Minutes of Regular Meeting
July 17, 2000
The Harnett County Board of Commissioners met in regular session on Monday, July
17, 2000, in the County Administration Building, 102 East Front Street, Lillington,
North Carolina.
Members present: Beatrice Bailey Hill, Vice Chair
Joseph T. Bowden
Walt Titchener
Chairman Dan B. Andrews and Commissioner Teddy J. Byrd were absent.

Vice Chair Hill called the meeting to order at 7 p.m. and Commissioner Bowden led
the pledge of allegiance and prayer.
Commissioner Titchener moved to approve the agenda as published with additional
budget amendments added to the consent agenda. Commissioner Bowden seconded
the motion and it passed unanimously.
Upon motion by Commissioner Bowden and seconded by Commissioner Titchener,
the Board unanimously approved the following items on the consent agenda:

Public utilities 11. Award of Public Utilities materials and supplies contract to Pipeline Supply
Materials & Supplies Company of Sanford, NC, which was low bidder with a bid of $89,088.68. Other
Contract bids received were: TEC Utilities Supply, Inc. of Garner, NC - $89,752.02 and
US Filter of Raleigh, NC - $102,012.51.
Rev. Joe Smith, Sr., Riverside, expressed concerns with standing water in his
community.
Al Bain, Public Utilities Attorney, presented for the Board's consideration, a
•Riverside w & S resolution that is required prior to sale of bonds for the Riverside Water & Sewer
Bonds District project. Commissioner Titchener moved for adoption of the resolution.
Commissioner Bowden seconded the motion and it passed unanimously.

Proposed amend. George Jackson, Planning Director, presented for the Board's consideration, a
to Zoning Ord. proposed amendment to the Zoning Ordinance which would permit the completion of
minor and major mobile home subdivisions that had infrastructure in place prior to
June 5, 2000. Commissioner Bowden moved to adopt the amendment. Commissioner
Titchener seconded the motion and it passed unanimously. (Attachment 4)
Vice Chair Hill called to order a public hearing on an application for a text amendment
Zoning Ordto the Zoning Ordinance for Gospel Light Baptist Church, Hwy. 24, Cameron, NC.
Proposed Amend. Lori Tomaszewski, Chief Planner, presented the request to the Board. Vice Chair Hill
Gospel Light Ch. opened the meeting for comments from the public. Rev. Grayson McNeill, applicant,
requested that churches be exempt from the section of the Zoning Ordinance that
prohibits travel trailers being parked or stored in rear or side yard of any lot. There
being no further comments, Vice Chair Hill closed the public hearing. The Planning
Board recommended denial of the request. Commissioner Titchener moved that the
Board take no action at this time but refer the matter back to the Planning Board; and
for the staff to ensure that Rev. McNeill knows at which Planning Board meeting it
will be reconsidered. Commissioner Bowden seconded the motion and it passed
is
unanimously.
Vice Chair Hill called to order a public hearing on an application for a text amendment
Zoning Ordto the Zoning Ordinance for Devon McDonald, Erwin Chapel Road, Erwin. Lori
Proposed Amend. Tomaszewski, Chief Planner, presented the request to the Board. Vice Chair Hill
Devon McDonald opened the meeting for comments from the public. Devon McDonald, applicant,
requested an amendment to the section addressing outdoor display, storage, or sale of
vehicles and other equipment. Brian Whittington, Clayhole Road, Dunn, also
provided comments. There being no further comments, Vice Chair Hill closed the
public hearing. Commissioner Bowden made a motion to table the matter until the
next Board meeting. Commissioner Titchener seconded the motion and it passed
unanimously.
Vice Chair Hill recognized and welcomed Rep. Don Davis to the meeting.
Vice Chair Hill called to order a public hearing on proposed amendments to the
Proposed Amend. Subdivision Regs. Harnett County Subdivision Regulations. George Jackson, Planning Director,
reviewed the proposed amendments in each section. Vice Chair Hill opened the
meeting for comments from the public. No comments were offered and Vice Chair
Hill closed the public hearing. The proposed amendments will be reviewed and
discussed by the Board in a workshop prior to consideration at a future meeting.
• Departmental reports were filed with the Board from Veteran's Affairs, Environmental
Health, Economic Development, Housing, and Emergency Medical Service.
There being no further business, Commissioner Titchener moved for adjournment.
Commissioner Bowden seconded the motion and it passed unanimously.

RESOLUTION
M. T. Phefts
Whereas, Mr. M.T. Phelts of Lillington will celebrate his 100s' birthday on August 9,
2000; and
Whereas, as a resident of both the Town and Harnett County since 1933, Mr. Phelts has
served as a model citizen of the community; and
Whereas, his commitment to his family is evident when one considers his dedication to
his wife Allene and his children Mary Ann, Rick, and Emily; and
Whereas, his commitment to his community is evident through his commitment to his
former employers, Rickman Brick Company, Womble's General Store, and O'Quinn's
Men Store, as well as his long-standing support of community projects and of local
athletes through the Lillington High School Boosters; and
Whereas, Mr. Phelts has long been known in the community as one who loved the
outdoors and the opportunity to enjoy nature through hunting and conservation efforts.
Now, Therefore, Be It Resolved That the Harnett County Board of Commissioners does
hereby recognize and congratulate Mr. M.T. Phelts on this his 1008i birthday.

EXTRACTS FROM MINUTES OF BOARD OF COMMISSIONERS OF
HARNETT COUNTY, SITTING AS THE GOVERNING BODY OF
RIVERSIDE WATER AND SEWER DISTRICT OF HARNETT COUNTY
The Board of Commissioners of the County of Harnett, sitting as the
governing body of the Riverside Water & Sewer District of Harnett County,
convened in a special setting during its meeting held on July 17, 2000 at
7:00 p.m. in the Harnett County Office Building, 102 East Front Street,
Lillington, North Carolina.
Board members present were: Walt Titchener, Beatrice Bailey Hill
and Joseph T. Bowden. Members absent were Dan+,B. Andrews and Teddy Byrd.
Commissioner Titchener
presented the
following resolution and moved that it be adopted:
WHEREAS, the bond order hereinafter described has taken
effect and the Board of Commissioners of the County of Harnett,
sitting as the governing body of Riverside Water and Sewer
District of Harnett County (the "Issuer"), desires to borrow
money for the purpose for which bonds are authorized to be issued
by said bond order in anticipation of the receipt of the proceeds
of the sale of said bonds as hereinafter provided; NOW,
THEREFORE,
BE IT RESOLVED by the Board of Commissioners of the
County of Harnett, sitting as the governing body of the Issuer,
as follows:
(1) The sum of $1,194,000 will be borrowed by the
Issuer in anticipation of the receipt of a $1,194,000 portion of
the proceeds of the sale of bonds authorized to be issued by the
water bond order, adopted by the Board of Commissioners of the
County of Harnett, sitting as the governing body of the Issuer,
on October 21, 1996, for the purpose for which said bonds are
authorized to be issued. Negotiable notes, each designated "Water
Bond Anticipation Note,." shall be issued for said sum so
borrowed.
(2) Said notes shall be dated August 1, 2000, shall be
payable April 25, 2001 and shall bear interest from their date at
a rate which shall not exceed seven per centum (7%) per annum.
Such interest shall be payable at the maturity of the said notes.
Each of said notes shall be signed by the Chairman of the
governing body of the Issuer and the Clerk of the Issuer and the
seal of the Issuer shall be affixed to each of said notes..
(3) The power to fix the rate of interest to be borne
by said notes and to determine the denomination or denominations
of the notes and the place of payment of the notes is hereby
delegated to the Chairman of the governing body of the Issuer and
Clerk of the Issuer who are hereby authorized and directed to

cause said notes to be prepared and to execute said notes when
they shall have been sold by the Local Government Commission of
North Carolina.
(4) The Chairman of the governing body of the Issuer
and Clerk of the Issuer are hereby authorized to make application
to the Local Government Commission of North Carolina for its
approval of said notes in the manner prescribed by The Local
Government Finance Act. Said Local Government Commission is

hereby requested to sell the notes in the manner prescribed by
said Act. Said notes, when they shall have been sold by said
Commission in the manner provided by law and when they shall have
been executed in the manner prescribed by this resolution, shall
be turned over to the State Treasurer of the State of North
Carolina for delivery to the purchasers to whom they may be sold
by said Commission.
(5) The Issuer covenants to do and perform all acts
and things permitted by law necessary to assure that interest
paid on the notes be and remain excluded from gross income of the
owners thereof for federal income tax purposes.
(6) The Issuer hereby represents that (i) the proposed
notes are not private activity bonds as defined in the Internal
Revenue Code of 1986, as amended (the "Code") and (ii) the
Issuer, together with any subordinate entities or any entities
which issue obligations on behalf of the Issuer, reasonably

expects that it will not issue in the aggregate more than
$10,000,000 tax-exempt obligations (other than private activity
bonds except qualified 501(C)(3) bonds) during the current
calendar year. In addition, the Issuer hereby designates the
above -mentioned notes as "qualified tax-exempt obligations" for
the purposes of section 265(b)(3) of the Code.
(7) The power to make any election on behalf of the
Issuer with respect to the arbitrage rebate provisions of the
Code applicable to the notes is hereby delegated to the Chairman
of the governing body and Finance Officer of the Issuer.

A RESOLUTION AMENDING THE HARNETT COUNTY ZONING ORDINANCE TEXT
WHEREAS, the Board of Commissioners of Harnett County adopted a Zoning Ordinance on July 18, 1988
for the purpose of promoting the health, safety, and general welfare of the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of
North Carolina, particularly G.S. 153A-340; and
WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those provisions
have been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to Article IV, Sections 2.0,
2.2 of the Harnett County Zoning Ordinance and recommends the adoption of the following amendment
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT
COUNTY, NORTH CAROLINA that Article IV, Sections 2.0, 2.2 of the Zoning Ordinance be amended by
adding a second paragraph with the new text as follows:

If a minor subdivision has been approved and improvements completed (Le. streets, water and/or
sewer) or a major subdivision has been approved and a multi -section manuf icuued home has been
permitted and occupied on one or more lots in the subdivision prior to June 5, 2000, then the
owner of a lot in any such subdivision may place a multi -section manufactured home on any other
lot in the subdivision for residential purposes, provided all requirements of the ordinance are met
regarding Rant, side and rear yard setbacks and provided the water and sewage disposal systems
have been approved by the Harnett Oxmty Health Department
