HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, AUGUST 15, 1994
Note: The regular meeting the first Monday in August was cancelled due to Commissioners
being at the NCACC Annual Conference.
I The Harnett County Board of Commissioners met in regular session on
Monday, August 15, 1994, in the Commissioners Meeting Room, County
Office Building, Lillington, North Carolina.

Chairman Sorrell called the meeting to order at 7 p.m. and
Commissioner Andrews offered the invocation.
Commissioner Titchener made a motion to delete from the agenda the
item concerning appointments to the Emergency Medical Services
Council and to add tax refunds. Commissioner Hill seconded the motion
and it passed with a unanimous vote.
Commissioner Hill moved to approve the agenda as published with
changes mentioned above. Commissioner Andrews seconded the motion and
it passed with a unanimous vote.
Upon motion by Commissioner Titchener and seconded by Commissioner
Bowden, the board unanimously approved the following items on the

of Johnsonville). Ms. Bullard would like zoning in the area.
2. Teresa Moore, Rt. 2, Cameron, concerns with proposed sand pit
operation
3 . Floyd Hein, Anderson Creek area, question concerning dry taps
4. Steve McNeil, Benhaven area, requested that a position be
filled immediately to assist the Western Harnett Community
with recreation.
5. Jerry Stogner, Rt. 1, Anderson Creek, requested recreation
position be filled as soon as possible.
6 . David Stewart, Rt. 3, Lillington, requested recreation
position be filled as soon as possible.
7 . Sol Kozma, Dunn, concerns with motorized bicycles on the
highway
8 . Bernard Young, Angier, against zoning
9. Lewis Cummings, Rt. 3, Lillington, request for assistance
with recreation in the Western Harnett Community
DSS AWARDS Jack Bryan, Director, Department of Social Services, reported that the
Department of Social Services had recently received two awards. Mr.
Bryan presented an award from the South Eastern Region's $6 million
Club to Ms. Nancy Johnson, Food Stamp Supervisor, and an award from the
North Carolina Social Services Association for the Best Community
Project, 1993-94, to Ms. April Collins, who headed up the project this
year.
Neil Emory, County Manager, reported to the Board that the State of
SMART START North Carolina is now accepting applications for the second phase of
Smart Start. He then presented the Board with the membership list of
the Board of Directors of Harnett Partnership For Children, who are
I preparing the application. Commissioner Titchener moved that the Board
endorse the Harnett Partnership for Children as applicant for Smart
Start and applaud their efforts in the interest of the children of
Harnett County. Commissioner Bowden seconded the motion and it passed
with a unanimous vote.
Chairman Sorrell called to order a public hearing on zoning change
ZONING CHANGE APPLI. request application for Rocky and Michele Caudle and others, SR 1549,
ROCKY CAUDLE & OTHERS Grove Township, RA-20M to RA-30, 300 acres. George Jackson, Planning
Director, presented the application and briefed the group that the
purpose of the public hearing was to obtain comments from the public
concerning the zoning change request. Chairman Sorrell opened the
meeting for public comments. Comments were provided by the following
citizens:

and family AGAINST
3 . Gerald Hayes, Attorney representing Clark Langdon and
family, and Edward Turlington and family AGAINST

There being no further comments, Chairman Sorrell closed the public
hearing. Mr. Jackson presented the application for consideration by the
Board. The Planning Board sent the application forward to the
Commissioners without a specific recommendation. Commissioner Andrews
made a motion to table the matter until legality of zoning of that area
in 1988 can be explored. Commissioner Bowden seconded the motion. The
motion was defeated with a 3 to 2 vote. Commissioner Bowden then moved
to leave the property zoned as it is currently (RA-20M) . Commissioner
Titchener seconded the motion and it passed 4 to 1 with Commissioner
I Andrews casting the dissenting vote.
NORTHWEST W & S Chairman Sorrell stated that the Board would now consider matters
sitting in its capacity as the governing body of the Northwest Water
and Sewer District of Harnett County. Al Bain, Public Utilities
Attorney, presented a proposed resolution calling for a public
hearing at the Commissioner's next regular Board meeting on September
6, 1994, at 9 a.m. Commissioner Andrews moved to adopt the resolution.
Commissioner Bowden seconded the motion and it passed with a unanimous
vote. (Attachment 4)
RESOLUTION RE: Bobby Wicker, Tax Administrator, presented a proposed resolution to
METHOD OF DETERMINING establish method of determining correct land acreages for tax
CORRECT LAND ACREAGES assessments. Commissioner Bowden moved to adopt the resolution.
FOR TAX ASSESSMENTS Commissioner Andrews seconded the motion and it passed with a unanimous

Lee Sudia, Fire Marshal, presented a proposed penalty schedule for
SCHEDULE FOR FIRE CODE North Carolina Fire Code violations. Commissioner Andrews moved to
table the matter. Commissioner Bowden seconded the motion and it
passed with a unanimous vote.
APPOINTMENTS & REAPPOINT. Commissioner Bowden moved to approve the following list of appointments
and reappointments. Commissioner Andrews seconded the motion and it
passed with a unanimous vote.
Domiciliary Home Community Advisory Committee - reappointed Alma
Wellons and Ruth Woodall for three-year terms which will expire I
8/31/97, and appointed Lillian Ferrell for a three-year term
which will expire 8/31/97.
Zoning Ordinance Board of Adjustment - reappointed Lois Hall for
a three-year term as an alternate which will expire 9/1/94, and
appointed Sam Reid for a three-year term which will expire 9-1-94.
Harnett Economic Development Commission - reappointed Charles
Carpenter and George Joseph, Jr. for three-year terms which will
expire 9-1-97.
Mid-Carolina Aging Advisory Committee - appointed Colman H. Lucas
to fill the unexpired term of Kie Hudson. The term will expire
3-1-96.
Mid-Carolina Nursing Home Advisory Committee - appointed Frances
Johnson to fill the unexpired term of Donald Clark. The term will
expire 12-31-94.
Lee-Harnett Criminal Justice Alliance Advisory Board appointments:
Joe Bowden, Neil Emory, Wiley Bowen, Larry Knott, Lena Langdon,
Billie Stevens, Louise Bruckner, L.T. Easley, and Sam Burgess.

SUPERVISION OF ANIMAL At the last Board Meeting, the Commissioners asked the County Attorney,
CONTROL AND ENVIRONMENTAL Dwight Snow, to explore legality of removi~g Animal Control and
HEALTH Environmental Health from jurisdiction of the Health Department. Mr.
Snow provided the Board with a Legal Memorandum giving his legal
opinion regarding these issues, stating why both sections must remain
under the purview of the Health Department. In the case of Animal
Control, a local act by the General Assembly requires supervision by
the Health Department, while Health Department supervision of I
Environmental Health is required state wide.
LEASE WITH TOWN OF Neil Emory, County Manager, recommended that the County lease property
from the Town of Lillington on which to build an animal control

CONTROL FACILITY SITE finalize a lease agreement with the Town of Lillington for a period of
20 years and that the County Manager be authorized to proceed with.

Titchener seconded the motion and it passed with a unanimous vote.
Neil Emory, County Manager, reported to the Board that plans are
complete and the County is now prepared to receive bids for the
PROCEED WITH ACCEPTING construction of the DSS/Health/Aging building. Commissioner Titchener
BIDS FOR DSS/HEALTH/ moved that the County Manager be authorized to proceed with accepting
AGING BUILDING bids for the building project. Commissioner Andrews seconded the
motion and it passed with a unanimous vote.
RESOLUTION DECLARING Neil Emory, County Manager, presented a proposed resolution declaring
ITEMS SURPLUS FOR ANNUAL property surplus for the annual sale. Commissioner Titchener moved for
SALE adoption of the resolution and that Jerry Blanchard, General Services
Manager, be authorized to execute titles of vehicles sold at the
Surplus Sale. Commissioner Hill seconded the motion and it passed with
a unanimous vote. (Attachment 6)
COUNTY MANAGER'S REPORT The following matters were discussed in the County Manager's report:
- Mr. Emory stated that bids had been received for the proposed
Administration Building as part of Public Utilities improvements and
all bids were over budget. Commissioner Hill moved that all bids for
the project be rejected. Commissioner Bowden seconded the motion and it
passed with a unanimous vote. I
- Mr. Emory briefed the Board that applications were being accepted
GRANT APPLI. FOR DEVEL. for a $200,000 grant toward development of a Family Resource Center.
OF FAMILY RESOURCE CENTER Commissioner Bowden made a motion that the County move forward with
making application for the grant. Commissioner Andrews seconded the
motion and it passed with a unanimous vote.
- Mr. Emory briefed the Board that a draft of a proposed tattoo
ordinance for Harnett County will be provided at the next Board
meeting.
- Mr. Emory briefed the Board that the Strategic Plan Steering
Committee will meet at the end of August to get underway and that there
will be a Public Forum in mid September for public input.

Commissioner Hill moved that the Board go into executive session to
discuss personnel matters. Commissioner Bowden seconded the motion and
it passed with a unanimous vote.
Commissioner Titchener moved that the Board come out of executive
I session. Commissioner Andrews seconded the motion and it passed with a
unanimous vote.
BOBBY WICKER APPOINTED Commissioner Andrews moved to appoint Bobby L. Wicker, Tax
TAX ADMINISTRATOR Administrator for a three-year term. Commissioner Bowden seconded
the motion and it passed 3 to 2 with Commissioners Hill and Titchener
casting the dissenting votes. Chairman Sorrell administered the oath
of office to Mr. Wicker.
Commissioner Andrews moved to approve salary modifications as discussed
SALARY MODIFICATIONS in executive session. Commissioner Bowden seconded the motion and it
passed with a unanimous vote. Funds were appropriated in the FY 94-95
Budget for this purpose.
ADDITIONAL COUNTY-WIDE Commissioner Bowden moved to approve an additional county-wide position
in the Parks and Recreation Department and to direct county staff to
POSITION IN PARKS & REC. develop a job description for the position and proceed with filling the
position. Commissioner Andrews seconded the motion and it passed
3 to 2 with Commissioners Titchener and Sorrell casting the dissenting
, votes.
ADJOURNMENT There being no further business, the Harnett County Board of
Commissioners regular meeting, August 15, 1994, duly adjourned at 10:15
p.m.

The Board of Commissioners of the County of Harnett, sitting
as the governing body of the Northwest Water and Sewer District
of Harnett County, convened in a special setting during its
meeting held on August 15, 1994 at 7:00 p.m. in the Harnett County
Office Building, 102 East Front Street, Lillington, North
Carolina.
Board Members present were: H. L. Sorrell, Jr. , (Chairman); I
Walt Titchener; Beatrice Bailey Hill; Dan B. Andrews and
Joseph T. Bowden.

Commissioner Andrews presented the following resolution
and moved that it be adopted:
WHEREAS, a bond order entitled "BOND ORDER AUTHORIZING
THE ISSUANCE OF $2,600,000 WATER BONDS OF NORTHWEST WATER AND
SEWER DISTRICT OF HARNETT COUNTY," adopted by the Board of
commissioners of the County of Harnett, sitting as the governing
body of the Northwest Water and Sewer District (the "District"),

on August 31, 1987, took effect on November 3, 1987; and
WHEREAS, $996,000 of bonds remain authorized and
unissued pursuant to said bond order; and
WHEREAS, the maximum period within which bonds and bond
anticipation notes may be issued pursuant to said bond order is a
period expiring on November 3, 1994; and
I WHEREAS, the Board of commissioners of the County of
Harnett, sitting as the governing body of the District, desires
to extend the period within which bonds and bond anticipation
notes may be issued pursuant to said bond order from seven years
to ten years; and
WHEREAS, the Board of commissioners of the County of
Harnett, sitting as the governing body of the District, has filed
an application with the Local Government Commission requesting an
extension of the maximum period during which bonds and bond
anticipation notes may be issued by the District pursuant to said
water bond order adopted by said Board on August 31, 1987; and
WHEREAS, the Commission has entered an order approving
the proposed extension; and
WHEREAS, the Board of Commissioners of the County of
Harnett, sitting as the governing body of the District, desires
to hold a public hearing on the proposed extension as required by
G.S. 159-64: NOW, THEREFORE,
I BE IT RESOLVED by the Board of Commissioners of the
County of Harnett, sitting as the governing body of the District,
as follows:
1- The action taken by City officials in filing an
application with the Local Government c.........ission for approval of
the extension of the period during which bonds and bond
anticipation notes may be issued pursuant to the water bond
order adopted by the Board on August 31, 1987, from seven years
to ten years, is hereby ratified and confirmed.
2. A public hearing shall be held on the question of
extending the period of time during which bonds and bond
anticipation notes may be issued by the District pursuant to the
water bond order adopted by the Board of commissioners of the
County of Harnett, sitting as the governing body of the District,
on August 31, 1987. The public hearing shall be held on the 6th
day of September, 1994, at 9:00 o'clock, ~.M. at the County
Office Building Lillington, North Carolina.

I 3. The Clerk of the Board of commissioners of the
County of Harnett and Clerk of the District is hereby directed to
cause a copy of the water bond order to be published with a
notice of such hearing in the form prescribed by law in a

NORTH CAROLINA
RESOLUTION TO ESTABLISH METHOD OF DETERMINING
CORRECT LAND ACREAGES FOR TAX ASSESSMENTS
WHEREAS, the assessed acreages of many parcels in Harnett I
County have been arrived at since the days of "giving in" taxes and
are not tied to a recorded deed; and
WHEREAS, the assessed acreages of many parcels in Harnett
County have been arrived at by reference to older legal
descriptions contained in deeds not prepared from accurate or
modern surveys; and
WHEREAS, Harnett County currently has available for assistance
in arri ving at accurate land description interpretations from
modern orthophoto based maps tied to the North Carolina State Plane
Coordinate System, 1983 North American Datum, compiled at National
Map Accuracy Standards; and
WHEREAS, the land descriptions and resulting acreage
determinations arrived at through the Harnett County GIS System
is more accurate and, therefore, fairer to the taxpayer, the taxing
authority, and the taxpaying public than the historical acreage
information heretofore used for tax assessment purposes;
NOW, THEREFORE, BE IT RESOLVED:
( 1 ) That the Harnett County Land Records/GIS Department shall
attempt to arrive at accurate acreage figures for all assessed real
property in Harnett County by relying on plats of surveys which
shall be subjectively evaluated for accuracy; and if no accurate
plat is available, such acreage shall be arrived at by digitizing
the interpreted land description to the tolerance standards
recommended by the North Carolina Ad Valorem Tax Division of the
North Carolina Department of Revenue and the North Carolina Land
Records Management Program.
(2) A plat of survey, to be considered accurate, must meet I
the requirements of North Carolina General statute 47-30 et seq.
and other applicable sections of the General Statutes. In all
cases wherein the divergence between the parcel's deed acreage (or
historical real property acreage used for tax assessment purposes)
and computer generated acreage exceed the maximum tolerance
established by the North Carolina Ad Valorem Tax Division of the
North Carolina Department of Revenue and the North Carolina Land
Records Management Program from time to time, the listing taxpayer
and record owner shall be notified in writing of such discrepancy
in acreages and shall be given fifteen (15) days to respond and
present evidence to the Harnett County Land RecordS/GIS Department
of any contended acreages applicable to such parcel. If no
response is received, the acreage figures calculated for such
parcel by the Harnett County Land Records/GIS Department shall
become the tax assessment acreage effective with the January 1 tax
listing of the following year. If a response and evidence is
received within fifteen (15) days, the Land Records Office will
evaluate same and notify the listing taxpayer and record owner
within thirty (30) days. Any disagreements on the part of listing
taxpayers or record owners shall be resolved as provided by law
through appeals from the Harnett County Tax Administrator to the
Board of Equalization and Review.
(3) Acreage figures calculated from the new computerized
maps, as provided in paragraph (2) above, shall continue as the
assessed acreage for property tax purposes unless changed as
provided in the General Statutes of North Carolina, or through
future conveyances and/or surveys which provide a more accurate
land description.
(4) There shall be no releases or refunds resulting from a
reduction and no discoveries resulting from an increase in assessed
acreage through the method outlined herein except as provided in
the General Statutes of North Carolina. I
