The Harnett County Board of Commissioners met in regular session on
Monday, June 6, 1994, in the Commissioners Meeting Room, County Office
Building, Lillington, North Carolina.

Chairman Sorrell called the meeting to order at 9 a.m. and
Commissioner Andrews offered the invocation.
Commissioner Hill made a motion to delete the agenda item concerning
appointments to Mid-Carolina PIC. Commissioner Andrews seconded the
motion and it passed with a unanimous vote.
Commissioner Bowden moved to approve the agenda as published with the ,
change noted above. Commissioner Titchener seconded the motion and it
passed with a unanimous vote.
Upon motion by Commissioner Hill and seconded by Commissioner
Titchener, the Board unanimously approved the following items on the

TAX REFUNDS Chairman Sorrell called to order a public hearing on the proposed F.Y.
PUBLIC HEARING ON 94-95 Harnett County Budget. Neil Emory, Budget Officer, presented
FY 94-95 BUDGET the proposed budget and stated that the purpose of the public hearing
wa~ to obtain comments from the public concerning the proposed budget.
No comments were offered and Chairman Sorrell closed the public
hearing.
PUBLIC HEARING ON Chairman Sorrell called to order a public hearing on proposed Home and
FUNDING PLAN FOR Community Care Block Grant Funding Plan for Older Adults. Betty
OLDER ADULTS Stewart, Aging Administrator, Mid-Carolina Council of Governments,
presented the proposed plan and stated that the purpose of the public I
hearing was to obtain comments from the public concerning the funding
plan for older adults. No comments were offered and Chairman Sorrell
closed the public hearing. Commissioner Bowden moved for approval of
the Home and Community Care Block Grant Funding Plan for Older Adults
as presented. Commissioner Andrews seconded the motion and it passed
with a unanimous vote.
Jerry Blanchard, General Services Director, presented for the Board's
RESOLUTION RE: consideration a proposed resolution concerning state requirement for
ALUMINUM CAN BAN ban of aluminum cans in the landfills. Commissioner Bowden moved for
adoption of the resolution. Commissioner Hill seconded the motion and
it passed with a unanimous vote. (Attachment 4)
STATE-COUNTY CRIMINAL Neil Emory, County Manager, presented a proposed resolution and
JUSTICE PARTNERSHIP briefed the Board on the requirement for appointment regarding NC
ACT State-County Criminal Justice Partnership Act. Commissioner Bowden
moved for adoption of the resolution. Commissioner Sorrell seconded
the motion and it passed with a unanimous vote. Commissioner Andrews
made a motion to appoint Commissioner Bowden to represent Harnett
County on the Criminal Justice partnership Advisory Board.
Commissioner Titchener seconded the motion and it passed with a
unanimous vote. (Attachment 5)
Commissioner Titchener moved to authorize the county manager to
CONTRACT TO PROVIDE negotiate and enter into a contract with North Carolina Natural Gas
GAS SERVICE TO which would provide for gas service to the governmental complex.
GOVERNMENTAL COMPLEX Commissioner Bowden seconded the motion and it passed with a unanimous
vote.
The following reports were filed with the Board: Tax Releases,
Sheriff's Department, Fire Marshal, Emergency Medical Service, and Tax --
Department.
Cor.missioner Hill moved that the Board go into executive session to
diEcuss legal and personnel matters. Commissioner Andrews seconded --
the motion and it passed with a unanimous vote.
Commissioner Hill moved that the Board come out of executive session.
Commissioner Bowden seconded the motion and it passed with a unanimous
vote.
WATER SHORTAGE Al Bain, Public Utilities Attorney, presented for the Board's
consideration a proposed water shortage and conservation ordinance for
ORDINANCE the Harnett County Department of Public Utilities to encourage

volunteer conservation. Commissioner Bowden moved for adoption of the
ordinance. Commissioner Hill seconded the motion and it passed with
unanimous vote. The ordinance is copied in full in Ordinance Book 1,
page 424, and recorded at Harnett County Register of Deeds, Book 1065,
page 397.
I PUBLIC HEARING ON Lyndo Tippett, North Carolina Department of Transportation Board
member, presented the proposed 1994-95 Secondary Road Improvement
FY 94-95 DOT SECON- Program for Harnett County. Chairman Sorrell called to order a public
DARY ROAD IMPROVEMENT hearing on the proposed road program. John G. Nance, District
PROGRAM Engineer, Department of Transportation, reviewed the proposed road
program and stated that the purpose of the public hearing was to
obtain public comments concerning the proposed program. Comments were
received from Keith Thomas, Rt. 3, Lillington regarding SR 1251 (Peach
Farm Road), and T. T. Smith, Driftwood Drive, Raleigh, regarding SR
1350 (Ball Road). There being no further comments, Chairman Sorrell
closed the public hearing. Commissioner Andrews moved for adoption of
the 1994-95 Secondary Road Improvement Program for Harnett County as
presented. Commissioner Bowden seconded the motion and it passed with
a unanimous vote.
There being no further business, the Harnett County Board of

BE IT RESOLVED, that on the 1..0 l-~ day of ifuu' , 1994,
the Harnett County Board of Commissioners hereb approves the
Harnett County application for matching funds and technical
assistance under the North Carolina Land Records Management Program
(LRMP), under the provisions of N.C.G.S. 102-15 through 17; and
BE IT FURTHER RESOLVED, that:
1. The application for grant assistance for F.Y. 94-95 be in
the amount of $110,000.00.
2. Harnett County has the necessary funds in its General Fund
F.Y. 94-95 to match the grant amount awarded under the
LRMP and will assign said funds to the project upon notice
of the award.
3. Harnett County Government shares a willingness to
\ participate in the LRMP and will comply with all
applicable laws and regulations.

RESOLUTION
RESOLUTION BANNING ALUMINUM CANS
FROM LANDFILLS AND INCINERATORS
WHEREAS, SENATE BILL 59, AN ACT TO PROHIBIT THE
DISPOSAL OF CERTAIN CLASSES OF SOLID WASTE IN LANDFILLS OR
BY INCINERATION. Section 1. , G.S. 130A-309.10, subsections
I ( f ) . (f1) , (g) , and (h) applies to aluminum cans, effective
July 1. 1994; and
WHEREAS. the County of Harnett will incorporate the State
law banning aluminum cans in the Harnett County Solid Waste
Ordinance and intends to enforce the ban; and
WHEREAS, aluminum cans are recyclable; and
WHEREAS. disposal. processing and recycling options for
aluminum cans are available in the County of Harnett;
NOW. THEREFORE. BE IT RESOLVED that the following
policies be applicable to aluminum cans in the County of
Harnett and County-owned solid waste management facilities or
facilities that are authorized by the State of North
Carolina to be permitted by the County of Harnett until such
time as it is altered, modified, or rescinded by the Board
of Commissionersl

l. The disposal of aluminum cans is prohibited in
County-owned landfills and incinerators, for which
a permit is required. in the County of Harnett, after
July 1, 1994.
2. No person shall knowingly dispose of aluminum cans
by incineration for which a permit is required in
the County of Harnett (this shall not apply to solid
waste incinerated in an incinerator solely owned I
and operated by the generator of the solid waste)
after July 1, 1994.
4. The County of Harnett shall identify alternative
disposal, processing, or recycling options for
aluminum cans.
5. Each municipality in the County of Harnett is
encouraged to adopt a resolution that recognizes
provisions of Senate Bill 59, states the purpose
of Senate Bill 59, and provides local commitment
programs for aluminum cans.
6. The County of Harnett shall provide information
to public and private sectors of available facilities
for recycling aluminum cans.

RESOLUTION FOR HARNETT COUNTY'S PARTICIPATION IN A
MULTI-COUNTY PLANNING INITIATIVE UNDER THE
NORTH CAROLINA STATE-COUNTY CRIMINAL JUSTICE PARTNERSHIP ACT
WHEREAS, the North Carolina General Assembly ratified
an amendment to Chapter 143B of the General Statutes in
1993, thereby creating the North Carolina State-county
Criminal Justice Partnership Act; and
WHEREAS, this new legislation is an attempt by the
State of North Carolina to:
( 1) Provide $12 million and technical assistance to
counties for developing supplemental community-
based corrections programs which appropriately
punish and rehabilitate non-violent criminals; I
( 2 ) Expand the sentencing options available to local
judges for non-violent criminals who receive
non-incarcerative sentences;
(3) Promote effective coordination between State and
County community-based corrections programs; and
( 4 ) Improve public confidence in the criminal justice
system by educating the public regarding the role
of community-based corrections programs; and
WHEREAS, under the new law, counties wishing to apply
for technical assistance (effective July 1994) and funding
(effective April 1, 1995) must first have their Board of
Commissioners approve the decision to apply and appoint a
local County Criminal Justice Partnership Advisory Board;
and

WHEREAS, the State of North Carolina is strongly
encouraging multi-county initiatives and offering financial
incentives for such efforts; and
WHEREAS, the 11th Judicial District, which is comprised
of Lee, Harnett, and Johnston Counties, is served by the
same District Court Judges and District Attorney; and
I WHEREAS, each of these three counties could benefit
from jointly developing and implementing a comprehensive
Community-Based Corrections Plan for the 11th Judicial
District.
NOW, THEREFORE, BE IT RESOLVED THAT the Harnett County
Board of Commissioners agrees to work in conjunction with
the Boards of Commissioners from Lee and Johnston Counties
to ensure that the following eligibility requirements for a
multi-county initiative under the North Carolina
State-County Criminal Justice Partnership Act are duly
realized:
( 1 ) Ensure through adoption of similar resolutions
that all three counties comprising the 11th
Judicial District agree in principle to jointly
develop a comprehensive Community-Based
Corrections Plan and agree in advance to jointly
apply for the technical assistance and funding
necessary to implement the plan; and
( 2 ) Ensure creation of a Criminal Justice Partnership
Advisory Board for the 11th Judicial District
which shall be comprised of appointed members from
throughout the tri-county region and which shall
have the following powers and duties:
(a) To conduct the planning process for
development of a comprehensive Community-
Based Corrections Plan for the 11th Judicial
District;
(b) To submit the plan to the appropriate Boards
of County Commissioners for approval within
I one year of the last appointment to the
Advisory Board;
(c) To review and revise the plan on a continual
basis and make formal recommendations
annually to the appropriate Boards of County
Commissioners concerning its implementation
and operation for the ensuing year; and
(d) To monitor and evaluate the impact of any
Community-Based Corrections Programming
already in existence or implemented under the
North Carolina State-County Criminal Justice
Partnership Act and prepare semi-annual
written reports with recommendations for the
appropriate Boards of County Commissioners.
