HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, SFPTEMBER 20, 1993
The Harnett County Board of Commissioners met in regular session on
Monday, September 20, 1993, in the Commissioners Meeting Room, County
Office Building, Lillington, North Carolina. I

Chairman Sorrell called the meeting to order at 7 p.m. and
Commissioner Hill offered the invocation.
Commissioner Hill made a motion to approve the agenda as published
with the addition of two resolutions to the Consent Agenda portion.
Commissioner Andrews seconded the motion and it passed with a
unanimous vote.
Upon motion made by Commissioner Bowden and seconded by Commissioner
Hill, the Board voted unanimously to approve the following items from
the Consent Agenda:

TO EDC the Economic Development Board to replace Clyde Adams who wished not to
be reappointed.~~ Commissioner Andrews seconded the motion
and it passed with a unanimous vote.
DISCUSSION OF PROPOSED Commissioner Andrews moved to adopt proposed bylaws for the Cemetery
CEMETERY BOARD BYLAWS Board and to appoint four members to the Cemetery Board. Commissioner
Bowden seconded the motion. After discussion, Commissioner Andrews
withdrew the motion and Commissioner Bowden withdrew the second.
Commissioner Titchener moved that consideration of the proposed bylaws
be tabled. Commissioner Hill seconded the motion and it passed with a
unanimous vote.
APPOINTMENTS TO CEMETERY Commissioner Titchener moved for the appointment of the following
BOARD OF TRUSTEES:
members to the Harnett County Cemetery Board of Trustees:

Commissioner Bowden seconded the motion and it passed with a unanimous
vote.
PUBLIC HEARINGS & CONSI. Chairman Sorrell called to order a public hearing on a zoning change
ZONING CHANGE APPLI. application for Mazie J. Pope, et aI, from RA-40 to RA-30 Zoning
District, Neill's Creek Township, Hwy. 210, 88.7 acres. George
I MAZIE J. POPE, ET AL Jackson, Planning Director, presented the application and briefed the
group that the purpose of the public hearing was to obtain comments
from the public concerning the zoning change re~uest. Chairman
Sorrell opened the meeting for public comments. Comments were
provided by Dallas H. Pope, representing the applicants. There being
no further comments, Chairman Sorrell closed the public hearing. Mr.
Jackson presented the application for consideration by the Board. The
Planning Board recommended approval of the zoning change request.
Commissioner Titchener requested that he abstain from voting because
of family ties. The Board approved his request. Commissioner Andrews
made a motion that the zoning change request be approved.
Commissioner Bowden seconded the motion and it passed 3 to 1 with
Chairman Sorrell casting the dissenting vote.

Chairman Sorrell called to order a public hearing on a zoning change
application for Hoke Smith, from RA-20M to RA-40 Zoning District,
HOKE SMITH Hector's Creek Township, SR 1403, 81.27 acres. George Jackson,
Planning Director, presented the application and briefed the group
that the purpose of the public hearing was to obtain comments from the
public concerning the zoning change request. Chairman Sorrell opened
the meeting for public comments. Comments were provided by Hoke
Smith, applicant. There being no further comments, Chairman Sorrell
closed the public hearing. Mr. Jackson presented the application for
consideration by the Board. The Planning Board recommended approval
of the zoning change request. Commissioner Titchener made a motion
that the zoning change request be approved. Commissioner Andrews I
seconded the motion and it passed with a unanimous vote.
Chairman Sorrell called to order a public hearing on a zoning change
application for Dennis Pope Turlington, from RA-30 to RA-20R Zoning
DENNIS POPE TURLINGTON District, Grove Township, SR 2005, 31.31 acres. George Jackson,
Planni"g Director, presented the application and briefed the group
that t~e purpose of the public hearing was to obtain comments from the
public concerning the zoning change request. Chairman Sorrell opened
the meeting for public comments. Comments were provided by the
following citizens:

There being no further comments, Chairman Sorrell closed the public
hearing. Mr. Jackson presented the application for consideration by
the Board. The Planning Board recommended that the zoning change
request be denied. Commissioner Titchener made a motion that the
zoning change request be denied. Commissioner Hill seconded the
motion and it passed with a unanimous vote.
SOUTH CENTRAL W & S Chairman Sorrell stated that at this time the Board would consider
certain matters sitting in its capacity as the governing body of South
Central Water & Sewer District of Harnett County.
Rev. C. P. Tarkington, Chairman, South Central Water & Sewer District
Board, requested that the Board of Commissioners authorize engineering
services and direct that the staff make preparations for a bond
refere~dum concerning South Central Phase III project. Commissioner
Bowden moved to authorize to proceed with design, plans and
specifications in connection with the construction of South Central I
Phase III and to direct the Public Utilities Staff to make preparation
for a bond referendum to be held after the first of next year to
finance the project. Commissioner Andrews seconded the motion and it
passed with a unanimous vote.
Chairman Sorrell closed the South Central Water & Sewer District
portion of the meeting.
REQUEST FOR AUTHORI- Rodney Tart, Public Utilities Director, requested that the Board
ZATION FOR R.F.P authorize receipt of Requests for Proposals for design of water
FOR DESIGN OF WATER treatment plant expansion. Commissioner Titchener moved to authorize
TREATMENT PLANT EXPAN. the Public Utilities Staff to proceed with the distribution and
receipt of Request for proposals for the design of the County's water
treatment plant expansion. Commissioner Bowden seconded the motion
and it passed with a unanimous vote.
SOUTHWEST W & S Chairman Sorrell stated that at this time the Board would consider
certaia matters sitting in its capacity as the governing body of
Southwost Water & Sewer District of Harnett County.
Jim Osborne, Vice-Chairman, Southwest Water & Sewer District Board,
reques~ed that the Board of Commissioners authorize design for
South Central upgrade and authorize engineering services for Southwest
Phase II project. Commissioner Bowden moved to authorize to proceed
with design, plans and specifications for South Central upgrade and to
authorize engineering services for Southwest Phase II. Commissioner
Andrews seconded the motion and it passed with a unanimous vote.
Al Bain, Public Utilities Attorney, presented for the Board's
consideration an agreement between Southwest Water & Sewer District
and Patten Corporation for conveyance of sewer system. Commissioner
Andrews moved to approve agreement between Southwest Water and Sewer I
District and Patten Corporation and to authorize the Chairman to
execute the agreement on behalf of the District. Commissioner Bowden
seconded the motion and it passed with a unanimous vote.
Chairman Sorrell closed the Southwest Water & Sewer District portion
of the meeting.
LEASE AGREEMENT WITH Tony Wilder, Assistant County Manager, presented for the Board's
ELS-LILLINGTON FOR consideration a proposed lease agreement between ELS-Lillington and
DSS OFFICE SPACE County of Harnett for lease of building and lot locateG near the
inters3ction of U.S. 401 and N.C. 210 highways, in the Town of
Lillin~ton, to be used as additional office space for the Department
of Soc~al Services. Commissioner Andrews moved for approval of the
lease agreement. Commissioner Bowden seconded the motion and it
passed with a unanimous vote.

ORD. RESTRICTING Tony Wilder, Assistant County Manager, presented for the Board's
VEHICLE USAGE ON consideration a proposed ordinance restricting vehicle usage on
AIRPORT PROPERTY Harnett County Airport property. Commissioner Titchener moved for
adoption of the ordinance. Commissioner Bowden seconded the motion
and it passed with a unanimous vote. (See Attachment 3 at the end of
these minutes)
The following reports were filed with the Board: Health Department,
I Fire Marshal's Office, Tax Releases, and Operating Budget Report.
There being no further business, the Harnett County Board of
Commissioners regular Meeting, September 20, 1993, duly adjourned at

RESOLUTION ACKNOWLEDGING
I OCTOBER 3-9, 1993 AS NATIONAL
FIRE PREVENTION WEEK
THAT WHEREAS. in 1871, a fire in Chicago. Illinois known
as the "Great Chicago Fire" took 250 lives and destroyed
17.430 buildings; and
WHEREAS. in 1911. the Fire Marshal's Association of
North America first designated the anniversary of this
tragedy Fire Prevention Day. dedicated to encouraging fire
safety; and
WHEREAS, in 1922, President Warren G. Harding proclaimed
National Fire Prevention Week and that the National Fire
Protection Association is the official sponsor of National
Fire Prevention Week; and
WHEREAS, the Theme of Fire Prevention Week 1993 is "Get
Out, Stay Out: Your Fire Safe Response" in hopes of teaching
people to resist the temptation to re-enter a bur~ing
building:
NOW, THEREFORE, BE IT RESOLVED by the Board of
Commissioners of the County of Harnett that October 3-9.
1993 is acknowledged as Fire Prevention Week in Harnett
County and that a copy of this resolution should be entered
into the regular minutes of this meeting and copies shall be
distributed to the media for distribution to the general
public.

RESOLUTION ACKNOWLEDGING
OCTOBER 3. 1993 AS NATIONAL
FALLEN FIREFIGHTERS DAY
THAT WHEREAS. the firefighters of Harnett County
numbering in excess of 600 provide professional t unselfish
and dedicated service to the citizens of Harnett County.
North Carolina; and
WHEREAS. these firefighters answer the call to alarm
without regard to t~me of day. weather or other personal
desires. or danger to their persons; and
WHEREAS. firefighting has been determined to be the most
hazardous of occupations and that firefighters. both career
and volunteer. will suffer the loss of more than 100 of their
brother and sister firefighters this year; and
NOW. THEREFORE. BE IT.RESOLVED by the Board of
Commissioners of the County of Harnett that October 3. 1993
be acknowledged as National Fallen Firefighter's Day in order
to pay homage to the fallen firefighters in North Carolina
and other states who unselfishly and without hesitation made
the supreme sacrifice to come to the aid of another. and by
doing so have answered their final alarm and that a copy of
this resolution should be entered into the regular minutes of
this meeting and copies shall be distributed to the media for
distribution to the general public.

AN ORDINANCE RESTRICTING VEHICLE USAGE
OF HARNETT COUNTY AIRPORT PROPERTY
BE IT ORDAINED BY THE COUNTY BOARD OF COMMISSIONERS OF HARNETT
COUNTY:
Section 1. Authoritv. I
This ordinance is adopted pursuant to North Carolina General
Statute 153A-275, which statute permits a County, by ordinance, to
adopt reasonable rules and regulations to protect and regulate a
public enterprise belonging to or operated by it.
Section 2. Purpose.
The purpose of this ordinance is to prohibit all vehicular
traff~.:: on or wi thin the runway, taxiways, and their respective
objec'_ free areas in the interest of safety. The rt.:1way object
free c.:.:ea extends out 200' on either side of the runway centerline
and eA~ends 500' beyond each runway end. The taxiway object free
area extends out 45' on either side of all taxiway centerlines.

Section 3. Exceptions.
Vehicles exempted from this ordinance are airport maintenance
vehicles, crash/fire/rescue or other emergency vehicles, law
enforcement vehicles, vehicles used on approved construction
I projacts, vehicles used by the State, the County or their
designated agents for the purpose of inspecting the runway,
taxiways, or other Airport facilities, and other exemptions
authorized by the County.
Section 4. Penalty.
If any person shall violate any provision, rule or regulation
of this Ordinance, he shall be guilty of a misdemeanor and upon
conviction punished as prescribed by North Carolina General Statute
14-4. Each day that a person shall continue to do any act in
violation of such provision, rule or regulation shall constitute a
distinct and separate offense. Further, this ordinance may be
enforced by injunction and order of abatement as provided for in
N.C.G.S. 153A-123.
Section 5. Severability.
If any section, sentence, clause or phrase of this Ordinance
is for any reason held to be invalid, such decision shall not
affect the validity of the remaining portions of this Ordinance.
Adopted by the Harnett County Board of Commissioners at its regular
meeting of September :J.D , 1993.
