaque of appreciation of support to the County from the APPRECIATION Cape Fear River Basin Assembly. FROM CAPE FEAR RIVZR BASIN ASMB • Commissioner Andrews moved that the Board go into closed session for the following purposes: CLOSED SESSION, 1) To instruct the county staff concerning the position to be taken on behalf of the County in negotiating the terms of a proposed contract for the acquisition of real property; and 2) To discuss certain personnel matters; and 3) To discuss matters relating to the location or expansion of industries or other businesses in Harnett County. This motion is made pursuant to N.C. General Statute Section 143-318.11 (a)(4)(5) & (6). Commissioner Hill seconded the motion and it passed unanimously. Commissioner Hill moved for the Board to come out of closed session. Commissioner Titchener seconded the motion and it passed unanimously. MEMORANDUM OF UNDERSTANDING FOR COOPERATIVE, COMPREHENSIVE AND CONTINUING TRANSPORTATION PLANNING AND THE ESTABLISHMENT OF A RURAL TRANSPORTATION PLANNING ORGANIZATION is FOR The Counties of Cumberland, Harnett, and Sampson, comprising the Region M Planning Area, and the Municipalities contained therein, excluding Fayetteville, Hope Mills and Spring Lake, and the North Carolina Department of Transportation. WITNESSETH Whereas, section 135 of Title 23, United States Code, declares that it is in the national interest to encourage and promote the development of transportation systems embracing various modes of transportation in a manner that will serve all areas of the State efficiently and effectively; and Whereas, North Carolina General Statutes 136-21 1 enacted July 6, 2000, provides for the establishment of Rural Transportation Planning Organizations (RPOs) similar in concept to Metropolitan Planning Organizations (MPOs) for transportation planning in North Carolina's urban areas; and Whereas, the establishment of a Rural Transportation Planning Organization (RPO), • similar in concept to the Urban Metropolitan Transportation Planning Organizations (MPOs), would provide rural areas the opportunity to work in partnership with the North Carolina Department of Transportation toward development of sound, short and long-range transportation planning for rural areas; and Whereas, the establishment of a Rural Transportation Planning Organization for the Region M area would assist the North Carolina Department of Transportation in complying with the provisions of the Transportation Equity Act for the 2 1 " Century (TEA 21), enacted June 9, 1998, relative to the participation of local officials and the public in the transportation planning process; and Whereas, It is the desire of these local governments and agencies to establish a Continuing, Comprehensive, Cooperative Transportation Planning Process with the establishment of a Rural Transportation Planning Organization for the Region M Planning Area; the following memorandum of understanding is made. Section I . It is hereby agreed, that the Counties of Cumberland, Harnett, and Sampson, and the municipalities within said counties, excluding the Fayetteville Area MPO, and the North Carolina Department of Transportation intend to establish and participate in a Rural Transportation Planning Organization created for the general purposes and responsibilities outlined in the • following: 1. Develop long range local and regional multimodal transportation plans in cooperation with the North Carolina Department of Transportation. 2. Provide a forum for public participation in the transportation planning process. 3. Develop and prioritize suggestions for transportation projects the Rural Transportation Planning Organization believes should be included in the State's Transportation Improvement Program. 4. To conduct transportation -related studies and surveys and to provide transportation -related information to local governments and other interested organizations and persons. 5. Undertake mutually agreed upon transportation -related tasks to enhance transportation system development, coordination and efficiency. Section 2. It is hereby further agreed that transportation plans and programs and land use policies and programs for the Rural Transportation Planning Organization will be coordinated by the Region M Council of Governments, an agency selected on behalf of participating local governments and the North Carolina Department of Transportation to be the administrative entity and serve as the lead planning agency for coordinating transportation planning in the three county Planning Area. Section 3. Establishment of Rural Transportation Advisory Committee (RTAC). A Rural • Transportation Advisory Committee (RTAC) is hereby established with the responsibility for serving as a forum for cooperative transportation planning decision making for the Rural Transportation Planning Organization (RPO). The Rural Transportation Advisory Committee (RTAC) shall have the responsibility for keeping the policy boards informed of the status and requirements of the transportation planning process; assist in the dissemination and clarification of the decisions, inclinations, and policies of the policy boards; and helping to ensure meaningful public participation in the transportation planning process. I . The Rural Transportation Advisory Committee will be responsible for carrying out the following: A. Establishment of goals and objectives for the transportation planning process. B. Endorsement, review and approval of changes to adopted Transportation Plans for the Rural Transportation Planning Organization. C. Endorsement, review and approval of a Prospectus for Transportation Planning which defines work tasks and responsibilities for the various agencies participating in the Rural Transportation Planning Organization. D. Endorsement, review and approval of Transportation Improvement Projects which • support and enhance rural transportation within the Rural Transportation Planning Organization. 2. The membership of the Rural Transportation Advisory Committee shall consist of the following: A. One County Commissioner representing each County. One municipal elected official representing the municipal interest in each County. B. One member of the Region M Council of Governments Executive Board. C. All members of the North Carolina Board of Transportation representing the Department of Transportation Divisions 03 and 06. 3. The County Commissioner representing each county shall be elected by the Board of County Commissioners of each county in regular session. The elected municipal representative shall be selected by balloting of municipal elected officials in each county (one vote for each town) every two years. A simple majority vote wins the seat. The term of office for all seats on the RTAC is two years. Re -appointment is possible. 4. The Rural Transportation Advisory Committee (RTAC) will meet as often as it is deemed appropriate and advisable. On the basis of majority vote of its membership, the Rural Transportation Advisory Committee shall appoint a member of the committee to act as chairperson with the responsibility for coordination of the committee's activities. A member of the staff of the Region M Council of Governments will serve as secretary to the committee. Section 4. Establishment of Transportation Technical Committee (TTC). A Transportation Technical Committee shall be established with the responsibility of general review, guidance and coordination of the transportation planning process for the Rural Transportation Planning Organization (RPO) and the responsibility for making recommendations to the Rural Transportation Advisory Committee regarding any necessary actions relating to the continuing transportation planning process. 263 1. The TTC shall be responsible for development, review and recommendation for approval of the Transportation Planning Prospectus for the RPO, the Transportation Improvement Plan, and revisions to the Transportation Plan for the RPO. 2. Membership of the Transportation Technical Committee shall include technical representatives from all local and state governmental agencies directly related to and concerned with the transportation planning process for the RPO Planning Area. Initially, the membership shall include, but may not be limited to, the following: A. County Manager and County Planner (if designated) from each of the three counties of the • RPO Planning Area. B. The Chief Administrative Official or Planner (as designated) from each municipality of 1000 population or more in the RPO Planning Area. C. Executive Director and Transportation Planner, Region M Council of Governments. D. Division Engineer, 3rd Division of Highways, North Carolina Department of Transportation or designated representative. E. Division Engineer, 6th Division of Highways, North Carolina Department of Transportation or designated representative. F. Manager, Statewide Planning Branch, Planning and Environment, North Carolina Department of Transportation, or designated representative. G. Area Traffic Engineer, Division of Highways, Traffic Engineering Branch, North Carolina Department of Transportation. 3. The Transportation Technical Committee shall meet when it is deemed appropriate and advisable. On the basis of majority vote of its membership, the Transportation Technical Committee shall appoint a member of the committee to act as Chairperson with the • responsibility for coordinating the committee's activities. Membership of the Transportation Technical Committee may be revised upon the approval of the Rural Transportation Advisory Committee of the RPO. Section S. It is further agreed that the participating agencies will assist in the transportation planning process by providing planning assistance, data and inventories in accordance with the approved Prospectus of the RPO. Section 6. Parties to this Memorandum of Understanding may terminate their participation in the continuing transportation planning process by giving 90 days written notice to the other parties prior to the date of termination. Section 7. In witness whereof, the parties of this Memorandum of Understanding have been authorized by appropriate and proper resolutions, and/or legislative authority to sign this Memorandum of Understanding, this the day of , 2001.
