The Harnett County Board of Commissioners met in regular session on Monday, January
3, 2000, in the County Administration Building,102 East Front Street, Lillington, North
Carolina.

Chairman Andrews called the meeting to order at 9:00 a.m. and Commissioner Titchener
led the pledge of allegiance and prayer.
Commissioner Hill moved to approve the agenda as published. Commissioner Bowden
seconded the motion and it passed unanimously.
Upon motion by Commissioner Byrd and seconded by Commissioner Bowden, the Board

15. Lease agreement with Joan Sexton Campbell for the County's use of a parking area

EAGLE SCOUTS 16. Two resolutions recognizing Eagle Scouts (Attachment 7)
TAX DEPT. GRANT - 17. Authorization for Tax Department to accept a grant entitled "Don't Duck Metadata"
"DON'T DUCK METADATA" in the amount of $1,700.00 for the GIS section.
INFORMAL COMMENTS Informal comments were provided by the following citizens:
l . Katherine Lowe, Coats, reported that a drug problem in her neighborhood has
improved and thanked the Board of Commissioners and the Sheriff's
Department.
2. Robert Shaver, Spring Lake, requested the Board's assistance to clean up and
maintain a historic cemetery in the Kipling area.
3. Wilton Lee, Rosebud St., Anderson Creek, requested that County sewer be
made available to citizens in the Rolling Springs community.
APPOINTMENTS Commissioner Titchener moved for the appointments listed below. Commissioner
Bowden seconded the motion and it passed unanimously.

Cemetery Committee
Commissioner Joseph T. Bowden
ZONING PETITION Ronald Thomas, 640 Stancil Road, Upper Little River Township, appeared before the
Board and informed the Commissioners that petition efforts continue in Upper Little
River Township requesting that the area be rezoned RA-30. Mr. Thomas presented a
map to the Board noting the area represented by the petition efforts.
RAY & KAREN Ray and Karen Moore, 905 Cool Springs Road, appeared before the Board and expressed
MOORE - ZONING their belief that those residents on the zoning petition for RA-20R, that was approved
• PETITION earlier by the Board (9/20/99), would prefer RA-30. Therefore, they requested that the
Board direct staff to consider rezoning of this property as soon as possible. Discussion
by the Board recognized that such action would prohibit development permitted under
RA-20R but not provided for under RA-30. It was noted that this action would delay
some on -going projects in the community involved. One such development is owned by
Mr. Mike Ray and wife, who were present and requested to address the Board. Chairman
Andrews asked the Board for a motion regarding this request. Commissioner Hill made a
motion to allow Mr. & Mrs. Ray to address the Board. Commissioner Titchener
seconded the motion and it passed unanimously. Mr. Ray informed the Board that he had
spent $280,000 and asked the Board to delay action that would prohibit further
development of his property. Lori Tomaszewski, Chief Planner, informed the Board that
Mr. Ray had met the requirements and obtained the necessary permits for his
development project. Mrs. Ray stated that citizens need to be educated on the difference
in RA-20R and RA-30. The Board of Commissioners took no action on the Moore's
request.
AIRPORT GRANT Wm. A. (Tony) Wilder, Assistant County Manager, presented to the Board the proposed
2001-2003 N. C. Department of Transportation Improvement Plan for the Harnett County
Airport. Commissioner Byrd moved to approve the Transportation Improvement Plan as
presented and to authorize the Assistant County Manager to sign appropriate documents.
Commissioner Titchener seconded the motion and it passed unanimously. Mr. Wilder
• also briefed the Board on a grant for the paving and lighting of the runway extension
project. Commissioner Titchener moved to accept the grant contingent on the County's
$35,000.00 match being an in -kind contribution. Commissioner Bowden seconded the
motion and it passed unanimously. The Board authorized Mr. Wilder to sign the form
stating the County's intention.
$10, 000 APPRO- Neil Emory, County Manager, reported to the Board that there is an interest in preserving
PRIATED TO abandoned cemeteries in the County. Following a review of the General Statutes
PRESERVE CEM. addressing the County's responsibility, Commissioner Titchener moved to appropriate
$10,000 for this purpose; and that the Cemetery Committee be responsible for allocating
these funds through a grant process, which would require final approval by the Board of
Commissioners. Commissioner Bowden seconded the motion and it passed unanimously.
The Cemetery Committee will develop guidelines to be considered by the Board to
establish the grant process, and will process grant applications for final approval by the
Board of Commissioners.
PUBLIC HEARING Neil Emory, County Manager, reported that staff has now finished land use/zoning public
SCHEDULED FOR hearings in each township that does not currently have zoning. He stated that staff is now
ZONING developing recommendations regarding this issue and will be submitting them to the
Board in the future. Mr. Emory asked the Board to schedule a formal public hearing in
February to be held in western Harnett County. Commissioner Titchener moved that the
public hearing be held on Thursday, February 17th with February 15th as an alternate date.
• Commissioner Byrd seconded the motion and it passed unanimously.
Departmental reports were filed with the Board from Veterans Service, Emergency
Medical Services, Fire Marshal/Emergency. Management, Economic Development,
Sheriff s Department, and Intra-Departmental Budget Amendments. (Attachment 9)
BD. OF EDUCATION Mr. Emory noted that Boards of Education are being asked to support changes in the
TAXES FOR EDUCA- State Statutes which would permit them to levy their own taxes for education. The North
TION Carolina School Board Association is promoting these proposed changes in state law.
The Harnett County Board of Education has not taken any steps to endorse this effort by
its state association. It is the Board of Commissioners' belief that this change is
unnecessary and unwarranted. Commissioner Titchener moved to direct the County
Manager to write a letter to our legislators stating our Board's opposition to this proposed
change. Commissioner Bowden seconded the motion and it passed unanimously.

MID -MONTH Commissioner Titchener moved to cancel the mid -month meeting in January.
MEETING CANCE19_'ommissioner Hill seconded the motion and it passed unanimously.
BOARD RETREAT The Commissioners scheduled a Board Retreat for January 26 h with January 25 h as an
SCHEDULED alternate date.
There being no further business, Commissioner Byrd moved for adjournment.
ADJOURNMENT Commissioner Bowden seconded the motion and it passed unanimously. The Harnett

Applicant Seeking Permission to Apply for CTP Funding,
Enter Into Agreement With The North Carolina Department Of Transportation
And to Provide the Necessary Assurances.

WHEREAS, Article 2B of Chapter 136 of the North Carolina General Statutes and the Governor of
North Carolina have designated the North Carolina Department of Transportation (NCDOT) as the
agency responsible for administering federal and state public transportation funds; and
WHEREAS, the North Carolina Department of Transportation will apply for a grant from the US
Department of Transportation, Federal Transit Administration and receives funds from the North Carolina
• General Assembly to provide assistance for rural public transportation projects; and
WHEREAS, the purpose of these transportation funds is to provide grant monies to local agencies
for the provision of rural public transportation services consistent with the policy requirements for
planning, community and agency involvement, service design, service alternatives, training and conference
participation, reporting and other requirements (drug and alcohol testing policy and program,
disadvantaged business enterprise program, and fully allocated costs analysis);
WHEREAS, (Applicant's Name) Harnett County hereby assures
and certifies that it will comply with the federal and state Statutes, regulations, executive orders,
Section 5333 (b) Warranty, and all administrative requirements which relates to the applications made
to and grants received from the Federal Transit Administration, as well as the provisions of Section 1001

ADOPTING A REQUEST FOR TRANSPORTATION GRANT FUNDING BY
THE FAYETTEVILLE AREA METROPOLITAN PLANNING ORGANIZATION
WHEREAS, the link between transportation and a sound economy can be traced
through time, and railroads are an important part of our region's integrated transportation
system; and
WHEREAS, a passenger/commuter rail corridor connecting Harnett County.
Cumberland County/Fayetteville and Wake County/Raleigh will be of benefit to our
County's citizens and our local economy; and
WHEREAS, a connection between our communities will provide our citizens an
entry point to the federally designated new High Speed Rail corridor.
NOW, THEREFORE, be it resolved that the Harnett County Board of
Commissioners endorses efforts to obtain a grant in the amount of $300,000.00 (three -
hundred thousand dollars) to conduct a feasibility study on a passenger/commuter rail
connector between Raleigh and Cumberland County/Fayetteville.

RESOLUTION
Attachment 4. REQUESTING EXTENSION OF FEMA AND SBA
APPLICATION DEADLINES
WHEREAS, eastern North Carolina has experienced the largest and most
significant natural disaster known in recorded history of the state - Hurricane Floyd; and
WHEREAS, Hurricane Floyd has damaged or destroyed over 17,000 homes
totaling over $400,000,000; and
WHEREAS, people with damages continue to apply for Federal Emergency
• Management Agency assistance; and
WHEREAS, people must also apply to the Small Business Administration for
loan assistance and eligibility determination for individual and family grants assistance;
and
WHEREAS, applications for Small Business Administration loans have been
lower than expected; and
WHEREAS, many persons have expressed confusion about the need to complete
a Small Business Administration loan or have indicated difficulty in completion of
paperwork;
NOW, THEREFORE BE IT RESOLVED that the Harnett County Board of
Commissioners requests the North Carolina Division of Emergency Management to seek
extensions of the application deadlines for individual Federal Emergency Management
Agency assistance and for Small Business Administration loans from December 14, 1999
to March 14, 2000.

THAT, WHEREAS, William Kenneth Sexton Jr., began his Harnett
County Law Enforcement career on 01-16-78; and
WHEREAS, after twenty years of distinguished service to
Harnett County, William Kenneth Sexton Jr. did retire; and
WHEREAS, North Carolina General Statute 20-187.2(a) provides
that the governing body of law enforcement agency may in its
discretion, award to a retiring member upon his/her request for

WASTEWATER SCADA IMPROVEMENTS
DESIGN PHASE
BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina,
sitting as the governing board for Harnett County.
Section I. This project will consist of the acquisition and installation of approximately 36
telemetry and SCADA system improvements at all existing wastewater treatment •
facilities. This project will allow HCDPU the ability to monitor existing conditions at
these sites as well as start and stop relevant equipment from a central location. These
improvements were necessitated by a mandate from the North Carolina Department of
Environment and Natural Resources, which required daily monitoring of all wastewater
lift stations to prevent the proliferation of spills caused by equipment failure.
Section II. The design portion of this project will be funded from the Harnett County
Department of Public Utilities' General Fund.
Section III. The following amounts are hereby appropriated for this project:
Engineering $35,000
Path Study $15,000
TOTAL $50,000
Section IV. It is estimated that the following revenues will be available for the design
phase:
Harnett County Public Utilities' General Fund Advance $50,000

PROFESSIONAL SERVICES AGREEbIENT
This Agreement by and between COUNTY OF HARNETT, NC, hereinafter
referred to as the Owner, and Marziano & Minier, P.A. of Asheboro, North
Carolina, hereinafter referred to as the Engineer.
WITNESSETH:
PROJECT: The Owner hereby contracts with the ENGINEER to perform the
following described services hereinafter collectively referred to as the PROJECT:
Develop plans and specifications and provide construction management
services for a telemetry and SCADA system for the County's wastewater
facilities.
ENGINEER'S COMPENSATION: The ENGINEER shall be paid for the
professional services on a lump sum basis not to exceed a fee of $35,000.00 for
the scope of this agreement.
Invoices will be submitted monthly for the project. The invoice is due and •
payable within 30 days of the invoice date. Should additional services be
requested beyond the Scope of Work, the rates on the attached Rate Schedule
will be used and include expected expenses and mileage and other normal, out
of pocket expenses. No additional work will be performed without written
authorization from the Owner.
OWNER'S AGENT: The OWNER has appointed the Director of Public Utilities,
Rodney Tart as the official AGENT of the Owner, for the purpose of the project.
GENERAL TERMS AND CONDITIONS: The Engineer will provide workmen's
compensation and general liability insurance for his employees working on this
PROJECT.
Any project performed under this contract may be canceled by the OWNER
upon 10 days written notice to the ENGINEER. The ENGINEER will then forward
a final invoice to the OWNER for payment.

SPECIAL CONDITIONS: The engineering fee includes costs associated with
printing of the construction documents. However, the engineering fee does not
include cost of any permit fees that may be required by regulatory agencies for
any part of this work.
The ENGINEER will begin work after he receives a signed Agreement and written
"Notice to Proceed" from the OWNER.
The plans and specifications prepared under this agreement will be complete
and ready for submittal to the regulatory agencies within 90 working days from
the date of the Notice to Proceed.
ADDITIONAL SERVICES: During the performance of the services in connection
• with this PROJECT, the OWNER may from time to time request additional
services. The ENGINEER shall be computed for such additional services on a
per diem basis. The rates shown under HOURLY RATE SCHEDULE of this
Agreement will be used to calculate any additional services. No additional
services will be performed without first receiving written approval from the
OWNER.

SCOPE OF WORK
The following scope of work describes technical services to be provided by
Marziano & Minier, PA (the Engineer) for the wastewater telemetry system:
I. The Engineer will provide necessary field surveys to acquire the
horizontal and vertical data as may be required to design the project.
2. The Engineer will prepare detail drawings, specifications and contract
documents suitable for procuring regulatory approval and receiving
proposals for the wastewater telemetry system.
3. The Engineer will provide required copies of plans and specifications
in the format desired by the Owner (either vellum or AutoCadd disks)
and assist in acquiring regulatory approval as may be required
(permit fees are not included).
4. The Engineer will prepare complete bid package and advertise project
throughout the construction industry according to law. The Engineer
will attend the bid opening and receive bids and review bids for
accuracy and completeness. Engineer will prepare a Discussion of
Bids and Certified Bid Tabulation along with recommendation of
award.
• S. The Engineer will prepare all required contract documents following
award of the contract and submit for review and subsequent
execution of parties of each contract.
6. The Engineer will provide construction observation services as
required (min. twice monthly) to secure a properly constructed
project. The Engineer will also review and approve shop drawings,
prepare and issue necessary change orders.
7. The Engineer will conduct a pre -construction conference with
representatives of the Owner and the Contractor in attendance.
8. The Engineer at completion of construction will arrange and conduct
a final inspection in the presence of the Owner and Contractor(s).
The Engineer will approve the Final Payment Request. The Engineer
will also prepare all required record drawings and furnish copies to
the Owner along with a Certification of Completion.
