03192001160 HARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Regular Meeting March 19, 2001 The Harnett County Board of Commissioners met in regular session on Monday, March 19, 2001, in the County Administration Building, 102 East Front Street, Lillington, North Carolina. Consideration will be $35.00 per acre. 9. Amendment to the Ordinance Establishing Financing of the 911 Emergency TOWN OF ERWIN Telephone System to include the Town of Erwin in the jurisdiction in which the E911 County provides dispatch services. ORD. 164 INFORMAL COMMENTS Informal comments were provided by the following citizens: - Floyd Hein, Anderson Creek, expressed concerns with cigarette butts at the Anderson Creek gym and trash trucks not using tarps to cover loads. - Wilton Lee, Spring Lake, expressed concerns with uninhabited used mobile homes and junkyards off Ray Road. - Rev. Joseph Smith, Riverside, expressed concerns with standing water in the community. Commissioner Hill moved for the appointments listed below. Smith for a one-year term to expire 4/30/02 Nursing Home Community Advisory Committee Diane Sisk for a one-year term to expire 4/30/02 Southeastern Economic Develonment Commission Carrell Robinson for a four-year term to expire 4/30/05 Chairman Byrd called to order a public hearing on a zoning change request for Cebco Construction, Inc. Lori Tomaszewski, Chief Planner, presented the zoning change request for Cebco Construction, Inc., SR 1117-Nursery Road, from RA-20R Zoning ZONING CHG. FOR CEBCO CONST. INC. District to Commercial Zoning District, Anderson Creek Township, 39.57 acres. The Planning Board recommended approval. Chairman Byrd opened the meeting for public comments. Comments were provided by the citizens listed below. 1. Ed Bain, Attorney from Lillington, representing a number of people in the area to resist zoning change. Mr. Bain presented a petition to the Board with approximately 50 signatures asking that the request be denied. 2. John Culbreath, Anderson Creek Club — stated the area is not ready to develop commercially and asked the Board to deny the request. • 3. Deborah Boswick, Hwy. 301, does not want low quality businesses in the community. 4. Mike Muller, 3493 Nursery Road, stated there is not yet enough people in the area to support businesses. 5. Floyd Hein, 6726 Rainey Drive, Spring Lake, is in favor of decent business such as recreational ice skating. 6. Elmer Smith, Nursery Road, stated the area is not yet ready for commercial development. 7. Wilton Lee, Spring Lake, stated that we need to clean up what we already have. There being no further comments, Chairman Byrd closed the public hearing. Commissioner McNeill moved to approve the zoning change request. Commissioner Titchener seconded the motion and it passed unanimously. Chairman Byrd called to order a public hearing on a zoning change request for Irene ZONING CHG. FOR Kinard. Lori Tomaszewski, Chief Planner, presented the zoning change request for Irene• IRENE KINARD Kinard, Hwy. 24, request to rezone 11.63 acres from RA-20M Zoning District to Commercial Zoning District, Johnsonville Township. The Planning Board recommended approval. Chairman Byrd opened the meeting for public comments. Irene Kinard, applicant, stated she wants the zoning change so she can open a flea market. There being no further comments, Chairman Byrd closed the public hearing. Commissioner McNeill moved to approve the zoning change request. Commissioner Hill seconded the motion and it passed unanimously. George Jackson, Planning Director, presented the North Carolina 87 Corridor Study for the Board's review. Over the past year the Harnett County Planning Board, with the NC 87 CORRIDOR technical assistance of the North Carolina Department of Commerce's Division of STUDY Community Assistance in Fayetteville, has studied the existing development issues along the NC Hwy. 87 Corridor from the Lee County boundary to the Cumberland County boundary. This report contains the research and recommended action of the Planning Board to be considered by the Board of Commissioners. A public hearing/town meeting will be held in the community some time in the near future prior to consideration by the Board of Commissioners of proposed plans. AMENDS. TO Neil Emory, County Manager, presented an overview of proposed amendments to the SUED. REGS . Harnett County Subdivision Regulations. Commissioner McNeill made a motion to schedule a public hearing on the proposed amendments for April 2, 2001. Commissioner • Andrews seconded the motion and it passed unanimously. Neil Emory, County Manager, presented for the Board's consideration a proposed PINE GROVE DEV. CORP. contract with Pine Grove Development Corp. Commissioner Andrews moved to approve the contract as presented. Commissioner Hill seconded the motion and it passed unanimously. (Attachment 8) ENeil Emory, County Manager, noted that Central Carolina Community College has HARNCCCC T WESTERN received funding to provide educational opportunities in western Harnett County in the CENTER MED. event the County can find a suitable site. It has been determined that the old Western CENTFACILITY Harnett Medical Center on Hwy. 27 would be a suitable location for this program. Commissioner McNeill moved for staff to proceed with final negotiations for a contract. Commissioner Hill seconded the motion and it passed unanimously. REPORT OF Neil Emory, County Manager, noted that some time ago the Board contracted with the COMMUNICATIONS firm of Communications International Inc. to conduct a comprehensive study of the STUDY County's overall communications program. Representatives of Communications International Inc., Bob Stork, H.T. "Sonny" Dean, and Alex Small, presented a report and recommendation regarding the public safety radio communications for Harnett County. Copies of the findings have been forwarded to the City of Dunn and the Town of Erwin and staff will meet with the fire and rescue chiefs regarding this matter in the near future. is The Board directed the County Manager to develop a plan of action in response to the report during the budget process. Departmental reports were provided by the Fire Marshal/Emergency Management, Economic Development, Animal control, Department of Social Services, Veterans Affairs, Housing, and Emergency Medical Service. INFRASTRUCTURE Mr. Emory presented a proposed infrastructure agreement between local governments AGREE. BETWEEN for the Board's consideration. Commissioner Hill moved to authorize the county LOCAL GOVM' TS manager and staff to move forward with contacting the municipalities regarding the agreement. Commissioner Andrews seconded the motion and it passed unanimously. There being no further business, Commissioner Hill moved for adjournment. NORTH CAROLINA STATE UNIVERSITY College of Design MEMORANDUM OF AGREEMENT RESEARCH, TRAINING, EXTENSION NUMBER This Agreement entered into by and between the North Carolina State University; College of Design (hereinafter. referred to as ("UNIVERSITY"), Raleigh, North Carolina, and Harnett County, with a principal place of business at Lillington, NC , hereafter referred to as "SPONSOR". WHEREAS, the project contemplated by this AGREEMENT is of mutual interest and benefit to the UNIVERSITY and the SPONSOR, and will further the instructional, research, and public service objectives of the . UNIVERSITY in a manner consistent with its status as a public educational institution; and WHEREAS, SPONSOR desires to provide funding in support of the project; NOW, THEREFORE, the parties hereto agree as follows: (1.) SCOPE OF PROJECT The UNIVERSITY will use its best efforts to perform activities as described in its proposal entitled "Dunn Erwin Rail trails Prjoject" dated March 5, 2001 which is attached hereto as Attachment "A" and hereby made a part of this AGREEMENT, and hereafter referred to as "project". (2.) PRINCIPAL INVESTIGATOR The project shall be under the supervision of Dr Shishir R Raval, from the Department of Landscape Architecture who shall serve as Principal Investigator. If for any reason the Principal Investigator shall be unable to continue to serve, and a successor acceptable to both parties is not available, this AGREEMENT shall be terminated as hereafter provided. (3.) PERIOD OF PERFORMANCE The activities of this project shall be conducted during the period beginning March 9, 2001 through August 31, 2001. This period will be subject to modification or renewal only by mutual written agreement of the parties hereto. (4.) PAYMENT OF COSTS In consideration of the UNIVERSITY'S performance hereunder, SPONSOR agrees to support the UNIVERSITY'S costs incurred conducting the activities as stated in Attachment "A", in the amount of $7,000. This is a fixed price contract. Full payment will be made by the SPONSOR within thirty (30) days of the execution of this Agreement. (5.) Inventions made jointly by UNIVERSITY personnel and SPONSOR personnel shall be owned jointly. UNIVERSITY hereby grants to SPONSOR an option to negotiate for a royalty -bearing, exclusive license to any invention in which UNIVERSITY has ownership rights under this paragraph, provided the SPONSOR must exercise its option by notice in writing within two (2) months following the disclosure of the invention to the SPONSOR by UNIVERSITY. (6.b.) SOFTWARE Rights to software developed by UNIVERSITY personnel in connection with the project shall be owned by UNIVERSITY. Upon request by SPONSOR, UNIVERSITY agrees to provide SPONSOR with a nonexclusive, nontransferable, royalty -free license to reproduce, display, translate, distribute, and modify the software. (7.) PUBLICATIONS UNIVERSITY shall have the right to publish the results obtained from the project conducted hereunder. UNIVERSITY agrees to provide SPONSOR with a manuscript of any proposed presentation and/or publication at least thirty (30) days prior to submission thereof for presentation and/or publication. SPONSOR shall have thirty (30) days to review any such publication and to request a delay of up to thirty (30) additional days so that a patent application can be prepared or so that SPONSOR's proprietary information can be deleted from the publication. If SPONSOR does not respond with comments within thirty (30) days, UNIVERSITY shall be free to proceed with publication. (8.) WARRANTY UNIVERSITY MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AS TO ANY MATTER isWHATSOEVER, INCLUDING WITHOUT LIMITATION, THE OWNERSHIP, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OF ANY GOODS OR SERVICES PROVIDED. The UNIVERSITY makes no representation or warranty regarding the actual or potential infringement of patents or copyrights of third parties, and SPONSOR acknowledges that the avoidance of such infringement in the use of the services related to this AGREEMENT shall remain the responsibility of SPONSOR. (9.) TERMINATION Performance under this AGREEMENT may be terminated by either party upon sixty (60) days written notice. Upon termination by either party, UNIVERSITY will refund to Sponsor any costs and noncancelable commitments not already incurred in the performance of the program prior to the date of termination. (10.) LIABILITY The liability of the UNIVERSITY, as an agency of the State of North Carolina, for bodily injury, property damage, infringement of proprietary rights and patents, and other items is limited by the North Carolina Tort Claims Act, Article 31, sec. 143.291. The SPONSOR will indemnify and hold harmless UNIVERSITY, its trustees, officers, employees and agents from and against any liabilities, damages, or claims (including attorneys' fees).arising out of injuries (including death) or property damage suffered by any person as a result of SPONSOR's negligence or willful misconduct in the performance of this AGREEMENT or from SPONSOR's use or possession of the results produced hereunder. 171 (11.) HAZARDOUS MATERIALS All materials provided by SPONSOR must be accompanied by the appropriate environmental and safety information for those materials as required by law. ****SEE NOTES AND INSTRUCTIONS**** The responsibility for and costs of disposal of all SPONSOR provided materials remaining at the termination of the program will rest with the SPONSOR. SPONSOR shall arrange for disposal or removal of any remaining SPONSOR provided materials prior to receipt of any final report of the project. The UNIVERSITY may decline to accept projects that impose undue risk. UNIVERSITY will observe all applicable safety precautions and governmental requirements concerning handling of test materials. SPONSOR and UNIVERSITY acknowledge that the selection of.project procedures, sites, and equipment, and the assignment and supervision of personnel to be used in the conduct of project hereunder rest under the sole and exclusive direction of UNIVERSITY. • (12.) PROPRIETARY INFORMATION Any proprietary information disclosed by one party to the other, including invention disclosures made by UNIVERSITY to SPONSOR, shall be disclosed in writing and designated as proprietary, or if disclosed orally, shall be confirmed in writing and designated proprietary within thirty (30) days of such disclosure. A party receiving proprietary information hereunder, hereafter referred to as "RECIPIENT", agrees to use the proprietary information only for the purpose of this AGREEMENT and further agrees that it will not disclose or publish such information except that foregoing restrictions shall not apply to: (i) information which is or becomes publicly known through no fault of RECIPIENT; information learned from a third party entitled to disclose such information; (ii) information already known to or developed by RECIPIENT prior to receipt hereunder, as shown by RECIPIENT's prior written records; (iii) information which is published in the necessary course of the prosecution of patent applications based upon inventions developed pursuant to this AGREEMENT; or (iv) information required to be disclosed by operation of law or court order. The obligation of confidentiality imposed by this provision shall expire throe (3) years following the expiration or termination of this AGREEMENT. Each party will use a reasonable degree of care to prevent the inadvertent, accidental, unauthorized or mistaken disclosure or use by its employees of proprietary information disclosed hereunder. (13.) USE OF NAMES Neither party will use the name, marks, or symbols of.the other for any commercial purpose without the express written permission of the other party. (14.) CONSULTING In the event that the Principal Investigator and/or the SPONSOR shall seek a consulting arrangement with each other on the subject of this study during the period covered by this AGREEMENT, such arrangement shall be reported to the UNIVERSITY according to the Conflict of Interest and External Pay Policies of the UNIVERSITY. (19.) ENTIRE AGREEMENT Unless otherwise specified herein, this AGREEMENT embodies the entire understanding of the parties for this project and any prior or contemporaneous representations, either oral or written; are hereby superseded. No amendments or changes to this AGREEMENT including, without limitation, changes in the activities of the program, total estimated cost, and period of performance, shall be effective unless made in writing and signed by authorized representatives of both parties. If any provisions stated in this AGREEMENT, resulting purchase orders, and the project proposal are in conflict, the order of precedence, beginning with the first to last shall be (1) • this AGREEMENT with attachments, (2) the project proposal, and (3) the purchase order, it being understood and agreed that any purchase order or similar document issued by SPONSOR will be for the sole purpose of establishing a mechanism for payment of any sums due and owing hereunder. LEGALLY BINDING COMMITMENT NORTH CAROLINA HARNETT COUNTY HOUSING DEVELOPMENT AGREEMENT COUNTY OF HARNETT AND PINE GROVE DEVELOPMENT CORP. This Agreement is entered into by and between PINE GROVE • DEVELOPMENT CORP. (hereinafter referred to as the "Developer") and Harnett County, North Carolina (hereinafter referred to as the "County"), this /9"ay of `rviarr-h 2001. Said agreement replaces an agreement in its entirety dated April, 1999.This Agreement will not become effective until all conditions placed upon the County's funding approval by the North Carolina Department of Commerce (hereinafter "DOC") are satisfied and funds are released by the DOC pursuant to a Community Development Block Grant (hereinafter "CDBG") with said County. WITNESSETH WHEREAS, the County has applied for and received a $181,010 Community Development Block Grant from DOC to be used particularly to benefit low and moderate income persons by financing public infrastructure that will reduce development costs resulting in affordable housing for low and moderate income home buyers in the County; and WHEREAS, the Developer wishes to obtain the benefit of Community Development funding to reduce housing development costs for the purpose of constructing and selling new homes that are affordable to low and moderate income home buyers; NOW, THEREFORE, in consideration of the promises and the mutual covenants set forth below, the County and the Developer hereby agree as follows: I. AGREED ACTION A. The County will assist with the design and or construction construct public • infrastructure including the provision of water, sewer (including lift station) and streets within the twenty (20) unit single family housing development, as well as a sewer main to the Carolina Lakes disposal plant. It is understood by the parties that the North Carolina Division of Environment and Natural Resources (hereinafter N.C.DENR) determines the capacity available in the Carolina Lakes disposal plant and that before any capacity in the plant can be released for use, it must be approved.by the State of North Carolina. B. The County, in consideration of the Developer's participation in this project will waive any and all capacity use fees applicable to the twenty unit single family development. C. The Developer agrees to plan, finance, and construct twenty houses on lots in the project having the minimum range between 1,147 sq. feet to 2,052 sq. feet with an initial selling price between $67,900 and $100,176. Costs may increase due to construction increases, income and mortgage rate changes. D. Developer shall execute its responsibilities as identified in the narrative exhibits contained in its application to DOC in connection with the twenty unit single family development. Those exhibits and commitments set forth in the application are incorporated herein by reference as if set out in full. E. The Developer commits to work with the County and Lenders to insure that at least one of the fifteen houses to be sold to either low or moderate income home buyers is purchased by a low income buyer using DOC Division of Community • Assistance low and moderate income limits. F. This Development Agreement constitutes a legally enforceable contract and shall be governed by and construed in accordance with the laws of the State of North Carolina. G. Harnett County as a condition of the Developer's involvement in this project further agrees that the extensions of sewer facilities to the project and in accordance with this agreement shall not place any obligation on the part of Pine Grove Development Corp. to extend sewer mains and/or utilize County sewage facilities in any other lands which Developer now owns or may be after acquired in said area of the lines.
