Blanchard, Clerk to the Board Chairman Andrews called the meeting to order at 7:00 p.m. and Commissioner Hill led the pledge of allegiance and prayer. Gift to the Campbell University Library in memory of William Womble, former Chairman of Campbell's Board of Directors, who recently passed away 12. Instructions to enter into the minutes, all correspondence with Campbell University regarding the wastewater treatment plant issue (Attachment 4) Chairman Andrews welcomed to the meeting, Allison Nelson, a government student of Dr. Martin Sellers at Campbell University, Commissioner Byrd moved to appoint J. Keith Parrish, Coats, to the Harnett ~county Adult Care Home Community Advisory Committee for a one-year term to expire 02/28/99. Commissioner Bowden seconded the motion and it passed unanimously. Marion Rice, Chief Court Counselor, appeared before the Board and requested that a new building be built at the Governmental Complex for office space for the Juvenile Services Division, and in the interim that the building which formerly housed First Union Bank be rented to provide office space for the Juvenile Services Division. Commissioner Titchener moved to not rent the First Union Building; commit to building a new building, and that location of the building will be at the County Manager's discretion. commissioner Bowden seconded the motion and it passed 3 to 2 with Commissioners Hill and Byrd casting the dissenting votes. --------~ ..- --~_._---_--.- -- 888 Macio Hill, 4-H Agent, introduced Sarah Hardison, 4-H Club Member, who made a presentation on uCommunity Countdown 2,000" which is Miss Hardison's citizenship project. Miss Hardison proposes to hold meetings with key leaders in each of the five commissioner's districts to find out the needs of the citizens in the community and how government can better serve them. She encouraged each commissioner to participate when the meeting is held in his or her community. Commissioner Byrd made a motion to endorse Miss Hardison's endeavors and give her approval to proceed with the uCommunity Countdown 2,000" project. Commissioner Bowden seconded the motion and it passed unanimously. Jonathan Woodall, Deloitte & Touche, presented the Harnett County AUdit. Report for FY 1996-97. Neil Emory, County Manager, reported to the Board that Public Utilities has accepted proposals for sludge disposal at the Buies Creek/Coats Sewer Plant and has submitted AMSCO, Inc. as the recommended choice for consideration by the Board. Commissioner Hill moved that the sludge service contract be awarded to AMSCO, Inc. Commissioner Bowden seconded the motion and it passed unanimously. Chairman Andrews stated that at this time, the Board will consider certain matters sitting in its capacity as the governing body of Riverside Water and Sewer District of Harnett County. Neil Emory, County Manager, presented for the Board's consideration a proposed Resolution Authorizing Execution of Water Purchase Contract and Management Contract with the County of Harnett. Commissioner Byrd moved for adoption of the resolution. Commissioner Bowden seconded the motion and it passed unanimously. (Attachment 5) Chairman Andrews closed the Riverside portion of the meeting. Neil Emory, County Manager, presented for the Board's consideration a proposed Resolution Authorizing Execution of Water Purchase Contract and Management Contract with the Riverside Water and Sewer District of Harnett County. Commissioner Hill moved for adoption of the resolution. Commissioner Bowden seconded the motion and it passed unanimously. (Attachment 6) . Neil Emory, County Manager, presented for the Board's consideration a proposed Resolution to Establish Harnett County Public Utilities Fund for Simplified Accounting Purposes. Commissioner Bowden moved for adoption of the resolution. Commissioner Hill seconded the motion and it passed unanimously. (Attachment 7) In the County Manager's report, Mr. Emory noted that the uWelcome to Harnett County" signs have arrived and will be placed on all major roads coming into Harnett County except Interstate 95. Placement of a sign on Interstate 95 is costly and will be considered during the upcoming budget process. The following departmental reports were filed with the Board: Sheriff's Department, Emergency Medical Service, Veterans Affairs, Economic Development, Fire Marshal and Emergency Management and Intra-departmental Budget Amendments. (Attachment 8) In new business, Neil Emory, County Manager, reported to the Board on the Tax Department's Task Force Report that has been completed by the N.C, Department of Revenue and presented two items from the Tax Department for consideration by the Board. 1. An additional position in the motor vehicle taxing division is requested. Commissioner Bowden moved to authori~ a new permanent motor vehicle clerk position in the Tax Department. Commissioner Titchener seconded the motion and it passed unanimously. 2. The Tax Department requests that the County contract out the backlog of digitizing and mapping in GIS in order to bring tax mapping up to date. The cost of this proposed project would be approximately $60,000. Commissioner Bowden moved to proceed with the contracting process and that monthly status reports be provided to the Board. Commissioner Titchener seconded the motion and it passed unanimously. ~ -- -- ~_.._- _.~ -- -- -- 889 commissioner Byrd moved that the Board go into closed session for the following purposes: 1) To discuss matters relating to the location or expansion of an industry in Harnett County. 2) To discuss a personnel matter. 3) To advise and give instructions to the County Attorney concerning the handling or settlement of claims or judicial actions, . namely: a) Shaw Construction Co., Inc. , et als vs. NC Department of Environment, Health and Natural Resources and the Harnett County Department of Public Health, et als 97 EHR 924 b) Kincheloe, et al vs. Harnett County, et al This motion is made pursuant to NC General Statutes, section 143-318.11 (a) (3), (4) and (6) Commissioner Hill moved that the Board come out of closed session. Commissioner Bowden seconded the motion and it passed unanimously. There being no further business, commissioner Hill moved that the meeting adjourn. As mentioned, set forth below are some suggested possibilities that we believe could remedy the problem to the mutual benefit of the County and the University. Alternative #1 - Purchase of the nresent Wastewater Plant. Inasmuch as the cities of Angier, Erwin, Dunn, LilIington and at least one corporation all have their own wastewater treatment facilities, we believe it is time that Campbell University goes forward with its own wastewater system as was envisioned when the University built the present plant. It is our understanding that with a minimum of outlay of funds by the County and the communities effected, a different and acceptable arrangement can be made for that in the Buies Creek and Coats areas now using the present facilities. Thus, the University respectfully recommends that the County and the University enter into an agreement providing for a Committee of three persons, one appointed by the County, one by the . University and one completely disinterested person having no tie to the County or the University and appointed by the two representatives with the approval of both the County and the University, to determine the present fair market value of the plant. Once the fair market value of the plant is established, the County and the University can proceed to negotiate a sale of the present facility to the University. We believe if this recommendation is followed that it will result in both short-term and long-term advantages to both parties and will help accelerate the orderly growth of the area. Buies Creek, North Carolina 27506 ~~---- ~-----~---- -- ._-~--"-~-~,~ --.,~-~~- ~-----~----------.-------------~---- --~~--_.-.--- f 896 Mr. Dan Andrews Page Two December 18, 1997 Alternative #2 - Construc~ion Of New Plant at New Site Inasmuch as the County is considering upgrading the present plant and the University has nearly finalized plans for the building of a completely new and modem wastewater facility, consideration should be given to the building of a new plant at a new site, preferably, in the . neighborhood of the area first considered some years ago. Certainly, all familiar with the history of the matter know that should this alternative have been adopted when presented, it could have been accomplished at a minimum cost and resulted in greater tax revenues to the County. Present estimates would indicate that a modem, up-to-date, state-of-the-art plant for 1.2 million gallons could be constructed for about $3,900,000 and this would include land acquisition, construction, engineering fees, legal costs, administrative costs and contingencies. These estimates are made upon the assumption that the County and University would divide the costs of construction and the ownership would be shared equally. Alternative #3 - Close Present Plant and Pumn Wastewater to Erwin Almost all experts in the field place this possibility high on the scale of solutions. Our contacts with the leaders of the Erwin Community has indicated a desire to consider this possibility. All seem to conclude that the pumping of all of the wastewater thus maximizing the use of the facilities would result in lowering operational costs to all users. As in the case of the building ofa state-of-the-art plant by the University, the utilization of the Erwin state-of-the-art plant, the closing of the present plant and the agreement of the University not to go forward with a separate plant would greatly improve the environmental aspects of this problem. Campbell University . A Major Contributor to County Solvency We realize that many fellow citizens know little of the major contribution made by Campbell University to the financial solvency of Harnett County. In the interest of a better understanding of the annual contribution to the economic environment of the County, we respectfully offer the following information. Notwithstanding our deep and abiding appreciation for an increasing awareness and support of the University by the local community, we believe and hope the Mr. Dan Andrews Page Three December 18, 1997 following information will be helpful to those who are unfamiliar with the annual financial contribution to financial viability of the County: 1. .Emnlovment Campbell University is presently one of the largest employers in Harnett County. . The more than 600 employees are your next door neighbors who buy the houses, frequent the stores and restaurants, and purchase an almost unlimited number of services. They are also the stable taxpayers who help defray a rather sizeable share of the costs of public services offered throughout the County and the communities in which they live. Campbell University employs about 620 full-time persons in Harnett County, 120 part-time, and about 550 student workers. The salaries are paid with outside new money generated from tuition, fees, and contributions. Economic experts would predict that additional supportive service employees would be needed, some estimate as high as 4 to 1, bringing the net jobs for Harnett County and area to about 3000 because of Campbell University. -- 897 2. Bud!!et The economic impact is significant when one looks at the many dollars that are brought into the community. Campbell's budget is in excess of $51,000,000. Using the multiplier effect, which says that each dollar expended generates from five to seven times the original dollar, means that the Campbell budget alone brings over $255 million in goods and services into the community. 3. Student and visitor economic contribution. . When you add the dollars spent by the several thousand students and visitors to the campus and one looks at the major vendors that sell goods and services to Campbell University, one can readily see that a tremendous economic impact is made by Campbell University in Harnett County and in the counties that surround it. A recent estimate predicted this figure in excess of 440 million dollars. The visitors coming to Campbell's campus are here for a variety of reasons including the athletic competitions from the Trans-America Athletic Conference consisting of 12 schools covering the area from Harnett County to Shreveport, Louisiana and over to Florida. Each of the member schools fields an average of Mr. Dan Andrews Page Four December 18, 1997 eight teams for men and eight teams for women. As these teams visit Harnett County on a regular basis, they bring with them family and supporters. These large followings spend not only time, but money in the local area and this shows . in the economic impact for the community. Other types of campus events bring many more visitors to Harnett County. Although not all inclusive, such activities as RA Day, Trust School, Pastors' Conference, Parents' Days, Homecoming, Student Convocation, Founder's Day, and golf tournaments inspire persons from other localities to want to come to Harnett County. The economic impact again is enjoyed by local businesses and service agencies as many of these visitors spend money while here. 4. Services assumed bv the Universitv Many people are not aware of the substantial enhancements made by Campbell University for an improved quality of life for the Harnett County Citizens--made without demands on the taxpayers for financial support. Time and space would not permit us to list all of them, but just a few would include: a. Public safety. The University not only pays for its own public safety, but it provides public safety for the local community. We might add, that Buies Creek is not only one of the safest places to live in Harnett County, but in North Carolina as well. Currently, the cost for this service is approximately $460,000 per year with about $24,000 per month paid directly to Harnett County for this service alone. . h. Water. The University has its own water supply system, thereby relieving the County of any responsibility for assisting the University in this absolutely necessary area of operation in any community. c. Wastewater treatment. The University has its own carrier lines for wastewater treatment, bought and maintained without any cost to the County. Infrastructure costs, as everyone knows, are substantial and this system is in place and working for our various publics of the University. d. Mental health. As you know, Campbell University was a primary motivator for bringing into being for our citizens, the present mental health center. For a considerable length of time mental health was located -'-- - -----~- ----- - ,~______~_ r _____ ____. 898 Mr.'Dan Andrews Page Five December 18, 1997 on the campus and supported by the University. Once again the University served as a catalyst to make good things happen for the citizens of Harnett County. It is reasonable to assume that a sizeable source ofthe income for the mental health center comes from University employees. . e. Refuse collection and disposal. Campbell University has always assumed the responsibility for this vital service. It has never received any support from the County and presently pays the standard rate for unloading at the County landfill site even though the University is probably the largest of any institution in the County using the site. f. Fire protection. Persons familiar with history will quickly recall or, if unable to, can quickly read that the present fire station was initially located on the University campus and primarily supported by the University. The University continues today to make annual contributions for fire protection and, from time to time, has contributed towards capital improvements necessary to maintain the excellent fire protection that we have. g. Use of campus facilities. At all times possible, the University has fulfilled its duty as an institutional citizen and made its facilities available to public activities for the citizens of the area at a reasonable charge. On some occasions, for example hosting of the Special Olympics, the University has assumed the cost of a great portion of or all of the events. h. Cultural quality. The University is very cognizant of fulfilling its role as . a prime instigator of an improved cultural quality of life for Harnett citizens. During any given year, outstanding cultural experiences and outstanding speakers will be brought into Harnett County. Who could ever forget being entertained at one of the Glenn Miller or Tommy Dorsey Orchestra concerts, or by the North Carolina Symphony? Nationally renowned speakers appear frequently on the campus, for example, Generals Hugh Shelton and Jack Keane, Dr. Billy Kim, Chuck Colson, Senator Jesse Helms, Congressman Bob Etheridge and Secretary-of-State Elaine Marshall, just to name a few. The University makes such cultural enhancements available for a nominal, if any, cost to the citizens of Harnett County. Mr. Dan Andrews Page Six December 18, 1997 Conclusion The University believes the purchase of the present plant would be the favored solution to the problem inasmuch as it holds more possibilities for long-range benefits to both the County and the University. It would resolve a long-standing and difficult problem that must be resolved if the University is to continue to enlarge its educational services at the present site. . Box 127 Buies Creek, North Carolina 27506 Dear Dr. Wiggins: On behalf ofthe Harnett County Board of Commissioners, I would like to thank you for responding so promptly to our recent proposals regarding the expansion of sewer facilities to serve Campbell University, as well as the Town of Coats and the Buies Creek Community. As we have noted throughout our discussions, the resolution of this issue is one of our Board's highest priorities and one which we would like to put behind us as soon as possible. I would also like to thank you and all those associated with the University for your willingness to work with the County in an attempt to resolve this very important issue. In response to your recent letter, I wanted to write and provide you with the County's position regarding the alternatives you have suggested. Please keep in mind . that the County's position on each alternative is based upon the impact it will have on the County's long-term wastewater needs and also the impact it will have upon the wastewater rates paid by the customers of the Buies Creek/Coats Sewer District. Also, I would again take this opportunity to note the option the County finds most attractive. A Itemative # 1- 'p1.\rd:1a~l! of the PreseIlt W a~tewater Plant As a follow-up to earlier suggestions regarding the County selling the current facility to the University, we asked our engineer to prepare cost figures for transporting waste to the Town of Erwin's treatment facility. Upon review of the cost, it is apparent that this alternative is only feasible ifthe sales price for the plant is somewhere in the neighborhood of $3 million. It would seem that such an alternative would be too costly for the University. Therefore, we would suggest that other alternatives be considered. However, if the University would like to submit an offer, the Board of Commissioners would be happy to receive and consider any such proposal. In regards to acquiring the Dr. Norman A. Wiggins Page 2 January 6, 1998 . services of appraisers, it is the County's position that any appraised value could not reflect the true value of the facility to the County. Also, an appraisal would not take into account the debt owed on the facility, as well as the capital cost required to transport the waste to another facility. hltemative #2 - Constmction of New Plant at New s..iW Again, as a follow-up to an earlier suggestion, the County has considered this alternative. Upon review, it is evident that the biggest drawback to this option is the tremendous financial burden it would place upon district customers. in fact, it is projected that the district base rate would have to increase from $12.10 per month to approximately $30 per month to finance the County's portion of this alternative ($2 million). Therefore, it is the County's position that this alternative is not a viable option for the District. ----- ~--- - \. 900 Alternative # 3 - ('\Q.c;~ Prt>,c;ent Plant and Pumn Wastewater to Em:in This option is one which the County has not explored. However, the Town of Erwin has informed the County that capacity in its plant would cost $3 per gallon. When you consider this up-front cost, it would appear that this option would be too costly for the . customers we serve. Since we have not looked at this option, we welcome any additional information you might provide. Upon review of the options submitted, the Board of Commissioners would again suggest that the University consider joining with the County to expand the existing facility at the present site. We believe that this option provides the most economical solution for the University, as well as the customers ofthe district. As you have documented in your letter, the University is a tremendous asset to the County and we would hope that we can join together in a solution that is of benefit to both the University and the County. Also, I would again like to point out that it remains the County's intent to proceed with plans to begin improvements to the existing facility sometime this spring. Our engineer is currently developing plans which would allow the County to expand the facility, or simply upgrade the existing plant, if the University chooses to end our current partnership. In conclusion, I would again thank you and those associated with the University for your many contributions to our County. It is with deep regret that our Board of Trustees have determined that it cannot accept any of the options proposed by Mr. Emory in his letter of November 20th. Unfortunately, the long-standing problem does not appear to have any solution acceptable to both the County and the University. Meanwhile, the damages resulting from the premature stoppage of the development of the proposed Keith Hills Subdivision continue to mount to the mutual loss of both County and University. . With great reluctance, we now accept the inevitable that our only recourse is to gn forward with the building of a new plant. This is readily understandable when one realizes the se\ -cral programs including the Keith Hills Subdivision that are now on the drawing board waiting to be accomplished. I am sure you can understand that it is virtually impossible to explain why the County is not willing to consider the sale of the plant on the basis of its present fair market value determined by reputable and knowledgeable people in the business, as opposed to setting a price for the plant that exceeds the cost of construction of a new plant. The University cannot assume indebtedness incurred by the County over the years. As of January 20, we have initiated the necessary action to go forward with the building of our own wastewater system and, thus, remove the single problem that has impaired our Mr. Dan Andrews Page Two January 29, 1998 relationship. In the light of our intent to move expeditiously to build a new wastewater treatment plant, we respectfully request that the present current average rate of $1.65 per thousand gallons . be continued until the new plant can be built and put into operation. (Point of Delivery and Pressure) That water will be furnished at a reasonable constant pressure calculated at fifty (50) pounds per square inch from those points of connection as shown upon the final plans and specifications for the Purchaser's water supply distribution system as approved by the Harnett County Board of Commissioners. If a greater pressure than that normally available at the points of delivery is required by the Purchaser, the cost of providing such greater pressure shall be borne by the Purchaser. Emergency failures of pressure or supply due to main supply line breaks, power failure, flood, drought, fire and use of water to fight fire, earthquake or other catastrophe shall excuse the Seller from . this provision for such reasonable period of time as may be necessary to restore service. 3. (Metering Equipment) To furnish, install, operate, and maintain at its own expense at the points of delivery, the necessary metering equipment, including meter houses or pits, and required devices of standard type for properly measuring the quantity of water delivered to the Purchaser and to calibrate such metering equipment whenever requested by the Purchaser but not more frequently than once every twelve (12) months. A meter registering not more than two percent (2%) above or below the test result shall be deemed to be accurate. The previous readings of any meter disclosed by test to be inaccurate shall be corrected for the three (3) months previous to such test in accordance with the percentage of inaccuracy . found by such tests. If any meter fails to register for any period, the amount of water furnished during such period shall be deemed to be the amount of water delivered in the corresponding period immediately prior to the failure, unless Seller and Purchaser shall agree upon a different amount. The metering equipment shall be read on the first day of each month. An appropriate official of the Purchaser at all reasonable times shall have access to the meter for the purpose of verifying its readings. ---- 90S 4. (Billing Procedure) To furnish the Purchaser not later than the fifth (5) day of each month, with an itemized statement of the amount of water furnished the Purchaser during the preceding month. B. THE PURCHASER AGREES: 1. (Rates and Payment Date) To pay the Seller, not later . than the tenth (10) day of each month, for water delivered in accordance with the following schedule of rates: a. One thousand one hundred twenty-five dollars ($1,125.00) for the first seven hundred fifty thousand (750,000) gallons, which amount shall also be the minimum rate per month. b. One dollar and fifty cents ($1.50) per one thousand (1000) gallons for water in excess of seven hundred fifty thousand (750,000) gallons. c. It is agreed that the minimum rate per month as stated in (a) above shall not be applicable until six (6) months after the last notices for connection have been mailed to potential water customers of the Purchaser by the Harnett County Department of Public utilities; and up to said time the minimum . rate per month becomes applicable, Purchaser shall pay only for such water as is delivered to Purchaser at the rate of $1.50 (one dollar and fifty cents) per 1000 (one thousand) gallons. 2. (Connection Fee) To pay as an agreed cost, a connection fee to connect the Seller's system with the system of the Purchaser, a sum equal to the amount of the cost of the installation of the meters, meter vaults and related appurtenances and the cost of the laying and installation of the necessary pipelines to connect the system of the Seller to the system of the Purchaser at the boundaries of the Riverside Water and Sewer District. C. It is further mutuallv aareed between the Seller and the Purchaser as follows: 1. (Term of Contract) That this contract shall extend for . a term of forty (40) years from the date of the initial delivery of any water as shown by the first bill submitted by the Seller to the Purchaser and, thereafter may be renewed or extended for such term, or terms, as may be agreed upon by the Seller and Purchaser. 2. (Delivery of Water) That thirty (30) days prior to the estimated date of completic~ of construction of the Purchaser's water supply distribution system, the Purchaser will notify the Seller in writing the date for the initial delivery of water. -. ---~---.-~- -~~ - --- - -~.._-"'-- ----~~~---- .' 906 3. (Water for Testing) When requested by the Purchaser, the Seller will make available to the contractor at the points of delivery, or other points reasonably close thereto, water sufficient for testing, flushing, and trench filling the system of the Purchaser during construction, irrespective of whether the metering equipment has been installed at that time, at a . flat charge of one dollar and fifty cents ($1.50) per one thousand (1000) gallons which will be paid by the contractor or, on his failure to pay, by the Purchaser. 4. (Failure to Deliver) That the Seller will, at all times, operate and maintain its system in an efficient manner and will take such action as may be necessary to furnish the Purchaser with quantities of water required by the Purchaser. Temporary or partial failures to deliver water shall be remedied with all possible dispatch. In the event of an extended shortage of water, or the supply of water available to the Seller is otherwise diminished over an extended period of time, the supply of water to Purchaser's consumers shall be reduced or diminished in the same ratio or proportion as the supply to Seller's consumers is reduced or diminished. . 5. (Modification of Contract) That the provisions of this contract pertaining to the schedule of rates to be paid by the Purchaser for water delivered are subject to modification at the end of every one (1) year period. Any increase or decrease in rates shall be based on a demonstrable increase or decrease in the costs of performance hereunder. Such costs shall not include increased capitalization of the Seller's water distribution system except as such costs relate directly to increasing the capacity of services to the Purchaser. Such costs may include increased capitalization of the Seller's water production facility system. other provisions of this contract may be modified or altered by mutual agreement. 6. (Future Water Transmission and Connection) I n the event . Seller elects to supply and sell water to any customers or other water distribution systems located outside of the boundaries of the Riverside Water and Sewer District of Harnett County and desire to do so by connecting to and transporting water through the water distribution system of Purchaser, it is agreed that Seller may, at no cost to it, connect to and transport water through the water distribution system of ._,~ -.- .------ - -. ~--~- 907 Purchaser for the purpose of supplying and selling water to customers or other water distribution systems outside of the Riverside Water and Sewer District, whether within the County . of Harnett or otherwise. In the event Seller should elect to supply and sell water as stated herein, Seller shall cause a meter to be installed at the connection point and the cost thereof shall not borne by Purchaser. 7. (Regulatory Agencies) That this contract is subject to such rules, regulations, or laws as may be applicable to similar agreements in this State and the Seller and Purchaser will collaborate in obtaining such permits, certificates, or the like, as may be required to comply therewith. 8. (Miscellaneous) That the construction of the water supply distribution system by the Purchaser may be financed by a loan made or insured by, and/or a grant from the united States of America, acting through the united States Department of Agriculture Rural Development, and if such construction is . so financed, then the provisions hereof pertaining to the undertakings of the Purchaser are conditioned the upon approval, in writing, of the USDA-Rural Development. 9. (Successor to the Purchaser) That in event of any occurrence rendering the Purchaser incapable of performing under this contract, any successor of the Purchaser, whether the result of legal process, assignment, or otherwise, shall succeed to the rights of the Purchaser hereunder. THIS CONTRACT, made and entered into as of the 16th day of February, 1998, by and between the COUNTY OF HARNETT, a body politic organized and existing under the laws of the State of North Carolina (hereinafter called "County") and the RIVERSIDE WATER AND SEWER DISTRICT OF HARNETT COUNTY, a municipal corporation organized and existing pursuant to the provisions of Article 6, Chapter 162A of the North Carolina General Statutes (hereinafter called "District"); WIT N E SSE T H: THAT WHEREAS, the County is owner and operator of a water production system and a water supply distribution system; and WHEREAS, County as operator of said systems has created a Public utility Department which conducts the operation of said systems; and . WHEREAS, the District was organized and established for the purpose of constructing and operating a water supply distribution system to serve water users within the District; and WHEREAS, the United States Department of Agriculture, Rural Development may agree to loan the District sufficient funds to enable the District to finance the construction of said water supply distribution system; and WHEREAS, the County's Public utility Department is fully capable to conduct the operation and management of the water supply distribution system of the District; and WHEREAS, the County and the District have agreed to enter into this contract for the operation and management of the water supply distribution system of the District as a County operated system on a continuing basis and especially for and during the period of the . existence of any Rural Development loan to the District. NOW, THEREFORE, the parties do contract and agree each with the other as follows: 1. That the District's water distribution supply system referred to above shall be operated and managed by the County's Public utility Department as a County operated water distribution system on a continuing basis and especially for a period beginning as of the execution of this contract and ...____ ___~T._ ------...------..--- ( 9:10 "- extending until any loan made by the Rural Development to the District has been paid in full, being a period of at least forty ( 40) years. 2. That the Harnett County Board of Commissioners, sitting in the capacity as the governing body of County and/or as the governing body of the District, shall establish and set the . rates of charges for the purchase of water and for such other fees, charges, and penalties as required for the operation of the water distribution system, with proper cost accounting procedures to appropriately reflect the cost of these facilities operated by the County Public utility Department relative to the operation of other utility enterprises which are or may be carried on by the County Public utility Department. Further, the Harnett County Board of Commissioners, in the capacities stated above, shall charge such rates for the users of said water distribution system as will appropriately yield sufficient funds to meet operation and maintenance expenses and to pay and retire the long term debt of the District to the Rural Development or other lender. 3. This contract shall be a continuing contract relative . to the furnishing of the essential water utility services for the people of the District and this contract shall exist and continue until the District and the County shall mutually modify or terminate this contractual arrangement. 4. That the Harnett County Board of Commissioners agrees to create an Advisory Council to lend assistance with input and advice as to the operation and maintenance of the aforesaid water distribution system by the Harnett County Board of Commissioners as the governing body of said District. 5. That the County shall be entitled to fund or cause to be funded the construction of any water line to be connected to the District's system as an extension within or without the boundaries of the District for the purpose of . serving needy users with water utility services as the same shall be determined by the Harnett County Board of Commissioners and that the rates chargeable to such persons (users) shall be equitably set to properly reflect cost of operations and maintenance of water production and supply and further that in the event it shall become necessary for the District to levy a tax for the purpose of funding bonded indebtedness of the District then in such event such rates of -,.~-,--- -<---- - ~- ------ 91.1. any person (user) outside the boundaries of the District shall be charged a greater user fee (rate) as will be equivalent to such needed property tax as may be levied; provided, if a tax levy is made, then such user charge for out-of-district users shall not be less than 150% of the user . charge of users of the District. It is understood and agreed that the District shall have no obligation to extend its water lines outside of the District's boundaries. 6. That the County will manage and operate the water supply distribution system on an annual budget with the setting of rates on an annual basis as approved by the District's governing body with proper input and advice from the Advisory Council, which budget shall provide and set forth the handling of the funds such that a reserve fund, depreciation fund, debt payment fund, and surplus fund for the District shall be distinguishable, and further that the County shall maintain a system of accounts for the County utility Department which will appropriately account for the various operations of the utility Department, specif ically so that all costs relative to the . operation of the water supply distribution system will be separately stated; the County shall further maintain insurance and bonds as required by state law and that the County shall properly contract with a certified public accountant for annual audits of the utility Department and that further the County shall comply with all federal, state and local laws and regulations relative to the operation of the water supply distribution system. RESOLUTION TO ESTABLISH HARNETT COUNTY PUBLIC UTILITIES FUND FOR SIMPLIFIED ACCOUNTING PURPOSES WHEREAS, there are eight County Water and Sewer Districts within the County of Harnett including Buies Creek-Coats Water and Sewer District, East Central . Water and Sewer District, Northwest Water and Sewer District, Riverside Water and Sewer District, South Central Water and Sewer District, Southeast Water and Sewer District, Southwest Water and Sewer District, and West Central Water and Sewer District; and WHEREAS, each of the above-named Water and Sewer Districts which owns a water distribution system or has plans to construct such a system has contracted to purchase water from the County of Harnett; and WHEREAS, each of the Water and Sewer Districts has contracted with the County to operate and maintain the water distribution and/or sewer collection system of the District, in addition to the operation and maintenance of facilities owned by the County of Harnett; WHEREAS, it has been recommended, after consultation with appropriate agencies including the Local Government Commission of the State of North . Carolina, to consolidate accounting for the operation of the facilities owned, operated, and maintained by the County of Harnett including the Water and Sewer Districts; and WHEREAS, such consolidation would result in a simplified accounting procedure and a more efficient operation of such systems; and WHEREAS, establishment of a "Harnett County Public Utilities Fund" would accomplish such end; and WHEREAS, each Water and Sewer District shall remain a separate and viable entity and the only change which will occur is the manner in which revenues and expenditures are budgeted and allocated; and WHEREAS, all debt owed by each District shall continue to be paid by that District; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of Harnett and by the Board of Commissioners sitting as the governing body of the . County Water and Sewer Districts named above, that: 1. A Fund be established entitled "Harnett County Public Utilities Fund" for the purpose of consolidating accounting procedures for the various water and sewer systems owned and operated by the County of Harnett, including the above- named Water and Sewer Districts. 2.
