HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, APRIL 19, 1993
The Harnett County Board of Commissioners met in regular session on
Monday, April 19, 1993, in the Commissioners Meeting Room, County
Office Building, Lillington, North Carolina.

Chairman Sorrell called the meeting to order at 7 p.m. and
Commissioner Titchener led the group in the pledge to the flag and
invocation.
Commissioner Hill moved to approve the agenda as published.
Commissioner Bowden seconded the motion and it passed with a unanimous
vote.

INFORMAL COMMENTS Informal comments were provided by Mr. Hugh Williams concerning the
requirement for the County to take responsibility for abandoned
cemeteries located in the County.
CYPRESS CHURCH COMMUNITY Neil Emory, County Manager, presented a review of concerns which were

NOT APPROVED addressed concerns regarding water service in the area. Roger Holder,
representative of Cypress Church Community Citizens Association,
reviewed the concerns and stated that the main concerns were law
enforcement, and fire and rescue services in the area. Mr. Holder
asked that the southwest corner of the County located in Johnsonville
Township be allowed to secede from Harnett County and become a part of
Moore County. James Osborne, Detective, Sheriff's Department,
provided comments on lack of Sheriff's deputies in the Western section
of the County. Jackie Upton, citizen from Rt. 3, Cameron, stated that
he had received good service from Benhaven Rescue and requests that
the area remain in Harnett County. Larry Knott, Chief Deputy,
Sheriff's Department, explained that deputies are placed in certain
areas based on population and number of calls received for a given
area. After discussion by the Board, Commissioner Andrews made a I
motion that the County improve services in the Cypress Church
Community area and that the Cypress Creek Church area remain in
Harnett County. Commissioner Bowden seconded the motion and it passed
with a unanimous vote.
RESOLUTION OF APPRECIA- A resolution of appreciation, which the Board adopted by acclamation,
TION TO JOHN M. PHELPS was presented to John M. Phelps, II, former Public Utilities Attorney,
by Rodney M. Tart, Public Utilities Director. Chairman Sorrell
presented a plaque from the Board to Mr. Phelps in honor and
appreciation of his outstanding service and contributions to Harnett
County as Public Utilities Attorney, 1986-1993. The resolution is
copied in full at the end of these minutes as Attachment 1.
PROCLAMATION FOR Rodney M. Tart, Public Utilities Director, presented for the Board's
"WATER WEEK" consideration, a proclamation to designate the week of May 2-8, 1993,
as "Water Week". Commissioner Bowden moved for adoption of the
proclamation. Commissioner Hill seconded the motion and it passed
with a unanimous vote. The proclamation is copied in full at the end
of these minutes as Attachment 2.
SOL KOZMA Sol Kozma, citizen from Dunn, briefed the Board on his concerns
regarding welfare check and food stamp fraud. Mr. Kozma asked that
rules be established for accountability of recipients and that
incentives be provided for recipients to work. The Board requested
that a letter be sent from the County to our legislative
representatives voicing these concerns.
EDC BOARD MEHBERSHIP There was a request at the last Board meeting that an additional
member be added to the Economic Development Commission. Neil Emory,
County Manager, briefed the Board that in order to appoint an
additional member to the EDC, the Commissioners would be required to I
amend Article V of the existing bylaws to provide for six at-large
seats. However, N.C. General Statute 158-8 provides that an EDC
should consist of three to nine members, and currently Harnett County
EDC has ten members. It was noted that one of the current members now
resides outside of Harnett County and is not eligible to be a member
of the Board. Commissioner Titchener moved to appoint Tom Cooley,
Lillington, to the Economic Development Commission Board pending on
notification of the member who lives outside the county that he is no
longer on the Board. Dwight Snow, County Attorney, cited the General
Statute which provides that the EDC shall have three to nine members
and recommended that the Board abide by the General Statute.
Commissioner Titchener withdrew his motion. Commissioner Hill moved
that the matter be tabled. Commissioner Bowden seconded the motion

CEMETERY BOARD OF Neil Emory, County Manager, briefed the Board concerning N.C. General
TRUSTEES Statute with directs each county to take responsibility for abandoned
cemeteries in their community. Commissioner Bowden moved to authorize
the County Manager to develop bylaws and enabling resolution for a
Harnett County Cemetery Board of Trustees, and that Hugh Williams be
appointed to the Board of Trustees. Commissioner Titchener seconded
I the motion and it passed with a unanimous vote.
PROCLAMATION FOR Neil Emory, County Manager, presented for the Board's consideration a
"COUNTY GOVERNMENT WEEK" proclamation to designate the week of April 17-24, 1993, as "County
Government Week". Commissioner Andrews moved for adoption of the
resolution. Commissioner Bowden seconded the motion and it passed
with a unanimous vote. The proclamation is copied in full at the end
of these minutes as Attachment 3. The group viewed a video on local
government in North Carolina.
Neil Emory, County Manager, informed the Board that the proposed F.Y.
93-94 Budget for Harnett County would be presented at the May 3rd
Board of Commissioners meeting.
The following reports were filed with the Board: Planning Department,
Fire Marshal's Office, and Operating Budget. The Tax Attorney's
report and report of intra-departmental budget amendments were also
filed with the Board and are copied in full at the end of these
minutes as Attachments 4 and 5.
Commissioner Hill moved that the Board go into executive session to
discuss litigation and personnel matters. Commissioner Andrews
seconded the motion and it passed with a unanimous vote.
Commissioner Titchener moved that the Board come out of executive
session. Commissioner Bowden seconded the motion and it passed with a
unanimous vote.
ADJOURNMENT There being no further business, the Harnett County Board of
Commissioners regular meeting, April 19, 1993, duly adjourned at 10:20
p.m.

WHEREAS, John M. Phelps, II was appointed as Harnett County Public Utilities
A ttorney by the Harnett County Board of Commissioners in December 1, 1986, and
has been reappointed consecutively since that date through December 2, 1993,
serving seven years as U.~ilities Attorney; and
WHEREAS, John M. Phelps, II's outstanding professional leadership in the
field of local government law has served to provide all Harnett County local utilities
government functional units exceptional legal support and service; and
WHEREAS, his outstanding professional abilities, his deep concern for good
government, and his strong commitment to provide better service to all the citizens
of Hurnett County has exalted him to a position of honor, respect, and esteem by his
colleagues and all who know him; and
WHEREAS, being an imaginative and innovative professional, he has made a
,"ujor contribution to the development of water and sewer systems throughout
Harnett County through his leadership as Public Utilities Attorney; and
WHEREAS, his professional and excellent leadership in the field of local
government law has won him recognition as an outstanding Public Utilities Attorney;
and
WHEREAS, through his extensive and thorough knowledge of public utility
law, John M. Phelps, II has enabled Harnett County to be recognized us a leader in
the State of North Carolina for public utility services.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners that John M. Phelps, II is hereby commended on behalf of all the
citizens cf Hurnett County for his service and contributions to the growth and
developm~nt of Harnett County. The Board does hereby express its appreciation for I
his outstanding leadership, integrity, honesty, and hard work that serves as an
example to all who have known him. The Board is honored to take this opportunity
to recognize one of its finest and most valuable citizens.

WHEREAS, Harnett County Department of Public Utilities has water and sewer
facilities available to the majority of Harnett County; and
WHEREAS, Harnett County Department of Public Utilities insures and provides
safe drinking water for the citizens of Harnett County; and
WHEREAS, Harnett County Department of Public Utilities is instrumental in
making the public aware of the necessity to conserve water, one of our most valuable
natural resources; and
WHEREAS, Harnett County Department of Public Utilities, in cooperation with
the National Rural Water Association, desires to set aside a special week for focusing
on water issues and the service provided by local water utilities;
NOW, THEREFORE, WE THE HARNETT COUNTY BOARD OF COMMISSIONERS,

TO DESIGNATE THE WEEK OF APRIL 17 - 24, 1993, AS
NATIONAL COUNTY GOVERNMENT WEEK
WHEREAS, ApriL 23rd, 1993, is the 125th Anniversary of the modern
form of county government in North Carolina as created by the North
Carolina Constitution of 1868; and
WHEREAS, North Carolina's 100 county governments have in fact
served this state since 1663, working in partnership with the State to
deliver services and provide leadership for our communities; and
WHEREAS, the citizens and taxpayers of Harnett County provide
through their tax dollars the resources necessary to fund county
services; and
WHEREAS, Harnett County is on the forefront of many issues
critical to both our state and nation, including health care, child
and elder care, environmental protection, social services, job
training, emergency medical services, drug and alcohol abuse
treatment, law enforcement, water and sewer services, and l~brary
services.
WHEREAS, Harnett County also is a major partner in the public
education system, having provided $5j million in 1992-93 to support
elementary-secondary schools and $121,000 to support the community
college system.
WHEREAS, Harnett County is involved in many innovative programs
to help deliver services more effectively and efficiently.
WHEREAS, those serving as county officials are dedicated to
providing services to our citizens without undue burden on the
taxpayers.
NOW, THEREFORE, THE HARNETT COLA....l BOARD OF COMMISSIONERS does I
hereby proclaim April 17 through April 24, 1993, as "National County
Government Week in Harnett County, North Carolina" and urge all
