The Harnett County Board of Commissioners met in regular session on Monday, March 17, 1997, in the Commissioners Meeting Room, County Office Building, 102 East Front Street, LiIlington, North Carolina. Commissioner Titchener made a motion to adopt the agenda as published with the following items deleted: request from Summerville Committee, grant for District Attorney's office, and change order for waterline project. Commissioner Byrd seconded the motion and it passed unanimously. APPOINTMENTS Domiciliarv Home Community Advisorv Committee Commissioner Bowden moved to appoint Jack Phillips Brinson for a I-year term to replace Rebecca Maness. Commissioner Titchener seconded the motion and it passed . unanimously. Southeastern Economic Develooment Commission This organization requires from Harnett County, 1 commissioner, 1 minority and 2 at- large members. One of the members should be designated to serve on the Executive Committee. Commissioner Titchener moved to appoint Chairman Andrews. Commissioner Byrd seconded the motion and it passed unanimously. Commissioner Bowden moved to appoint Rodney Tart as an at-large member. Commissioner Hill seconded the motion and it passed unanimously. Harnett Youth Planning Board Commissioner Titchener moved to appoint Wm. A. (Tony) Wilder, with a term expiration of November 1, 1998. Commissioner Bowden seconded the motion and it passed unanimously. ZONING CHANGE Chairman Andrews called to order a public hearing on a zoning change request for Billy and REQUEST FOR Jerry Norris, from Industrial Zoning District to RA-30 Zoning District, SR 1709, Averasboro JERRY NORRIS Township, 12.289 acres. George Jackson, Planning Director, presented the zoning change request and stated that the purpose of the public hearing is to obtain public comments regarding the request. Chairman Andrews opened the meeting for public comments. No comments were offered and Chairman Andrews closed the public hearing. The Planning . Board recommended approval of the zoning change request. Commissioner Titchener moved for approval of the zoning change request for Billy and Jerry Norris. Commissioner Hill seconded the motion and it passed unanimously. BEARS LANE Neil Emory, County Manager, briefed the Board that residents of SR 1828 (Bears Lane) have requested that their road not be paved as per the Department of Transportation Priorities List The residents signed a petition stating that they do not want the road widened or paved. They are satisfied with the road as it is (dirt). Chairman Andrews called to order a public hearing concerning this matter. No comments were offered and Chairman Andrews closed the public hearing. Commissioner Byrd moved to approve the residents' request for DOT not to pave SR 1828 (Bears Lane) upon verification by DOT that all property owners have signed the petition. Commissioner Bowden seconded the motion and it passed unanimously. ROADNAMING FOR Chairman Andrews called to order a public hearing on road naming and road renaming for E- 911 Enhanced 911. Clint Williams, E-911 Coordinator, presented a list of proposed private road names for Enhanced 911 and stated that the purpose of the public hearing is to obtain public comments regarding this matter. Chairman Andrews opened the meeting for public comments. Comments were received from the following citizens: 1. Barbara Baker requested that Road 2298 (1090) off of SR 1106 (Hillmon Grove Road) be named Gainsborough Lane. 2. King S. Cameron, Jr. requested a certain road not be named Sands Road. The road Mr. Cameron referred to is not on the proposed list to be considered by the Board at this meeting. There being no further comments, Chairman Andrews closed the public hearing. . Commissioner Byrd moved to approve the list of road names as presented by Clint Williams, with the change requested by Ms. Baker to name Road 2298 (1090) Gainborough Lane, contingent on the Planning Department verifying that it is not a duplicate roadname. Commissioner Bowden seconded the motion and it passed unanimously. (Attachment 4, page 613) Clint Williams, E-911 Coordinator, reviewed the proposed Harnett County Addressing ADDRESSING Ordinance. The Board of Commissioners scheduled a public hearing on the proposed ORDINANCE ordinance for April 7, 1997. Neil Emory, County Manager, reviewed financing for Harnett Production Enterprises/Central FINANCING FOR Carolina Community College construction project. As per state statute, prior to proceeding HPE/CCCC with financing the Board must hold a public hearing and adopt a resolution authorizing the process to proceed. Chairman Andrews called to order a public hearing on the matter and asked for public comments. No comments were offered and Chairman Andrews closed the public hearing. Commissioner Titchener made a motion that the appropriate resolution be drafted regarding financing of the project. Commissioner Bowden seconded the motion and it passed unanimously. DRAINAGE PROBLEM Donald Dawson, resident in the Bunnlevel community, representing several of his neighbors, IN BUNNLEVEL submitted concerns regarding drainage problems in their community. WATER PURCHASE Al Bain, Public Utilities Attorney, reviewed and presented for the Board's consideration, a CONTRACT WITH water purchase contract between Harnett County and the towns of Angier, Fuquay-Varina and ANGIER, F.V. & Holly Springs. Commissioner Bowden moved to approve the water purchase contract as . HOLLY SPRGS. presented. Commissioner Byrd seconded the motion and it passed with a unanimous vote. Rodney Tart, Public Utilities Director, briefed the Board on proposed modifications to the ALUM SLUDGE County's sludge disposal program and called on representatives from The Wooten Company. DISPOSAL SYSTEM Dan Boone, Vance Brooks and Ralph Mobley presented the Executive Summary of the Alum Sludge Dewatering Pilot Study performed at the Harnett County Water Treatment Plant. Commissioner Byrd made a motion to authorized staff to apply for funding with North Carolina Clean Water Revolving Loan Fund for an Alum Sludge Dewatering Facility. Commissioner Bowden seconded the motion and it passed unanimously. REQUEST FROM Neil Emory, County Manager, presented a request from the Board of Directors of Anderson A.C. FIRE DEPT. Creek Fire Department that the County consider the creation of a rescue district in that area. The Board directed that any action on this matter would require a vote of the residents. REINSTATE LANDFILL Neil Emory, County Manager, noted that since Hurricane Fran, the County has accepted storm CHARGES debris at the landfill at no cost. Due to the state suspension of roadside pick-up as well as our neighboring counties reimplementing charges, staff recommends that the Board reinstate charges in Harnett County. Commissioner Bowden made a motion to reinstate landfill charges as of April 1, 1997 on storm items other than tree and brush debris. Commissioner Titchener seconded the motion and it passed with a unanimous vote. Neil Emory, County Manager, stated that due to the pending retirement of Bobby Wicker, Tax Administrator, the county needs to proceed with plans to fill the position as of July 1, 1997. The Tax Administrator position is a Board appointment. Commissioner Titchener . made a motion to authorize staff to advertise statewide for applicants for the position with application deadline of April 15, 1997. Commissioner Bowden seconded the motion and it passed unanimously. In the county manager's report Mr. Emory reported on the following items: - It was noted that the Forestry position vacated by the employee who was named Forest Ranger has been frozen. Commissioner Titchener made a motion for the Board to encourage the Forestry Service to keep the much needed position in Harnett County. Commissioner Bowden seconded the motion and it passed unanimously. ANDERSON CREEK - The County has agreed to pay operation costs only, for the Anderson Creek gym. The GYM County will not pay for initial improvements. LIFT FOR COURTHOUSE - Recently a citizen called for jury duty was unable to serve due to lack of wheelchair . access in the Courthouse. It was noted that it is time to move ahead to obtain a lift. Commissioner Byrd authorized staff to get prices on a lift for the Courthouse and bring the matter back to the Board for consideration. Commissioner Bowden seconded the motion and it passed unanimously. - A joint meeting with the Planning Board is scheduled for April 7, 1997, at 8:00 p.m. Departmental reports were filed with the Board from Veterans Affairs, Emergency Services, Economic Development, Emergency Medical Service, Department of Social Services and the Tax Attorney's report (Attaclunent 3). Commissioner Hill moved for the Board to go into closed session for the following reasons: CLOSED SESSION 1) To discuss matters relating to the location or expansion of an industry in Harnett County 2) To discuss a personnel matter 3) To advise and give instructions to the County Attorney concerning the handling or settlement of a claim or judicial actions. The judicial actions are the cases of Asher G. Sullivan, Jr. vs. Harnett County and Jimmy Gregory vs. Duncan Jaggers. This motion is made pursuant to N.C. General Statutes section 143-3l8.ll(a) (3), (4) and (6). Commissioner Bowden seconded the motion and it passed unanimously. Commissioner Hill moved for the Board to come out of closed session. Breakfast was provided by the Sheriff department's kitchen staff. In reports from the legislators, Representative Don Davis briefed the Commissioners on c\... ..u~ legislation. Of particular interest is the redistricting plan. Representative Davis reported the House redistricting plan will not split Harnett County contrary to the Senate plan, which divides the county into two districts. Other bills of discussion in the House are: sales tax being returned to schools, a bill to reduce inheritance tax, a bill to require state courts to notifY schools when students are convicted of a crime, and a bill requiring sex offenders to register with law enforcement. Representative Hall briefed the Commissioners on the following bills: a bill preventing livestock operations in a flood plain, a motorcycle helmet bill, and a bill making sale of cigarettes to minors a criminal offense. Senator Dan Page stated many of the same bills are up for discussion in the Senate. . Senator Page stated the Senate Agriculture Committee is recommending match funds to be appropriated to North Carolina State University to study control of livestock odors. \ -- - -~...-. - ..- -~ ..-.-- ----.-~,,~ - -- c'~ ?
