Members present: Beatrice B. Hill, Vice Chairman Joseph T. Bowden Walt Titchener Staff present: Neil Emory, County Manager Kay S. Blanchard, Clerk to the Board RESOLUTION RE: Neil Emory, County Manager, presented for the Board's PRICE GOUGING consideration, a proposed ordinance regarding price gouging. Commissioner Titchener moved for adoption of the ordinance. Commissioner Bowden seconded the motion and it passed with a unanimous vote. Whereas, a state of emergency was declared in Harnett County, North . Carolina on September 6, 1996; and Whereas, certain merchants are now taking advantage of the emergency by increasing prices for essential goods - called "Price Gouging". NOW TImREFORE, The Harnett County Board of Commissioners hereby prohibits any merchant selling any goods or providing any services within the incorporated area of Harnett County, North Carolina from raising prices above the pre-disaster (pre September 6, 1996) levies. Sales of goods or services at a price above pre-disaster level shall only be permissible if merchants can document in writing the purchase of these goods at increased cost. Violation of the provisions of this ordinance known as "Ordinanace Prohibiting Price Gouging" is punishable by a fine of up to $200.00 per incident and 30 days in jail. Each sale shall constitute a separate offense. Effective immediately, September 11, 1996.
