The Harnett County Board of Commissioners met in regular session on Monday, May
• 1, 2000 in the County Administration Building, 102 East Front Street, Lillington,
North Carolina.

Chairman Andrews called the meeting to order at 9 a.m. and Commissioner Byrd led
the pledge of allegiance and prayer.
Commissioner Bowden moved to approve the agenda as published with the following
additions to the consent agenda: - Budget Amendments

Commissioner Byrd seconded the motion and it passed unanimously.
Upon motion by Commissioner Bowden and seconded by Commissioner Hill, the

Informal comments were provided by the following citizens:
1. Maylon McKoy, Anderson Creek area, regarding fire tax rate
2. Wilton Lee, Rolling Springs area, regarding need for sewer system
Commissioner Titchener made a motion to appoint Mike Parham to the Harnett 40
County Revolving Loan Fund Committee. Commissioner Byrd seconded the motion
and it passed unanimously.
Rudy Brown, Angier, addressed the Board regarding Internet Service Providers. The
INTERNET SERVICE Board directed Paula Stewart, MIS Director, to meet with Mr. Brown to explore
PROVIDERS options concerning internet service and for Ms. Stewart to report her findings to the
Board.
SHAWTOWN REHAB. Chairman Andrews called to order a public hearing on the Shawtown Infrastructure
PROJECT project. Patricia H. Crissman, The Wooten Company, provided background
information on the infrastructure grant. Chairman Andrews opened the meeting for
comments from the public. No comments were offered and Chairman Andrews closed
the public hearing. The Board scheduled a required second public hearing for May 15,
2000.
Chairman Andrews called to order a public hearing on the proposed FY 2000-2001
FY2000-2001 DOT Department of Transportation Secondary Roads Improvement Program. Ray Stone,
ROAD IMPROVEMENT District Engineer, presented an overview of the proposed Roads Improvement
PROGRAM Program and stated that the purpose of the public hearing was to obtain public
comments concerning the proposed program. Board members provided comments
regarding the following roads:
1. SR 1164, Poplar Drive
2. Long Leaf Drive
3. Tom Myers Road
4. Hwy. 210, V4 mile south of Valley Road — dangerous area near hardware
store, and Hwy. 210 and 27, 2 miles south of Lillington
5. Pope Road, Dunn
6. Buttonwood Court
Chairman Andrews opened the meeting for comments from the public.
1. Maylon McKoy, Anderson Creek area, asked who was responsible for
picking up full trash bags after citizens pick up trash on roadsides.
2. Mike Cagle asked when Roberts Road would be paved.
There being no further comments, Chairman Andrews closed the public hearing.
Commissioner Bowden moved to adopt a resolution approving the FY 2000-2001
Secondary Road Construction program for Harnett County as presented.
Commissioner Hill seconded the motion and it passed unanimously. (Attachment 6)
Departmental reports were filed with the Board from the Department of Social
Services and the Health Department.
REQUEST FOR PLANNING In the County Manager's report, Mr. Emory discussed staff recommendations for an
BOARD'S RECOMMENDATION amendment to uses permitted in RA-30 Zoning District. Commissioner Bowden ma
ON AMEND. TO ZONING a motion to ask the Planning Board for a recommendation regarding the issue prior t
the Board of Commissioners regular meeting, May 15t'.
Commissioner Byrd moved for the Board to go into closed session for the following
purposes:
1) To consider and discuss a personnel matter;
2) To instruct the county staff concerning the position to be taken on
a proposed contract for the sale of real estate;
3) To give instruction to the County Attorney concerning the handling
of an administrative procedure matter and claim resolution.
This motion is made pursuant to N.C. General Statute Section 143-318.11
(a)(3)(5)&(6). Commissioner Bowden seconded the motion and it passed
unanimously.

Commissioner Hill moved for the Board to come out of closed session. Commissioner
Titchener seconded the motion and it passed unanimously.
There being no further business, Commissioner Byrd moved for adjournment.
ADJOURNMENT Commissioner Bowden seconded the motion and it passed unanimously. The Harnett
County Board of Commissioners regular meeting May 1, 2000, duly adjourned at
10:45 a.m.

RESOLUTION AUTHORIZING DISPOSAL OF PERSONAL PROPERTY BY
PRIVATE SALE
WHEREAS, the Harnett County Department of Public Utilities has a number of
water meters that are either not serviceable due to their age or are not able to be repaired;
and
WHEREAS, these water meters have little or no marketable value, and in no event
does the personal property have a value of $30,000.00 or more; and
WHEREAS, the Harnett County Department of Public Utilities is having to store
these old and non -serviceable meters; and
WHEREAS, it is desirable for this Board to authorize the disposal of this property
by private sale at a negotiated price pursuant to the procedures outlined in North Carolina
General Statutes §153A-176, 160A-266, and 160A-267;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the
County of Harnett that:
1. The Assistant Director of the Harnett County Department of Public Utilities
is hereby authorized to dispose of the aforementioned water meters that are not serviceable
due to age or condition by private sale at a negotiated price; and
2. The Assistant Director of the Harnett County Department of Public Utilities
is authorized to execute such documents and take such actions as are necessary to
implement the disposal of said property by private sale at a negotiated price.
Duly adopted this 1st of May, 2000, upon motion made by Commissioner
Bowden , seconded by Commissioner Hill and

RESOLUTON ON DELAYING CONGRESSIONAL ACTION ON
• INTERNET TAX MORATORIUM
WHEREAS, out-of-state remote sellers who conduct sales via the Internet, mail
order, and phone are not required by law to collect existing sales and use taxes imposed
by state and local governments; and
WHEREAS, the primary barrier to collecting taxes on remote sales is the
Supreme Court's ruling in Quill vs North Dakota which defers to Congress to authorize
states to require remote sellers to collect taxes in a manner that does not unduly burden
Interstate Commerce; and
WHEREAS, state and local governments are working together to implement a
streamlined sales tax system that would simplify definitions tax rates and tax bases and
use 2 1 " Century technology in the collection process; and
WHEREAS, current laws create a competitive disadvantage and great inequities
between merchants who sell from traditional "brick -and -mortar" establishments and
those who sell from electronic stores; and
WHEREAS, increasing sales on the Internet, and the resulting erosion of sales
and use tax revenues will limit the ability of states and governments and school districts
to finance essential public services such as police, fire, emergency medical service,
education, social services, infrastructure development, and healthcare; and
WHEREAS, a recent University of Tennessee study estimates that state sales tax
revenue losses in 2003 will exceed $10 billion; and
• WHEREAS, the Advisory Commission on Electronic Commerce failed to reach a
legally required consensus on fair and equitable treatment of both remote sellers and
"Main Street" retailers and also proposed that Congress preempt state and local
sovereignty guaranteed by the U.S. Constitution:
THEREFORE, BE IT RESOLVED that Harnett County supports simplification of
state and local sales taxes, and urges states to move expeditiously to develop and approve
model simplification legislation; and
BE IT FURTHER RESOLVED that Congress should not extend or expand the
current moratorium until its expiration in October 2001; and
BE IT FURTHER RESOLVED that if state and local governments choose to
negotiate a brief extension of the existing moratorium as part of a broader bill, such an
extension:
- Should only be effective for a short period of time (no more than two years);
and
- Must be linked to states' successfully implementing sales tax simplification,
which would trigger Congressional authorization of expanded duty to collect
use taxes on remote sales.

Generator Operational Indicators to be acquired for use by Harnett County;
WHEREAS, said bids were solicited pursuant to the General Statutes of the State of North
Carolina and all bid solicitation requirements have been complied with; and
WHEREAS, bids were received by the County of Harnett in response to such solicitation of
bids; and
WHEREAS, said bids were delivered to the Harnett County MIS Department, 201 West Front
Street, Lillington, N.C., and were opened, and read aloud at the Harnett County MIS Department
911 Conference Room at 9:00 am, April 20, 2000; and
WHEREAS, the County of Harnett has determined that Patrick and Burgess Electric, has
submitted the lowest responsive bid which meets the bid requirements
and that Patrick and Burgess Electric is the lowest responsible bidder, taking into consideration
quality, performance, service and other requirements specified by the bid solicitation process
conducted by the County of Harnett; and •
WHEREAS, the County of Harnett reserves the right to enter a contract for said services for up
to 90 days as it deems necessary according to the established contract prices by Global Energy
Corporation; and
WHEREAS, the Harnett County Board of Commissioners, meeting in regular session on
May 1,2000 has reviewed the proposals submitted and has concluded that the contract to provide
Generators and Automatic Transfer Switches for Harnett County should be awarded to Global
Energy Corporation
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners,
upon motion duly made, seconded and adopted, that the bid of Patrick and Burgess Electric, in
the maximum amount of TEN THOUSAND NINE HUNDRED EIGHTY-SEVEN
DOLLARS AND ZERO CENTS ($10,987.00). Harnett County reserves the right to appropriate

Dear Mr. Andrews: .
The Harnett County Black Leadership Caucus respectf idly submits, for the record, its opposition
to the Democratic Party's request that our commissioners prepare and submit the appropriate
request to change the present government structure by the addition of two at large seats for both
the board of commissioners and the school board. In addition, any redrawing of district or
precinct lines should increase and not diminish Black representation on either board.
Any effort to change the present mode of election should address some specific area of concern
relative to equal representation. No issue can be deduced to exist at this time. Both boards
currently have four white members. We have four white males on each five -member board and
one Black male on the school board and one Black female on the board of commissioners.
The addition of any at -large seats could only serve to diminish Black representation and voting
strength from its current twenty percent on each board affected by such it change. We further
submit that any at -large scats in Harnett County could properly be labeled white only,
Unless the Democratic Party believes that whites have too little representation on the boards or is
able to establish some other group without a proper share of political voice in government, no
additional seats deserve consideration.
• In conclusion, we believe, that the current Harnett County Board of Commissioners has done an
excellent job in representing the citizens of the county.
