(Tony) Wilder, Assistant County Manager, presented for the Board's LEASE consideration a proposed standard hangar ground lease as recommended by the Harnett County Airport Committee. Commissioner Titchener moved to approve the lease, with deletion of section 4 of the agreement which addresses water and sewer, until water and sewer services are available to the area. Commissioner Titchener moved for approval of the proposed policies. Commissioner Bowden seconded the POLICIES motion and it passed unanimously. INSPECTIONS Neil Emory, County Manager, presented a contract renewal to provide Housing Code Enforcement for the Town of Lillington. Commissioner Bowden moved for CONTRACT approval of the contract. Commissioner Hill seconded the motion and it passed unanimously. DEBRIS Neil Emory, County Manager, reported to the Board on removal of Hurricane Fran. debris from streams in Harnett County. Mr. Emory presented an agreement with REMOVAL FROM the Emergency Watershed Protection Program for clean-up of additional streams STREAMS in Harnett County. Commissioner Titchener made a motion to move forward to participate in the program. Commissioner Bowden seconded the motion and it passed unanimously. Neil Emory, County Manager, reported to the Board that the Board of Education has received funding to hire three additional school resource officers for ten months per year. These officers would be assigned to middle schools. It has been requested that the County fund these positions as twelve month positions. The cost to the County would be $13,443.33. The necessary funding would be obtained from drug tax revenues this fiscal year. Commissioner Bowden moved to fund the new positions. Commissioner Byrd seconded the motion and it passed unanimously. Rodney M. Tart, Director, Public Utilities, presented a discussion of bids for NH PH II the Water Improvements Project - Phase II, Northwest Water and Sewer District HATER of Harnett County. Commissioner Bowden moved to adopt a resolution awarding IMPROV . the contract to McMahan Brothers Pipeline Company. Commissioner Andrews seconded the motion and it passed unanimously. (Attachment 7) Neil Emory, presented the bids for auctioneering services for the County's Annual Surplus Property Sale which will be held October 4, 1997. Commissioner Titchener moved to award the contract to Cary Stewart, Carolina Eastern Auction & Realty. The motion died from lack of a second. Commissioner Bowden moved to award the contract to James B. Brown. The motion died from lack of a second. After discussion, Commissioner Titchener moved to award the contract to Cary Stewart, Carolina Eastern Auctions & Realty. Commissioner Byrd . seconded the motion and it passed 4 to 1 with Commissioner Bowden casting the dissenting vote. Neil Emory, County Manager, reported to the Board on the following items: 1. There will be a 3% vehicle tax on the new Harnett County Mobile Command Post vehicle. Commissioner Titchener moved to approve paying up to $560 for vehicle tax on the new vehicle. Commissioner Byrd seconded the motion and it passed unanimously. 2. Welfare Reform 3. CBA funding for restitution program for youthful offenders 4. The North Carolina Revenue office located in Lillington will be staffed only on Monday of each week. with no objection from the Board, Harnett County's Veteran Service Officer will occupy available office space in the same building. The Board does not object to the move of the Veteran's Service Office from the Courthouse to the building housing the Revenue Office. 5. A workshop will be scheduled to discuss the Buies Creek Thoroughfare Plan as proposed by N.C. DOT. 6. Staff is working with the architect to determine space needs for the proposed courthouse. 7. Neil Emory, County Manager and George Jackson, Planning Director, met with the towns to discuss needs to be submitted as part of . Harnett County's proposed Transportation Improvement Program. Mr. Emory asked the Board to give thought to the County's priorities regarding road improvement needs. Commissioner Bowden moved that the Board go into closed session for the following purposes: CLOSED SESSION a) To instruct the County staff concerning the position to be taken by the staff in negotiating a contract to sell property, and b) To consider a personnel matter, and c) To advise and give instructions to the County Attorney concerning ----- - ------- 769 the handling or settlement of a claim or judicial action, namely: Bethune, et al. vs. County of Harnett, et al Kincheloe vs. County of Harnett This motion is made pursuant to the provision of N.C. General Statute sections 143-318.11 (a) (5) , (6 ) and (3) . Commissioner Hill seconded the motion and it passed unanimously. . Commissioner Titchener moved for the Board to come out of closed session. Commissioner Hill seconded the motion and it passed unanimously. Commissioner Byrd left the meeting. Under new business, Dwight Snow, County Attorney made the following report in accordance with the open meetings law: The Asher-Sullivan case was settled August 18, 1997. The judge approved the settlement. The Board of Commissioners approved the settlement 3 to 2 in closed session. There being no further business, Commissioner Bowden moved that the meeting adjourn. COUNTY OF HARNETT Hunting and fishing have always been an important part ofthe North Carolina tradition. And most Americans believe that such activities continue to be popular. Their perceptions are right on target. For example, the number of women involved in the shooting sports has increased by more than 80% in the past ten years. But hunting and fishing are so much more than recreational pursuits. For over 100 years, hunters and anglers have been at the forefront of the conservR.tion movement giving of their time and finances. In fact, they have provided over $20 billion to wildlife management programs, contributing $3.5 million per day nationally. In 1996, North Carolinians contributed nearly 30 million for licenses and wildlife stamp and excise taxes on sporting equipment. This financial support has provided the basis for scientific research, habitat restoration, and education which have led to the dramatic come back of wildlife in North Carolina such as wild turkey, river otters, tundra swans, and other waterfowl, alligators, shore birds, bald eagles, and other raptures and fur bearers. Hunters and anglers are also important to the economy. With the average sportsman . spending $1024 on food, lodging, equipment, real estate leases, and conservation fees, it is hardly a surprise that one million jobs are directly or indirectly supported by hunting and fishing. Of course dollars and cents alone do not represent the true worth of our outdoor traditions. Wealthier than any millionaire is one with greater awareness, understanding, and respect of the natural environment and its wildlife. Wealthier still are the ethical hunters and anglers who share this treasure with a youngster, friend or relative. In recognition of past and current conservation achievements of ethical hunters and anglers in Harnett County, we the Commission of Harnett County do hereby proclaim Saturday, September 27, 1997 as: Hunting and Fishing Day in Harnett County. It is the desire of the District to serve as many individuals as may be economically feasible. Construction of the water system is contingent, among other things, upon the District obtaining funding for the costs of construction. In order for the District to move forward with the planning for the water system, it is necessary for the District to obtain commitments from a sufficient number of individuals and/or property owners to connect to and use the water system. By signing this Agreement, in the event the water system is constructed, the User named above agrees to connect such User's residence, business or other building to the water system and agrees to thereafter use such system for User's water source. However, in the event the water system is not constructed, then neither the District nor the User . named shall be obligated hereunder. NOW THEREFORE, In consideration of the mutual promises herein set forth, it is agreed by the District and User as follows: A. It is mutually understood by User and District that in the event an adequate number of water users for the District is not obtained or for other reasons construction of the water system is not begun or a water distribution line is not available to the User, then neither District nor User shall be bound hereunder. B. The property which is the subject of this Agreement and to which water shall be supplied as provided is described as follows (please draw a map indicating the location of the property): ~-~.~ ____ __ ____n_. 774 c. User agrees to pay to the District, the amount of One hundred ($100.00) Dollars per connection as a tap-on charge, said amount being due after notice to User by District. The notice shall be given after funding commitments for the costs of construction of the District's water system are obtained, and shall be mailed to User by first class mail at the address indicated above. In the event that construction of the water system does not follow as anticipated or a water distribution line is not available to User, District shall refund the tap-on charge to User, without interest. D. In the event that the water system is constructed and a water distribution line is available to the User and the property described, then the following agreements shall apply: . 1. District, pursuant to its Rules and Regulations, agrees to provide a water service connection on the above described property and upon completion of the construction of the system and the commencement of the operation thereof, to provide potable water to the User. 2. User agrees to pay to District the amount ofTen ($10.00) Dollars as a deposit as required by the District Rules and Regulations; which deposit may be returned without interest as provided by said Rules and Regulations. Said deposit shall be due 30 days after notice to User by District and such notice shall be given by first class mail to User at the mailing address indicated hereon. Should this agreement be for rental property, the amount of the deposit, as set forth in the said Rules and Regulations, shall be Fifty ($50.00) Dollars. Said deposit shall be paid by or on behalf of the tenant prior to commencement of water service. Additionally, prior to commencement of water service, the tenant must complete and file a tenant water application. 3. User grants the District, its successors and assigns, a perpetual easement in, over, under and upon the above described land with the right to erect, construct, install, lay and thereafter use, operate, inspect, repair, maintain, replace and remove water lines, meters, meter service facilities and appurtenant facilities thereon, together with the right of ingress and egress over adjacent land for the purposes mentioned above. 4. User shall install and maintain at User's own expense a 3/4 inch cut-off valve on the User's side of the District's water meter and a service line which shall begin at the meter and extend to the dwelling or place of use. The service line shall connect with the water system of the . District at the nearest place of desired use by the User, provided the District has determined in advance that the District water system is of sufficient capacity to permit the delivery of water at that point. 5. User agrees to comply with all requirements, rules and regulations applicable to water . users adopted by the Division of Health Services of North Carolina Department of Human Resources. User further agrees that upon and after the date a plumbing connection is made between the User and the District, User shall allow no cross connection to exist between the District's system and any pipeline containing a contaminant or any pipeline connected to other present or future sources of water. 6. User agrees to pay for water at such rates, time and place as shall be determined by the District and agrees to the penalties for non-compliance with the above, as set out in the District's Rules and Regulations. 7. User agrees to abide by the Rules and Regulations of the District as from time to time promulgated by the District or the Harnett County Board of Commissioners, and further agrees to abide by such other Harnett County ordinances, rules and regulations with respect to water service connections, as are adopted by the Harnett County Board of Commissioners. Additionally, User agrees to obtain the necessary inspections and permits related to water service connections as required by the Inspections Section of the Harnett County Planning and Development Department. 8. It is understood that after the date water is made available to the User, District shall . notify User of such fact. Such notice shall set forth the details regarding the making of the plumbing connection, and shall provide information concerning User's obligations with respect to obtaining applicable inspections and permits regarding the plumbing connection. User shall then have sixty (60) days from the date of such notification to make the plumbing connection from the place of use on the above described property to the District's system. Charges for water shall commence on the date that the plumbing connection is completed, but in no event later than the end of the sixty (60) days period. That is to say, if the plumbing connection is not completed by the end ofthe sixty (60) days period, User charges shall commence and User shall be obligated to pay the minimum user bill from and after the end of such period, regardless of whether water is being supplied to User. ~,---_._-- ~. ~~~ ~_. ._~ ~- 775 9. User shall be responsible for paying at least the minimum monthly water bills, whether or not water is actually used, until such time as the reduced connection fee charged to the User, plus all monthly minimum water bills charged, equal to the then current charge for tap-on connection. The current charge for a tap-on connection as of March, 1997, is $500.00. The User shall remain liable for at least the minimum monthly bills thereafter until the User has notified the County in accordance with the provisions of the Rules and Regulations of the District that the User desires to stop water service. . 10. District shall purchase and install a cutoff valve (a cutoff valve shall be installed on the District's side of the meter by the District, the User is responsible for installing a cutoff valve on the User's side) and water meter for each service. The District shall own said meter and shall have the exclusive right to use it. 11. User agrees that there shall be one water connection for each building or structure requiring water connections on the above described property. A tap-on charge shall be due for each such connection. 12. District shall have final jurisdiction on any question of location of any service line connection to its distribution system; shall determine the allocation of water to User in the event ofa water shortage and may shut offwater to User if User allows a connection or extension to be made to User's service for the purpose of supplying water to another user. 13. In the event User transfers title or agrees to transfer title to the above described property, before or after such connection, User agrees that this agreement shall run with the property title thereto and agrees to advise the new owner with respect hereto and furnish new owner a copy thereof 14. In the event User breaches this agreement by refusing or failing, without just cause, to connect to the District's distribution system within 60 days from date of notification to make connection as set forth in paragraph 8 above, User agrees to pay District $500.00 liquidated damages. . 15. After District has executed this Agreement, a copy shall be provided to User by mailing to the User's address as indicated above. WHEREAS, the Harnett County Board of Commissioners, sitting as the governing body of the Riverside Water and Sewer District of Harnett County, (hereinafter the "Board") recognizes the need for general rules and regulations to manage and operate the water distribution system of the Riverside Water and Sewer District of Harnett County (hereinafter the "District") during both its construction period and thereafter; and WHEREAS, Harnett County now is operating and managing the systems of several water service districts within Harnett County and utilizes with respect thereto the current operational Rules and Regulations of the Northeast Metropolitan Water District of Harnett County; and WHEREAS, it has been recommended to the Board by the Harnett County Director of Public Utilities that the currently existing Rules and Regulations for the Northeast Metropolitan Water District of Harnett County as amended, except as the . same relate to Section 28 regarding Classifications, Rates, Fees and Charges and Section 29, be used as the rules and regulations for the District; and WHEREAS, it is the desire of the Board to make provision in said rules and regulations for the water rates, charges and fees to be applicable to said District, and in conjunction therewith desires to adopt as Section 28, and Section 29 of said rules and regulations the provisions herein below set forth. NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS, SITTING AS THE GOVERNING BODY OF THE RIVERSIDE WATER AND SEWER DISTRICT OF HARNETT COUNTY THAT: l. In setting such increased rate, the County will take into consideration . the rate paid by persons inside the District plus taxes levied on them for support of the water system. 3. Section 29 is added to said Rules and Regulations and reads as follows: Section 29.
