Wanda Gregory, Angier, invited the Commissioners to the Town of Angier's 100t' Anniversary Celebration. 3, Douglas Amour, Hilliard Subdivision near Fuquay-Varina, encouraged the Board to adopt an Intensive Livestock Operations Ordinance. Chairman Byrd nominated all appointments listed below with exception of • Commissioner Titchener nominating W.N. Porter for the Lee -Harnett Mental Health Board. Commissioner Titchener moved to close the nominations and to approve all the appointments listed below. Commissioner Andrews seconded the motion and it passed unanimously. Hill, County Commissioner Tony Wilder, Assistant County Manager • Jerry Blanchard, General Services Manager (at large member) Public hearing Chairman Byrd called to order a public hearing on the Harnett County/Fuquay-Varina F.V. 201 Facilities 201 Facilities Plan for the Regional Wastewater Project. Hiram Marziano, Marziano Plan & Minier Engineers, presented findings of the plan. Chairman Byrd opened the meeting for comments from the public. Mr. Wilton Lee, Anderson Creek area, requested sewer in his community. There being no further business, Chairman Byrd closed the public hearing. Neil Emory, County Manager, noted that the Board tabled a proposed amendment to Zoning ord. Amend. the Zoning Ordinance at the October 16, 2000 and again at the November 20, 2000 1_ 2 1 Farm Exemptions Board meeting. The proposed change is related to farm exemptions. Commissioner McNeill moved to bring the matter off the table. Commissioner Andrews seconded the motion and it passed unanimously. Mr. Emory presented the proposed amendment to the Board for consideration. Commissioner Hill moved to adopt the amendment as presented. Commissioner McNeill seconded the motion and it passed unanimously. (Attachment 11 and in Ordinance Book 2) • Departmental reports were filed with the Board from the Sheriffs Department, Health Department, Board of Elections, Veterans Service, Housing, Department of Social Services, General Services, and Tax Attorney. (Attachment 12) Fire Education Mr. Emory noted that Harnett's fire education program recently won two Outstanding Awards County awards from the North Carolina Association of County Commissioners. Deputy Fire Marshal Beverly Williams will be presented the awards at a future meeting. Commissioner McNeill moved that the Board go into closed session for the following Closed Session purposes: 1) To consider and discuss a personnel matter; 2) To consider and give instructions to the County staff and County attorney concerning the handling or settlement of certain claims including Godwin vs. Faircloth and Harnett County Harnett County File No. 00 CvS 01014 Kincheloe vs. Harnett County Harnett County File No. 96 CvS 508 This motion is made pursuant to N.C. General Statute 143-318.11(a)(6)&(3). Commissioner Andrews seconded the motion and it passed unanimously. • Commissioner Hill moved to come out of closed session. Commissioner McNeill seconded the motion and it passed unanimously. Commissioner McNeill moved to amend the closed session motion to include a) To discuss matters relating to the location or expansion of industries or other businesses in Harnett County; b) To consider and give instructions to the County staff concerning the material terms of the proposed purchase of real property. This amendment motion is made pursuant to N.C. General Statute Section 143- 318.11(a)(4)&(5). Commissioner Hill seconded the motion and it passed unanimously. The Governing Body does hereby find and determine as follows: (a) The State of North Carolina (the "State"), pursuant to the Clean Water and Natural Gas Critical Needs Bond Act of 1998, being Chapter 132 of the 1998 Sessions Laws, as amended (the "Act"), has authorized the issuance by the State of Clean Water Bonds for the. purpose of making loans to local government units for the purpose of paying all or a portion of the cost of water supply systems, water conservation projects, wastewater collection systems and wastewater treatment works. (b) The Borrower has determined to borrow moneys from the State under the Clean Water Bond Loan Program established pursuant to the Act for the purpose of providing funds, together with any other available funds, to pay the costs of certain clean water bond projects as more particularly described in the Agreement hereinafter mentioned (the "Project"). (c) Pursuant to the Act, the Borrower has made application to the Department of Environment and Natural Resources for approval of a clean water bond loan to finance the Project and has received a loan commitment in the principal amount of $ [insert loan offer amount] to finance such capital improvements. (d) The North Carolina Local Government Commission has approved the loan in an amount not to exceed such principal amount in accordance with the provisions of the Act. • (e) There has been presented to the Governing Body at this meeting forms of the following: (1) Loan Offer from the State containing various assurances required by the State in connection with the loan and the Project; and (2) Loan Agreement (the "Agreement") between the Borrower and the State, together with a form of the promissory note of the Borrower attached as Exhibit A thereto (the "Note"), evidencing the obligation of the Borrower to repay the loan from the State. (f) The Borrower has determined that the borrowing from the State in the manner provided in this Resolution and the Agreement is in the best interest of the Borrower. Section 2. Capitalized terms used in this Resolution and not otherwise defined herein shall have the same meanings given such terms in the Agreement. Section 3. The Borrower hereby accepts the Loan Offer from the State, including all the assurances associated therewith. Section 4. Pursuant to the provisions of Act, the Borrower hereby authorizes the borrowing of a principal amount not to exceed $ [insert loan offer amount] from the State under the State Clean Water Bond Loan Program. The terms and provisions of the borrowing shall be as set forth in the Agreement and the Note, subject to the provisions of this Resolution. Section 5. The interest rate on the Note shall be determined as set out in the Schedule of Terms and the latest installment of principal on the Note shall not exceed May 1, • 2020. Section 6. The proceeds of the loan shall be applied to pay the costs of the Project as provided in Section 2.03 of the Agreement. Section 7. Except as provided in Section 8, the Note shall be secured solely by the Net Revenues and any Designated Non -Tax Revenues as provided in the Agreement, and the Borrower shall pledge the Net Revenues and the Designated Non -Tax Revenues for the payment of the principal of and interest on the Note in the manner set forth in the Agreement. The principal of and interest on the Note shall not be secured by the general funds of the Borrower nor shall the Note constitute a legal or equitable pledge, charge, lien or encumbrance upon any of the property or upon any of the income, receipts or revenues of the Borrower, except the Net Revenues, the Designated Non -Tax Revenues and any other moneys and securities pledged under this Resolution, the Agreement and the Note. Neither the credit nor the taxing power of the Borrower are pledged for the payment of the principal of or interest on the Note, and the State shall not have the right to compel the exercise of the taxing power by the State of North Carolina or the Borrower or the forfeiture of any of their property in connection with any default with respect to the Note or this Agreement. 130 Section 8. The Borrower authorizes the State to include in the Agreement provisions authorizing the State to withhold from the Borrower any State funds that would otherwise have been distributed to the Borrower in accordance with North Carolina law in amount sufficient to pay all sums than due and payable to the State as a repayment of the loan; provided, however, that such funds shall not be withheld if (a) prior to the execution of the Agreement and the Note, such funds have been pledged to secure special obligation bonds or other obligations of the Borrower or (b) after execution of the Agreement and the Note, such funds are legally pledged to secure special obligation bonds or other obligations of the Borrower. Section 9. The forms, terms and provisions of the Loan Offer, the Agreement and the Note are hereby approved, and the , the and the are hereby authorized and directed to execute and deliver the Loan Offer, the Agreement and the Note in substantially the forms presented, together with such insertions, modifications and deletions as they may deem necessary and appropriate, and to take such other action and to execute and deliver such other certificates, agreements, instruments or other documents as they, with the advice of counsel, may deem necessary or appropriate to effect the transactions contemplated by this Resolution, the Loan Offer, the Agreement or the Note. The officers, agents and employees of the Borrower are hereby authorized and directed to do all acts and things required of them by the provisions of this Resolution, the Loan Offer, the Agreement and the Note for the full, punctual and complete performance of the terms, covenants, provisions and agreements of the same. RESOLUTION • WHEREAS, Lee -Harnett Area Mental Health, Developmental Disabilities and Substance Abuse Authority (under this and former names given to this organization hereinafter referred to as Area Program) has provided quality mental health, developmental disability and substance abuse services to the citizens of Harnett County since February 5, 1988; and WHEREAS, the Area Program's administration has been responsive and accountable to the Board of Commissioners and citizens of this County; and WHEREAS, the current Area Program has provided stable and responsible administration of its programs; and WHEREAS, the Area Program was recently recognized by the Council of Accreditation for Children and Family Services as meeting national accreditation standards and as being one of the outstanding programs in the State; and WHEREAS, the current arrangements have proved to be satisfactory to the Board of Commissioners and the citizens of this county. NOW, THEREFORE BE IT RESOLVED by the Hamett County Board of Commissioners that: Section 1. The continued provision of services under the current Area Program is satisfactory and should be maintained. Harnett County Economic Development Incentive Grant Program The EDI Grant involves a contractual agreement between the county and a new or existing business/industry that would allow for a financial incentive grant based upon the actual value, schedule and payment of county property taxes for a period of up to seven years. The county will require the business/ industry to pay in full annually total property taxes due. If the business/ industry has met specific criteria as outlined in a formal agreement, a portion of the property tax paid by that business/industry to the county for up to seven consecutive tax years would be returned to the business/development incentive grant. The terms of the grant will be based on the amount of investment. Attachment 11, HARNETT COUNTY, NORTH CAROLINA A RESOLUTION AMENDING THE HARNETT COUNTY ZONING ORDINANCE TEXT WHEREAS, the Board of Commissioners of Harnett County adopted a Zoning Ordinance on July • 18, 1988 and June 5, 2000 for the purpose of promoting the health, safety, and general welfare of the county residents; and WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North Carolina, particularly G.S. 153A-340; and WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those provisions have been followed; and WHEREAS, the Harnett County Planning Board has reviewed the amendment to Article III and Article XV of the Zoning Ordinance and recommends the adoption of the following amendment. NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT COUNTY, NORTH CAROLINA that Article III and Article XV of the Zoning Ordinance be amended by deleting Article III and Article XV, definition of bona -fide farm and adding the new text as follows: Article III Exemption of Bona Fide Farms The provisions of this Ordinance shall not apply to bona fide farms (as defined in Article XV). This Ordinance does not exercise any controls over cropland, timberland or other farmlands. Nor does it exercise control over any barn or other farm buildings, including houses for persons working on said farms and their families, as long as such houses shall be in same ownership as the farm and located on the farm and shall not exceed four (4) residences. All buildings, including residences, shall meet the following setbacks: distance of structure from front property line or street right-of-way (whichever is greater) thirty-five (35) feet; distance of structure from side property lines, ten (10) feet, except on corner lots which shall require twenty (20) feet; distance of structure from rear property lines, twenty- five (25) feet; and distance of structure from any other structure, ten (10) feet. The use of any bona fide farm property for any non -farm purposes shall be subject to the regulations • of this Ordinance. Article XV Definitions Bona Fide Farm Bona fide farm purposes include the production and activities relating or incidental to the production of crops, fruits, vegetables, ornamental and flowering plants, dairy, livestock, poultry and all other forms of agricultural products having a domestic or foreign market. Bona fide farm purposes also include processing for personal consumption or commercial sale or distribution of any and all crops, fruits, vegetables, ornamental and flowering plants, dairy, livestock, poultry, and all other forms of agricultural products, provided that a farm serial number issued by the United States Department of Agriculture (U.S.D.A.) Harnett County Farm Service Agency has been obtained and so long as all such agricultural products are grown or produced on lands which are owned solely by or leased exclusively to and are harvested by the person processing such agricultural products.
