Al Bain, Public Utilities Attorney, presented for the Board consideration a resolution authorizing issuance and sale of bond anticipation notes. Commissioner Bowden moved for adoption of the resolution. . Commissioner Andrews seconded the motion and it passed with a unanimous vote. (Attachment 6) Chairman Sorrell closed the South Central portion of the meeting. Chairman Sorrell called to order a public hearing on requested ZONING CHANGE zoning change for John Hunter Holland and Milton Andrew Holland, REQUEST from RA-40 Zoning District to Commercial Zoning District, SR 1437, Hector's Creek Township, 2 acres. George Jackson, Planning JOHN HOLLAND Director, presented the zoning change request and stated that the MILTON HOLLAND purpose of the public hearing is to obtain public comments regarding the request. Chairman Sorrell opened the meeting for public comments. No comments were offered and the public hearing was closed. The Planning Board recommended approval of the zoning change request. Commissioner Andrews moved for approval of the zoning change request for John Hunter Holland and Milton Andrew Holland. Commissioner Titch~ner seconded the motion and it passed with a unanimous vote. . ~Jj ~~1 1 ..:.:' :1 ~_I_ Chairman Sorrell called to order a public hearing on proposed PUBLIC HEARffiNG resolution amending the Harnett County Zoning Ordinance Text ZONING ORD. concerning Board of Adjustment membership. George Jackson, AMENDMENT Planning Director, presented the resolution and stated that the purpose of the public hearing is to obtain comments from the public regarding the proposed amendment. Chairman Sorrell opened the meeting for public comments. No comments were offered and the public hearing was closed. Commissioner Bowden moved for adoption of the resolution. Commissioner Hill seconded the motion and it passed with a unanimous vote. (Attachment 7) . SHAWTOWN Steve Player, The Wooten Company, provided an update on REVITALIZATION continuing community revitalization work within the Shawtown area. Chairman Sorrell called to order a public hearing and Mr. Player stated that this was the first of two required public hearings for the submission of a new Community Development Block Grant application for revitalization in the Shawtown area. Chairman Sorrell opened the meeting for public comments. No comments were offered and Chairman Sorrell closed the public hearing. Steve Player, The Wooten Company, reported that the County has a limited amount of funds from the North Carolina Housing Finance Agency to provide housing rehabilitation assistance to eligible homeowners for owner occupied dwellings in unincorporated areas of the County. Funding is available to assist elderly homeowners (age 62 or above) and homeowners with a handicap or disability. A proposed list of recipients to receive single family housing rehabilitation funds was left with the Clerk to the Board for review by the Board and others who may be interested. patricia Crissman, The Wooten Company, briefed the Board on the redevelopment planning process required for CDBG programs. This process ties in with the County's existing Community Development Block Grant program. A proposed resolution will be considered at the next regular Board meeting which would designate the Board of Commissioners to undertake the powers, duties, and responsibilities of a Redevelopment Commission. . Capt. Steve West, Chief Deputy, Sheriff's Department, requested authorization to submit a grant application to the Local Law Enforcement Block Grants Program. Commissioner Titchener moved to authorize submission of the grant application. Commissioner Andrews seconded the motion and it passed with a unanimous vote. PROPOSALS FOR Wm. A. (Tony) Wilder, Assistant County Manager, presented the CLEANING SERVo following proposals to provide cleaning services for the new FOR NEW BLDGS. DSS/Health/Aging Building: 1. Piedmont Pressure Wash, Godwin----------------114,400 Commissioner Titchener moved to approve a three-month trial basis contract with A Clean Sweep, Maintenance and Cleaning Service, Inc. COmmissioner Hill s~conded the motion and it passed with a unanimous vote. Wm. A. (Tony) Wilder, Assistant County Manager, presented for the RUNWAY Board's consideration a work Authorization for Professional EXTENSION Services with Talbert & Bright, Inc. to prepare plans to be used . by the military to build a runway extension at the Harnett County Airport. Commissioner Titchener moved for approval of the work authorization as presented. Commissioner Andrews seconded the motion and it passed with a unanimous vote. BOARD OPTIONS DWight,W. Snow, County Attorney, discussed Board options RE. HUNTING regard~ng hunting regulations. Mr. Snow noted that on February . 19th, a public forum was held in the Commissioners Room regarding REGULATIONS a dispute between some Harnett County landowners and some hunters. The two issues that came out of that public forum was whether local laws were needed making it illegal to hunt from any public road or highway, and whether local laws were needed making it illegal to pursue or take deer with dogs on any privately owned land without permission of the landowner. Mr. Snow commented that problems arise when development occurs where hunters are accustom to "wilderness" type hunting. There are two forms of action the Board of Commis~ioners may take: adopt a ._.~~ ~~- ~-----. JP'~ r) , ;1 f.J*, ~' ":, ,;':-.::. :;.:-- local ordinance which would be enforced by the Sheriff's Department, or the Board could request local legislation from State officials which would be enforced by the State Wildlife enforcement officers and the Sheriff's Department officers. After discussion, the Board decided to take no action at this time regarding the matter. BD. OF ED. REQUEST Neil Emory, County Manager, presented for the Board's consideration, a request from the Board of Education to transfer TO TRANSFER FUNDS funds from current expense to capital outlay. This type of transfer requires approval by the Board of Commissioners. Commissioner Titchener moved to authorize transfer of funds as requested. Commissioner Bowden seconded the motion and it passed with a unanimous vote. 911 FUNDS TO BE USED Neil Emory, County Manager, presented a request from the . FOR RECORDING Sheriff's Department for authorization to utilize 911 funds to EQUIPMENT purchase a new recording system to replace recording equipment that was damaged by lightning. Commissioner Andrews moved to authorize the purchase using 911 funds, contingent upon approval by Purchasing. Commissioner Bowden seconded the motion and it passed with a unanimous vote. Departmental reports were filed with the Board from Veterans Affairs, Health Department, Fire Marshal, Emergency Medical Service, Economic Development, Department of Social Services, and Tax Attorney (Attachment 8). NEW REPORT DEVELOPED Mr. Emory distributed a new report to the Board that was FOR PUBLIC UTILITIES developed by the Finance Office and Public Utilities. This SYSTEMS report will keep the Board informed on County constructed utility systems and how many units are currently being added. ADJOURNMENT There being no further business, Commissioner Hill moved for adjournment. Commissioner Bowden seconded the motion and it passed with a unanimous vote. Resolution Requesting Amendment to State Water Supply Watershed Protection Map WHEREAS, the Environmental Management Commission has recently issued an interpretative statement setting forth its intent with respect to the delineation of protected areas for WS-IV water supply watersheds on the state water supply watershed protection - maps where the intake is located directly in a stream or river (run-of-the-river intakes); and, WHEREAS, as a result thereof, the definition of "Protected Area" as found in the applicable provisions of the North Carolina Administrative Code, has been clarified such that the ten. (10) mile protected area for WS-IV water supply intakes located directly in a su:eam or nver may be measured using ten (10) stream miles in lieu often (10) land mdes; and, ,WHEREAS, as a local government affected by such int.:.....c.lative statement, it is . the desire of the governing body of the County of Harnett that the watershed area over which it has jurisdiction be redefined and redrawn so as to reflect the interpretation above described. NOW THEREFORE, BE IT RESOLVED by the governing body of the County of Harnett as follows: 1. The Harnett County Board of Commissioners, recognizing that adequate water facilities are essential to provide for good public health and economic &~ ./th, has commissioned a comprehensive water study. This study will evaluate the feasibility of adequate water facilities in the South C....l.~ and South Eastern section of the County from Lillingtoll, paralleling the western side of the Cape Fear River, to the Cumberland County line. (3) The power to fix the rate of interest to be borne by said notes and to determine the denomination or denominations of the notes and the place of payment of the notes is hereby delegated to the Chairman of the governing body of the Issuer and Clerk of the Issuer who are hereby authorized and directed to cause said notes to be prepared and to execute said notes when ~hey shall have been sold by the Local Government Commission of North Carolina. . (4) The Chairman of the governing body of the Issuer and Clerk of the Issuer are hereby authorized to make application to the Local Government Commission of North Carolina for its approval of said notes in the manner prescribed by The Local Government Finance Act. Said Local Government Commission is hereby requested to sell the notes in the manner prescribed by said Act. In addition, the Issuer hereby designates the above-mentioned notes as "qualified tax-exempt obligations" for the purposes of section 265(b) (3) of the Code. . WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North Carolina, particularly G.S. IS3A, Article 18, Part 3; and WHEREAS, the Zoning Onlinance contains provisions for amending said ordinance and those provisions have been followed; and WHEREAS, the Harnett County Planning Board has reviewed Article XII, Section 1.1 of the Zoning Ordinance and recommends the adoption of the following amendment. NOW. lHEREFORE BE IT RESOLVED BY TIlE BOARD OF COMMISSIONERS OF HARNEIT COUNlY, NORTII CAROLINA that Article XII, Section l.l of the Zoning Ordinance be amended by deleting the existing pamgraph and adding the following: The Board of Adjustment is hereby created, which shall consist of five (5) members and three (3) or more alternates who shall all be citizens of Harnett County, North Carolina.
