Blanchard, Clerk to the Board Chairman Andrews called the meeting to order at 7:00 p.m. Commissioner Bowden led the pledge of allegiance. Commissioner Titchener made a motion to add tax refunds under new business, and to move the item concerning hunting regulations to right after consideration of the consent agenda. Commissioner Hill seconded the motion and it passed unanimously. Commissioner Hill moved to approve the agenda as published with the above changes. . Commissioner Byrd seconded the motion and it passed unanimously. Statements have been sent to these customers on a monthly basis, as well as delinquent letters requesting payment, with no response. The total amount to be written off is $1050.35. DESIGNATION OF 12. .Resolution authorizing designation of official depository (Attachment 3) DEPOSITORY Presentations regarding hunting regulations were presented to the Board by the following HUNTING REGS. citizens: PRESENTATIONS 1. David Chatellier, Spring Lake, read a petition which asked the Board for two things: to establish a law preventing hunting from roads and road rights of way, and to establish a law preventing hunting deer with dogs on private lands without written permission of the landowner. . 2. Allen Lytch, attorney representing several hunting clubs, addressed the Board and stated that there are enough laws regulating hunting and asked the Board to not support any additional restrictions on hunting. 3. Cary Stewart, Rt. 1, Lillington, stated that he is surprised we are still talking about the hunting issue. He thought it was decided last year that we already had enough laws regulating hunting. 4. Jay Smith, high school student at Harnett Central and a hunter, spoke about hunting being a family tradition, that hunting is a privilege and that hunters as a whole should not be punished for the wrongs of a few hunters. 5. Larry Howard, lifelong resident of Harnett County, thinks hunting from a pick-up parked on the side of the road should be allowed, especially on your own property. 6. Willie Young, Rt. 1, Spring Lake, hunter, states he tries to do the right thing when he hunts. 7. Reggie Akers, supports the petition requesting additional regulations. He stated that there is no incentive to keep people from running dogs on others' property. 8. Mike Story, Rt. 1, Broadway, supports the petition requesting additional . regulations. 9. Junior Roberts, retired N.C. Highway Patrol, stated that while a patrolman he did not experience anyone being injured by hunters shooting from the roadside. Mr. Roberts does not support the petition requesting additional regulations. Chairman Andrews explained that the Board of Commissioners would take no action concerning the hunting issue at this meeting. The Board will have a special meeting on February 25, 1997 and will consider the hunting issue at that time. INFORMAL COMMENTS During the informal comment period, Mr. Nash Hardee voiced his concern with time that site plans are valid. Mr. Hardee asked that the fee and time limit for site plans be reviewed and reconsidered, particularly if there (lre no changes to the site plan. - ,--~.- 590 APPOINTMENTS Board of Health Commissioner Titchener moved to appoint Dr: Patrick H. Gray, Dunn, to fill the unexpired term of Dr. Manuel Lopez who resigned. Commissioner Hill seconded the motion and it passed unanimously. Harnett County Youth Planninl! :e9?-rQ. Commissioner Bowden moyed to reappoint Angela Baker, Juvenile Intake Counselor with the Court System, and Alyson Bunker, Juvenile Officer with the Court System. Commissioner Byrd seconded the motion and it passed unanimously. . ~ ETJ Planninl! Board - Town of Anl!ier Commissioner Bowden moved to reappoint Mark Wilkins for a three-year term which will expire 1/1/2000. Commissioner Hill seconded the motion and it passed unanimously. Board of Eoualization and Rvv;(!w Commissioner Hill moved to appoint the below listed citizens to the Board of Equalization and Review. Commissioner Titchener seconded the motion and it passed unanimously. In the past, the Board of Commissioners have served as the Board of Equalization and Review. By resolution adopted January 6, 1997, a Special Board of Equalization and Review was created to consist of five members representing each of the five commissioners' districts. The members will serve a one year term. District 1 Carnell Robinson, Dunn District 2 Dennis Boyette, Dunn District 3 Darrell Smith, Coats District 4 Thomas Moore, Rt. 2, Fuquay-Varina District 5 Jerry Bullock, Rt. 1, Bunnlevel Commissioner Bowden moved to remove from the table, consideration of a zoning change ZONING CHANGE request for lA. Gregory and Donald Gregory. Commissioner Byrd seconded the motion and REQUEST FOR J.A. it passed unanimously. A public hearing was held May 15, 1995, but consideration of the GREGORY & DONALD matter was tabled. Eric Braun, attorney representing the Gregorys, reviewed the zoning GREGORY change request and asked those present in support of the zoning change request to stand. . Seven people stood in support. Jim Deming, resident from Angier, spoke in opposition of th request and asked those present who opposed the requested change to stand. Nine people stood in opposition. Dwight Snow, County Attorney, presented for the Board's consideration three viable options: (1) the Planning Board's recommendation to rezone 185.0 acres +/- affecting 29 parcels with the exception that the Alvin GerrelI property (parcel # 6632) to remain RA-30 as requested by Mr. Gerrell. The Gregory property was recommended for RA- 20M and the remainder recommended for RA-20R except for the Conservation District which is unchanged. (2) Rezone only the Gregory's property to 20M. (3) Make no changes. Commissioner Bowden moved to approve rezoning of the Gregory's property (40 acres +/-) to 20M Zoning District except for the portion within the Conservation District. Commissioner Byrd seconded the motion and it passed 3 to 2 with Commissioners Hill and Titchener casting dissenting votes. ZONING CHANGE Chairman Andrews called to order a public hearing on a zoning change request for Small REQUEST FOR Business Administration (Timberlyne Cabinet Company Property), represented by Jimmy TIMBERLYNE CABINET Johnson, from RA-30 Zoning District to Industrial Zoning District, SR 1440, Black River COMPANY PROPERTY Township, 4.097 acres. George Jackson, Planning Director, presented the zoning change request and stated that the purpose of the public hearing is to obtain public comments regarding the request. Chairman Andrews opened the meeting for public comments. Jimmy Johnson provided history and reason for the requested change. There being no further comments, Chairman Andrews closed the public hearing. The Planning Board recommended approval of the zoning change request. Commissioner Bowden moved for approval of the zoning change request for the Small Business Administration (Timberlyne Cabinet Company . Property). Commissioner Titchener seconded the motion and it passed unanimously. Mayor Frank Lewis, Town of Lillington, addressed the Board regarding recommendations for naming of the new DSS/Health facilities. FEASIBILITY STUDY Rodney M. Tart, Public Utilities Director, presented the feasibility study for the Northwest NW WATER & SEWER Water & Sewer District, Phase II. Commissioner Bowden moved to authorize the engineer to proceed with plans and specifications to complete the project and authorize the staff to arrange financing. (Tony) Wilder, Assistant County Manager, presented a proposed contract for cleaning CLEANING SERVICES services for the DSS/Health facilities. Commissioner Byrd moved to table the matter until the TABLED special meeting, February 25, 1997. Commissioner Bowden seconded the motion and it passed unanimously. APPLI. FOR GRANT Neil Emory, County Manager, presented a request for authorization for staff to proceed with FARM CHIMICALS application for a state grant to establish a recycling program for farm chemical containers. RECYCLING Commissioner Titchener moved to authorize staff to proceed with application for the funding as requested. Commissioner Bowden seconded the motion and it passed unanimously. . Neil Emory, County Manager, reviewed the list of items on the agenda for the special meeting February 25, 1997. The county manager was instructed to submit a request to NC DOT for a guardrail on Hwy. 301 north of Dunn near Johnston County. RESOLUTION RE: Commissioner Bowden moved to authorize staff to submit a resolution regarding financing for the Central Carolina Community College construction project. Commissioner Hill seconded FINANCING IMPROV. the motion and it passed unanimously. (Attachment 4) CCCC TEMP. EASEMENT Commissioner Bowden moved to authorize a temporary easement to NC Natural Gas in order NC NAT. GAS to speed up the process of moving a gas line at the Governmental Complex site. Commissioner Hill seconded the motion and it passed unanimously. TAX REFUNDS Commissioner Titchener moved to approve requested tax refunds. Commissioner Bowden seconded the motion and it passed unanimously. (Attachment 5) Departmental reports were filed with the Board from Economic Development, Emergency Medical Service, Veterans Affairs and Health Department. There being no further business, Commissioner Bowden moved for adjournment. Commissioner Hill seconded the motion and it passed unanimously. (KNAPP BUIWING) WHEREAS, the Institute of Government since 1931 has made important contributions to North Carolina's government and its excellent financial management by serving the entire state from its base in Chapel Hill; and WHEREAS, the Institute's building has been inadequate and outmoded for many years, which threatens its ability to maintain the highest quality of services for North Carolina's public officials; and WHEREAS, the 1994 General Assembly recognized the need for a renovated and expanded building by appropriating $700,000 to plan necessary improvements and additions to the Institute of Government; and WHEREAS, the Institute has planned the necessary capital improvements . that will enable it to provide North Carolina public officials with the latest and most efficient instructional technologies and a higher quality of service; and WHEREAS, the necessary improvements will include a teleconferencing classroom, a computer training room, increased classroom and office space, an . expanded and accessible library, increased parking, improved dining facilities, and access for persons with disabilities; and WHEREAS, the planned capital project has been approved by the UNC-CH Board of Trustees and is ratted as one of the University's highest capital priorities, and it also is a legislativ~ priority for the UNC Board of Governors. NOW, THEREFORE, BE IT RESOLVED, that by way of this resolution, Harnett County Government fully and enthusiastically encourages the 1997 North Carolina General Assembly to appropriate $16.1 million to fund this urgently needed capital renovation and expansion project. RESOLUTION WHEREAS, Harnett County has pledged to match state bond proceeds which are for the purpose of capital improvements at Central Carolina Community College's Harnett County Campus; and WHEREAS, to meet its commitment, Harnett County has chosen to finance its portion of the project; and WHEREAS, Central Carolina Community College is prepared to proceed with the construction of a new classroom building at the Harnett County Campus; and WHEREAS, in order to finance this project, Harnett County must acquire ownership of property upon which the building is to be built; and : WHEREAS, current State Statutes prohibits the college from transferring the property in question. . NOW THEREFORE, BE IT RESOLVED that the Harnett County Board of Commissioners does hereby request that its local legislative delegation introduce a local act which would allow Harnett County to acquire property for the use by Central Carolina Community College and would also authorize Central Carolina Community College Board of Trustees to convey property to the County in connection with improvement and repair of the property.
