The Harnett County Board of Commissioners met in regular session on Monday,
November 1, 1999, in the County Administration Building, 102 East Front Street,
Lillington, North Carolina.
Members present: Dan B. Andrews, Chairman .

Chairman Andrews called the meeting to order at 9:00 a.m. and Commissioner Byrd
led the pledge of allegiance and prayer.
Commissioner Titchener moved to approve the agenda as published with additions to
the consent agenda as listed below. Commissioner Bowden seconded the motion and
it passed unanimously.
Add to consent agenda: - budget amendments

- change order for airport water project
Upon motion by Commissioner Byrd and seconded by Commissioner Hill, the Board .

PUBLIC HEARING 8. Public hearing scheduled regarding the financing of the purchase of Rolling
Springs Water and Sewer System assets. The public hearing is scheduled to be
ROLLING SPRINGS held at the Board's regular meeting, November 15, 1999.
. PERSONNEL 9. Personnel Items:
A. Reclassification of Director of Public Utilities from Grade 82 to Grade 84.
This reclassification is effective November 1, 1999. The Board also
authorized a vehicle allowance of $500.00 per month for the Director of
Public Utilities.
B. Reclassification of Administrative Technician in Finance Office from
Grade 65 to Grade 68. This reclassification is effective November 1, 1999.
C. Authorization to adjust three Social Worker II position salaries in
CAP/Department on Aging 2.5% to correct an oversite. This increase is
effective July 1, 1999.

10. Settlement agreement with the NC Department of Labor, Division of Occupational
SETTLEMENT AGREE. Safety and Health, regarding penalty for the County's failure to implement a
LANDFILL INCIDENT sufficient disciplinary program for its employees who do not follow safety rules,
i.e. wearing seat belts. (Attachment 6)
CHANGE ORDER 11. Change order for water hookup for the terminal building at the Airport which was
AIRPORT PROJECT overlooked when the plans for the project were drawn. No new funds are needed.
Informal comments were provided by the following citizens:
1. Catherine Lowe, Coats, thanked the Board for assistance in getting a
waterline run in her community and requested assistance regarding a drug
problem in her community. .
2. Wilton Lee, Spring Lake, requested assistance for sewer to be run in the
Rolling Springs area. He noted that there is a junkyard in the
neighborhood that needs to be cleaned up and there is an animal control
problem in the neighborhood as well.
Commissioner Titchener moved for the appointment listed below. Commissioner Hill
seconded the motion and it passed unanimously.
APPOINTMENTS
Central Carolina Community College Advisorv Board
Jerry Hartgrove for a 3-year term to expire 12/31/02
AUDIT REPORT Jon Woodall, Deloitte & Touche, LLP, presented the Harnett County FY 1998-99
Audit Report.
Departmental reports were filed with the Board from the Health Department and the
Department of Social Services.
Neil Emory, County Manager, reported that the Town of Lillington has terminated the
RESCUE BUILDING lease with the County for use of the rescue building on East Front Street and that the
LEASE TERMINATED County's EMS ambulance will be stationed at Flatwoods Fire Department beginning
July 1,2000. .
There being no further business, Commissioner Titchener moved for adjournment.
Commissioner Hill seconded the motion and it passed unanimously. The Harnett
County Board of Commissioners' regular meeting, November 1, 1999, duly adjourned
at 9:45 a.m.

5. In consideration of this Agreement, the Employer agrees to: .
a. Certify that it has abated the above-referenced Citation ltem(s) or will abate the above-
referenced Citation ltem(s) by the abatement date contained in such Citation(s);
b. Pay the total penalty assessment of $5600.00 pursuant to Paragraph 8 of this
Agreement: and
c. Waive its rights under the Occupational Safety and Health Act of North Carolina,
N.C.G.S. ~~95-124 to -155, to contest any citation item(s), penalty(ies), or abatement date(s) listed
on the NCOSHA-2, copy attached, before the Safety and Health Review Board of North Carolina
and/or any other tribunal.

d. The Employer lI$rees to improve their Sqfety & Health Pro$ram 'tv reviewin, and
IIPfradin,. as necessaO'. discipline policies and procedures within sixty (6Q) d4Ys
of the execution of this agreement. The Employer agrees that all employees who
make suggestions or complaints shall have the same protection provided employees
'. under Article 21, Chapter 95 of the General Statutes.
6. The parties agree that this agreement is a full and final settlement of all the claims set out in
the underlying NCOSHA-2, and none of the foregoing ~...._.ents, statements or actions taken by
the Employer shall be deemed an admission by the Employer of any of the allegations contained in
the NCOSHA-2. The parties agree that in any subsequent proceeding brought by the North Carolina
Department of Labor regarding matters covered by the Occupational Safety and Health Act of North
Carolina or any matter involving the Retaliatory Employment Discrimination Ace (Chapter 95,
Article 21 of the North Carolina General Statutes), this Agreement shall have the full force and effect
of a Final Order. This agreements, statements and actions taken herein are made solely for the
purpose of settling this matter economically and amicably without litigation and shall not be used
for any other purpose except for proceedings and matters arising under the Occupational Safety and
Health Act of North Carolina or Article 21, Chapter 95 of the North Carolina General Statutes. This
Agreement has been entered into prior to any notification by the Employer of the intent to contest
. a citation or the filing by the Employer of any notice relating to the time period established for
abate.ment. Further. the parties a~e that this a~ement is an unawealable Final Order of the
Commissioner that is sUQject to the provisions ofN(XT~ 9S-133(h) and 95-\.iL.
7. The parties agree to bear their own attorneys' fees, costs and other expenses incurred
to date in this matter.
8. The Employer ~.....> to pay the penalty of $5600.00 in equal monthly installments
ofS1400.00 over the next 4 months, with the first installment beginning on the first day of the month
immediately following the signing of this agreement by the parties. In the event that the Employer
does not pay each monthly installment as agreed upon, all remaining payments shall become
immediately due and payable, and the Commissioner retains the right to institute collection
proceedings as allowed by law. The Employer agrees to pay attorneys' fees to the North Carolina
Department of Labor in the event that collection proceedings must be instituted to collect the debt.
9. This Ae.-.......ent shall be prominently posted at or near such place(s) any violation(s)
. referred to in the original citation occurred and in close ....w..:mity to that original citation.
WHEREFORE, the undersigned parties enter into and execute this Agreement.
